in the Declaration of Condominium entitled Eastwind Shores Condo-
minium made by Solar Symmetry, Inc. under Article 9-B of the New
York Real Property Law dated March 26, 1985, and recorded in the
Office of the Clerk of the County of Suffolk on the 2nd day of
April, 1984, in Liber 9763, at Page 562, covering the property
therein described.
The land area of the property is described as follows :
ALL that certain plot, piece or parcel of land, situate,
lying and being at Arshamomoque, in the Town of Southold, County
of Suffolk and State of New York, bounded and described as follows :
BEGINNING at a point on the southerly side of Middle
Road, where it is intersected by the easterly side of land now or
formerly of Herman; running thence along the southerly side of
Middle Road, the following two courses and distances : (1) along
an arc of curve bearing to the right with a radius of 1877 .08 feet
a distance of 149. 55 feet; (2) North 65 degrees 55 minutes 50
seconds Fast 91 feet to land now or formerly of Leonard and
others; thence along land now or formerly of Leonard and others,
South 45 degrees 12 minutes 10 seconds East, 518. 24 feet to high
water mark of Arshamomoque Pond; thence along Arshamomoque Pond as
it winds and turns to land now or formerly of Goetz, said point of
interesection of the land of Goetz with the high water mark of
Arshamomoque Pond lies South 50 degrees 18 minutes West a distance
of 196. 78 feet from the point where the westerly side of land now
or formerly of Leonard and others intersects the high water mark
of Arshamomoque Pond ; thence along land now or formerly of Goetz,
Bagley and Herman, North 48 degrees 42 minutes 50 seconds West,
566 . 77 feet to the southerly side of Middle Road at the point or
place of BEGINNING.
SUBJECT TO the provisions of the Declaration, By-Laws,
site plan and floor plans of the Condominium recorded or filed
simultaneously with and as a part of the Declaration, as the same
may be amended from time to time by instruments recorded or filed
in the Office of the Clerk of the County of Suffolk, which provi-
sions, together with any amendments thereto shall constitute cove-
nants running with the land and shall bind any person having at
