paid by the party of the second part, does !!reby grant and release unto the party j~nd~eJrs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improveJOents thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated on a diagram of lots belonging to Jane A.
Cochran, dated October 1867 and duly filed in the Office of the Clerk
of the County of Suffolk as and by Lots 26, 27 and 28, said lots when
taken together are more particularly bounded and described as follows:
BEGINNING at a point on the westerly side of Locust Lane distant 129.79
feet southerly from the intersection of the southerly side of Main Road
with the westerly side of Locust Lane;
running thence along the westerly side of Locust Lane South 22 degrees
21 minutes 20 seconds East 155.50 feet to lands of F. Berry Estate;
thence along said lands and also along lands of N. Corbett South 73
degrees 21 minutes 50 seconds West 162.91 feet to lands of J. Walters;
thence along said land North 17 degrees 10 minutes West 48.80 feet to
the southeast corner of lands of D. Finne;
thence along said lands North 18 degrees 05 minutes 50 seconds West
109.47 feet to lands of Albertson and Katz;
thence along said lands of Albertson and Katz (1) North 71 degrees 55
minutes 40 seconds East 38.81 feet; and (2) North 75 degrees 42 minutes
East 111.69 feet to the westerly side of Locust Lane and the point or
place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the
first part and Gertrude Katz as tenants in common each as to a one-half
undivided interest by deed from Judith Zaveski, James Michael Lucey,
Kathleen Marie Lucey and Patricia Lucey dated May 19, 1982 and recorded
in the Suffolk County Clerk's Office on July 7, 1982 in Liber 9207 page
596.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads ahutting the ahove descrihed premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumLered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and wiJ1 hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
