The party of the second part does hereby covenant and agree that the party of
the first part shall be permitted to discharge surface water from the remaining lands
of the party of the first part into a sump to be constructed by the party of the second
part on the above described premises, such permission to continue so long as said
remaining lands of the party of the first part are used for agricultural purposes.
