BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED SEPTEMBER 11, 1990, AUTHORIZING
THE CONSTRUCTION OF STREET IMPROVEMENTS ALONG
GLENN ROAD AND SHEPPARD DRIVE, IN SAID TOWN,
STATING THE ESTIMATED MAXIMUM COST THEREOF IS
$40,000, APPROPRIATING SAID AMOUNT THEREFOR,
AND AUTHORIZING THE ISSUANCE OF $40,000 SERIAL
BONDS OF SAID TOWN TO FINANCE SAID
APPROPRIATION.

WHEREAS, following the submission of a petition
requesting the permanent improvement of Glenn Road and Sheppard
Drive in the Town of Southold (herein called "Town"), in the
County of Suffolk, New York, at the estimated maximum cost of
$40,000, and after a public hearing duly called and held to
consider said improvements, the Town Board of the Town (herein
called "Town Board"), determined pursuant to the resolution duly
adopted on February 28, 1990, that it is in the public interest
to construct the proposed street improvements to Glen Road and
Sheppard Drive pursuant to the definite plans, specifications and
estimate of cost prepared by Sidney B. Bowne & Son, as engineers
for the Town; and
WHEREAS, it is now deemed advisable to provide financing
for said improvement by the issuance of serial bonds, or bond
anticipation notes issued in anticipation thereof, in the amount
of not to exceed $40,000;
Now, therefore, be it

RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN
THE COUNTY OF SUFFOLK, NEW YORK, (by the favorable vote of not
less than two-thirds of all the members of said Town Board) AS
FOLLOWS:
Section 1. The Town of Southold, in the County of
Suffolk, New York (herein called "Town"), is hereby authorized
to construct street improvements using flexible pavement with
penetration macadam or plant mix bottom course and heavy duty
bituminous concrete wearing surface in and along Glenn Road and
Sheppard Drive, in said Town, including curbs, gutters, culverts,
and other necessary improvements. The estimated maximum cost of
said specific object or purpose, including preliminary costs and
costs incidental thereto and the financing thereof, is $40,000
and said amount is hereby appropriated therefor. The plan of
financing includes the issuance of $40,000 serial bonds of the
Town to finance said appropriation, and the assessment, levy and
collection of special assessments from the several lots and
.,parcels of land within the Town which the Town Board shall
determine and specify to be especially benefited by said street
improvements, so much upon and from each as shall be in just
proportion to the amount of benefit which said street
improvements shall confer upon the same, to pay the principal of
said bonds and the interest thereon as the same shall become due
and payable.
Section 2. Serial bonds of the Town in the principal

the provisions of the Local Finance Law, constituting Chapter 33-

a of the Consolidated Laws of tbe State of New York (herein
called "Law") to finance said appropriation.
Section 3. The following additional matters are hereby
determined and declared:
(a) The period of probable usefulness of said specific
object or purpose for which said $40,000 serial bonds authorized
pursuant to this resolution are to be issued, within the
limitations of Section 11.00 a. 20(c) of the Law, is fifteen (15)
years.
(b) Current funds are not required by tbe Law to be
provided as a down payment prior to the issuance of the bonds
authorized by this resolution or any bond anticipation notes
issued in anticipation thereof in accordance with Section 107.00
d. 3{i) of the Law.
(c) The proposed maturity of the bonds authorized by
this resolution will exceed five (5) years.
Section 4. Each of the bonds authorized by this
resolution and any bond anticipa~ion notes issued in anticipation
of the sale of said bonds shall contain the recital of validity
as prescribed by Section 52.00 of the Law and said bonds and any
notes issued in anticipation of said bonds, shall be general
obligations of the To~n, payable as to both principal and
interest by general tax upon all the taxable real property within
the Town without limitation of rate or amount. The faith and
credit of the Town are hereby irrevocably pledged to the punctual
payment of the principal of and interest on said bonds and any
notes issued in anticipation of the sale of said bonds and

provision shall be made annually in the budget of tbe Town by
appropriation for (al the amortization and redemption of the
bonds and any notes in anticipation thereof to mature in such
year and (bl the payment of interest to be due and payable in
such year.
Section 5. Subject to the provisions of this resolution
and of the Law and pursuant to the provisions of Section 30.00
relative to the authorization of the issuance of bond
anticipation notes and of Section 50.00 and Sections 56.00 to
60.00 of the Law, the powers and duties of the Town Board
relative to authorizing bond anticipation notes and prescribing
the terms, form and contents and as to the sale and issuance of
the bonds herein authorized and of any bond anticipation notes
issued in anticipation of said bonds, and the renewals of said
notes, are hereby delegated to the Supervisor, the chief fiscal
officer of the Town.
Section 6. The validity of the bonds authorized by this
resolution and of any notes issued in anticipation of the sale of
said bonds, may be contested only if:
(a) such obligations are authorized for an object or
purpose for which the Town is not authorized to
expend money, or
(b) the provisions of law which should be complied with
at the date of the publication of such resolution
are not substantially complied with,
and an action, suit or proceeding contesting such validity, is
commenced within twenty days after the date of such publication,
or

(c) such obligations are authorized in violation of the
provisions of the constitution.
Section 7. This bond resolution shall take effect
immediately, and the Town Clerk of the Town, is hereby authorized
and directed to publish the foregoing resolution, in full,
together with a Notice attached in substantially the form
prescribed by 581.00 of the Law in " THE LONG ISLAND
TRAVELER-WATCHMAN," a newspaper published in Southold, New York,
and in "THE SUFFOLK TIMES", a newspaper published in Mattituck,
New York, two newspapers having a general circulation in the Town
and hereby designated the official newspapers of said Town for
such publication.

and duly put to a vote on roll call,
which resulted as follows:

Several weeks ago, a question arose from Claire Glew regarding the
assessment method on the above referenced District. That is, was
assessment to be based on assessed valuations or equally amongst the
property owners (I believe the terminology is Ad Valorem or Benefit Use).
As documentation, a homeowner in the area had presented to Claire a copy
of the petition to the Town Board indicating that assessment would be equal
amongst the property owners. I have spoken with Matt Kiernan about this;
Matt has tried to contact the attorney representing the homeowners in an
attempt to answer this question. Several days ago, Matt indicated that he
had not yet heard from this attorney,
It is my opinion that the Assessors should follow up this matter
directly with the Town Attorney's Office.

The Planning Board reviewed this situation at the request
of the Town Board.
Its recommendation is to connect the two roads. The
reasons behind this recommendation are:
1. Connecting the two roads will improve the access for
fire, medical and pOlice emergency vehicles.
2. Connecting the two roads will improve access and
efficiency for highway maintenance vehicles.

Proposed Connection of Sleepy Hollow Road and Glenn
Road, Southold.

November 14, 1989
At the request of the Supervisor, these roads were
inspected. The two roads service neighorhoods that are located
off the main thoroughfares of Pine Neck Road and Main Bay View
Road.
It is our joint recommendation that the two roads be
connected in the interest of promoting emergency access and
greater efficiency of services, such as snow plowing.
The connection between the two roads should be made between
the cUl-de-sacs, and not where the guardrails are located. The
guard rails are too close to the existing homes.
A serious drainage problem was noted on Shephard Drive.
Standing water as high as the floorboards of the Town car was
noted at the site of the road drains which are at the lowest
part of the road.

Dear Mr. Jacobs:
In reFerence to the road improvements being made by the town highway
department to both Glenn Road and Shepard Drive, it is the wish of
the majority of those property owners signing the petition dedicating
the roads to the town, that Glenn Road be leFt as a dead ended road.
Glenn Road has existed as a dead end road For the past twenty Five
years and any connection to the turnaround at the end of Sleepy Hollow
Lane would only exacerbate the nuisance problems that exist at the
turna.'ound and create an additional hazard to safety on Glenn Road.
If necessary, the property owners association is prepared to gather
and submit an informal petition to the town stating this request.
The roads are shaping up and we wish to thank you for the attention
being paid to our problems.

Dear Mrs. Terry:
I don't know whether you had a chance to review the West Creek Estates
road problem with the town attorney, but the highway department appear-
ed this past Teusday and cleared between four or five hundred feet of
brush from the worst area of Glenn Road. The road, in comparison to
what it was, is almost a boulevard, and you have no idea of what a
pleasure it is, not to have to worry about a head on collison when
driving through this section. I do hope this recent activity will con-
tinue and that the highway department will also take care of some of
the other serious problems before the onset of Winter. I still want to
be advised of the availability of the Survey made by Peconic Surveyors,
as well as their invoice.
You have my sincere thanks - and I sure that of my neighbors - for
whatever influence you were able to use with the town attorney in
having this work initiated. Let's hope Mr. Jacobs is able to continue
the good work.

Dear Mrs. Terry:
Although you report discouraging news, I do want to thank you for the pronpt
reply to my letter of August 29th and also my letter to councilman George
Penny. If, .as you report, Peconic Surveyors are only two-thirds complete with
their survey of Glenn Rd. and Shepard Drive after six months, it would appear
completion cannot be expected until December. I would think, assuming Mr.
Jacobs still insists on having "survey in hand", that this would be much too
late in the season to start re-building roads. I do hope Mr. Jacobs has a
big operating budget to draw upon because with rising labor and materiel
costs, more winter damage to the already damaged roads, and vdth now what
appears to be an expensive survey which was not noted in the estimate sup-
plied by the town in April, 1988, the cost will exceed that estimated. The
property owners petition accepted by the town board limited the cost to a
little more than the estimate.
I would also like to comment that if the survey was required by state or
local law, it should have been made concurrent with the title search ordered
by the town attorney's office in October, 1988, and prior to the passage of
the town board resolution accepting the dedication of the roads in February,
1989. The roads are now town property, surveyor no survey. And if -perchance-
Mr. Jacobs' fears are realized and a property owner is discovered owning to
the middle of the road, I can't imagine what the town attorney can do about
it, except make a good story for the Suffolk Times.
You are probably also aware that town records records show that this sub-
division was approved by the planning board in 1965 after the town highway
superintendent certified that the road layout met town criteria. And that
the highway department built a considerable portion of the roads at town
expense as authorized by the town board. It was truly a developer's dream.
The sub-division map was prepared by Otto Van Tuyl in 1965, has never been
revised, and is the same map that Peconic Surveyors must follow . I'll bet
Otto took nowheres near nine months, and he had to start from scratch!
Ever since the passage of the town resolution accepting the roads this past
February, we, the property owners, have been trying to locate the person in
town goverment who is in charge and has the authority to initiate the re-
building of the roads. We have written and called Supervisor Murphy with no
Success. He thought Jacobs had finished them. A letter and finally calls to
Mr. Jacobs resulted in our receiving copies of correspondence orginated by
your office, indicating it as a critical link-not necessarily in charge~
but at least you know what is going on. We still don't know who is in charge
but we hope he is not running for re-election.

I am sure you can understand our frustration. It is not only incredible, but
ludicrous that the performance of Peconic Surveyors is being tolerated by
town officials. The fact that they have been unable to provide a survey after
six months, and the absence of the survey is being used by town officials to
delay the roads, deprives at least thirty taxpaying homeowners of the safe
and decent roads they are entitled to. And Peconic Surveyors has the gall to
say they will put it to the "top of the list". Thanks a lot! I must as a
taxpayer ask what is the deal with Peconic Surveyors? Are they on contract-
and if so, do they report their charges monthly? v~o audits and approves their
invoices for payment? And most important at this time, how much are their
charges to date for the Glenn Road-Shepard Driue survey? You may not be the

injury or fatality result, the town will find themselves with a lawsuit which
will be difficult, if not impossible, to defend.

another review with the town attorney and Mr. Jacobs. My previous request for
copies of the survey, survey invoices and I want to expand to include all
pertinent information to the road district, still stands. Again, thanks for

In response to your letter of August 29, 1989, please be advised
that I do not have a survey from Peconic Surveyors of Glenn Road and
Shepard Drive as requested on March 10, 1989, and again on June 19,
1989 (copy enclosed).
After receiving your letter, and a copy of your letter to Councilman
George Penny, referencing delays "due to the Town Clerk's office", I
spoke with Superintendent of Highways Jacobs about the matter. Mr.
Jacobs went directly to Peconic Surveyors who advised him that they were
two-thirds of the way through the project, and said they would put it
at the "top of the list". Mr. Jacobs has informed me that he cannot get
started with the road work until he has the survey in hand, as
occasions have arisen where it has been discovered a property owner
owned to the center of the road.
can assure you that Glenn Road/Shepard Drive is an open file in
this office. I have reviewed it on numerous occasions with the Town
Attorney and with Superintendent of Highways Jacobs, and have been
advised each time that we must wait for the survey.
If I can be of further assistance, please do not hesitate to contact

Dear Mr. Jacobs;
We are writing concerning your plans for the restoration of the
roads in West Creek Estates, Southold, namely Glenn Road and
Shepard Drive. When Mssrs. Rehwinkel and Wilson met with you
early this year, you said you wanted to restore the roads this
spring with the exception of repaving, mentioning that once sump
mer came you would be busy with other work.
Alth.ough the potholes. have been filled several times and some
work has been done on the Shepard Drive drainage problem, no
further activity hAS been observed on the part of the highway dep
partment. The roads are still in deplorable condition. There may
be good reason for the inactivity of which we are unaware. Howp
ever after struggling for several years and going to considerable
expense to dedicate the roads to the town, the property owners
are becoming concerned about further delays, and questions are
aris.ing as: to the highway department's plans for the roads-
especially in view of the delay.
We would very much appreciate an outline of your plans for the
roads and when we can look forward to the roads being completed.

WHEREAS, said petition was duly signed by owners of real estate owning real
estate to the extent of at least one-half of the entire frontage or bounds on both
sides of such highway and also signed by resident owners owning lot less than
one-half of the frontage owned by resident owners residing in or along such high-
way; and
WHEREAS, the said petition was duly acknowledged or proved as to each signer
in the same manner as required of a deed to be recorded; and
WHEREAS, at a meeting of said Town Board duly called and held on December
13, 1988, an order was duly adopted by it and entered in its minutes, reciting the
filing of such petition, the improvements proposed and the maximum amount proposed
to be expended for the improvement as stated in such petition, to wit, the sum of
$40,000.00 and specifying that the said board would meet to consider the petition
and hear all persons interested in the subject thereof concerning the same, at the
Southold Town Hall, at Southold, in said Town, on the 10th day of January, 1988,
at 8: 00 o'clock in the evening of that day for the purpose of considering the said
petition and hearing all persons interested in the subject thereof concerning the
same; and
WHEREAS, the said order, duly certified by the Town Clerk, was duly published
and posted as required by law; and
WHEREAS, a hearing was duly held by this Town Board at the place and on
the date and - time hereinbefore mentioned, and at such place and time, the said
Town Board diddJly consider the said petition and hear all persons interested,

NOW, THEREFORE, after such hearing and upon evidence given thereat
and pursuant to the provisions of Section 200 of the Town Law of the State of
New York, it is hereby
RESO LVED that this board does hereby determine that it is in the public
interest to make the improvements petitioned for, to wit: The permanent paving
of thel'ighways set forth in said petition and the construction of such curbs,
gutters, catch basins and drainage facilities as may be necessary; and it is further
RESOLVED that Sidney B. Bowne & 'Son, as engineers for the Town, shall
prepare definite plans and specifications and make a careful estimate of the expenses
for the performance of the work; and it is further
RESO LVED that Peconic Land Surveyors, who are hereby employed for that
purpose, shall survey said highway and establish the lines and grades thereof and
such survey and a profile of the grade shall be filed in the Town Clerk's Office;
and it is further
RESOLVED that upon the completion of the aforesaid plans, specifications,
estimate of expenses, survey and profile of the grades, that the Superintendent
of Highways perform said work by using regular highway employees and that the
cost thereof to be deemed a part of the expenses of the improvement.

SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON FEBRUARY 28, 1989:
WHEREAS, West Creek Estates Property Owners Association I nc. has made application
to the Town Board of the Town of Southold to dedicate certain roads in Southold, New
York, known as GLENN ROAD and SHEPARD DRIVE, as shown and designated on a
certain map entitled, "Map of West Creek Estates at Southold", Town of Southold, Suffolk
County, New York, surveyed by Otto W. Van Tuyl and Son, Licensed land Surveyor,
Greenport, New York, dated January 28, 1963; and
WHEREAS, the Southold Town Superintendent of Highways has inspected said highway
and has advised the Town Board that he determines and orders that said highway shall
be laid out in the Town;
NOW, THEREFORE, BE IT RESOLVED that in accordance with Section 171 of the Highway
law of the State of New York, consent be and the same is given to the Superintendent
of Highways to make an order laying out the aforesaid highway, to consist of lands
described in said application as shown on certain maps attached to said application; and
BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is authorized and
directed to forthwith cause the dedication, release and deed to be recorded in the Office

SUPERVISOR MURPHY: I'd like to open a public hearing to consider the petition
for the street improvements for the residents of the West Creek Estates. The
official notice to be read by Councilman Penny.
COUNCILMAN PENNY: Legal Notice."At a meeting of the Town Board of the
Town of Southold, Suffolk County, New York, held on the 13th day of December,
1988. I n the Matter of the petition of the owners of more than one-half of the
real property fronting on Glen Road and Shepard Drive for the improvement
of said roads. Order for Meeting to Consider Petition for Street Improvements.
WHEREAS, a written petition, dated July 26, 1988, was heretofore duly filed
with this board pursuant to Section 200 of the Town Law of the State of New
York for the improvement of highways in said town known as Glen Road and
Shepard Drive, in the Town of Southold, and shown and designated on a certain
map entitled "West Creek Estates", surveyed by Otto W. Van Tuyl, Greenport,
New York, and filed in the Office of the Clerk of the County of Suffolk on August
19, 1963 as map number 3848, and this day filed in the Office of the Southold
Town Clerk, by the permanent pavement of such portion thereof as may be
necessary, and the construction of such curbs, gutters, catch basins and drainage
facilities as may be necessary; and whereas it duly appears that such petition
has been duly signed by the owners of real property owning at least one-half
of the entire frontage or bounds on both side of said highway; and whereas
it duly appears that such petition was also duly signed by resident owners
owning not less than one-half of the frontage owned by resident owners residing
in or along such highway; and whereas such petition was duly acknowledged
or proved by all the signers thereof in the same manner as a deed to be recorded;
and whereas the maximum amount proposed to be expended for the improvement
of said highways as stated in the petition is the sum of Forty Thousand Dollars
($40,000.00). it is pursuant to the provisions of said Section 200 of the Town
Law of the State of New York, hereby
ORDERED that the Town Board of the Town of Southold, Suffolk County,
New York shall meet at the Southold Town Hall, at Southold in said Town on
the 10th day of January, 1989 at 8: 00 o'clock in the afternoon of that day, for
the purpose of considering the said petition and hearing all persons interested
in the subject thereof concerning the same.

this time I would like to ask the attorney for this group, Kevin McLaughlin,
would you like to address the Town Board to make any comments?
J. KEVIN McLAUGHLIN, ESQ.: Thank you. Good evening, members of the Town
Board. Basically, I think the petition is pretty self explanatory I think we've
got the signatures and authorizations of a vast majority of people that have
property that abut along the roadways that are proposed to be improved. And
I would ask that the Board render a decision establishing such road improvement
district as we have petitioned. Thank you.
SUPERVISOR MURPHY: Thank you, Kevin. Is there anyone else would like
to speak in favor or against this? Anyone here from the Association? Don,
do you want to say something?
DONALD FREDERICK: Yes, is there anyone from the Association...
SUPERVISOR MURPHY: Anyone can speak at this time.
DONALD FREDERICK: I'm Donald Frederick. I've lived in Southold for somewhat
over fifty years. I've owned property in various parts of Southold. I've been
a builder for some forty-five years, and I feel I'm somewhat qualified to know
maps, charts and so forth. When I purchased my property, Lot No. 35, in
West Creek Estates, in 1970, there were five full time families and three partially
completed homes. We had a 24 foot wide hard surfaced oiled road, with gutters
and shoulders on both sides. It was built by the Town, to the Town's specifica-
tions. The Wilsberg Brothers, with pitches leading to working drains and
drainage areas. Since then, I have watched as new arrivals came, built homes,
completely destroyed these gutters, by placing ties accross them. Some as much
as 16 feet out into the right-of-way, then placed heavy rocks beyond that, then
plant trees shoulder to shoulder right in the gutters, creating blind driveways,
extending black top drives out over the gutters, and on to the roadway itself
as much as 18 feet. They bulldozed entire shoulders back onto their lots to
gain fill, and even on the edge of the road itself. They bulldozed
the top off of one drain, placed a four inch well approximately 6 feet out into
the right-of-way, and use one gutter and shoulder for a dump, filled with trees,

limbs, stumps, grass cuttings and other debris. All of this causing the water
to lay on the road, freezing at times, as well as making it very difficult. if
not impossible, to safely park the car on the side of the road. At a hurriedly
called informational meeting on the June 24th, we were handed an estimate on
what could be performed. When I asked questions, I was given very evasive
answers,or none at all. Question No.1: When I asked how this estimate could
be prepared without a land survey, I was told they didn't need one. Now,either
they know where the road was, or didn't care, because at one point the road
runs off of the right-of-way, while on the other side a row of trees has been
planted approximately twenty feet out into the right-of-way. Also, in the same
area a four inch well has been sunk, approximately six feet out in the right-of-way
protruding approximately two feet above the ground. Now,can the Town approve
and accept a public road under these conditions? Question No.2: Estimate
lists $1,500.00, metal guide rails, Glenn Road, dead end. When I questioned
this, I got no answer. Glen Road runs directly into Sleepy Hollow Lane for
a distance of approximately 175 feet on the east, and along the creek on the
south 100 feet, part of which includes a launching area on the right, the westerly
side, which some of my neighbors and myself have used for nearly twenty years.
Are we to be denied access to Sleepy Hollow Lane, or are we to be denied access
to the creek? Question No.3: Estimate list, $8,000. for 24 vertical feet of drainage
rings. Again, when I asked where and why, I got a very vague answer. There
are drains and drainage areas already there, although some do need cleaning
and repair. The problems that the water runoff can not reach them. With the
regard to the amount of $900. to trim back the brush on the sides of the right-of-
way, I sincerely doubt that anyone realizes the number of large trees, mostly
locust growing out into. .overhanging the road, so far that they're a hazard.
Or to the large number of cedars, that have been planted out in the right-of-
way, creating several blind drives, where these residents have to back far out
into the road before they can see, or be seen. I,myself,have had several near
misses. I'm sure there must have been others. There are now some thirty
homes, here in West Creek Estates, and I feel that we deserve to have our roads
atleast as good as they were in 1970. Before any construction is started, I
would urgue that you, as our Town Board, along with the Superintendent of
Highways, make an on site inspection to see first hand exactly what the existing
conditions are. I wish to point out, that I'm prepared to substantiate every
statement I have made here. We're very much in need of these improvements,
but I think that it should be looked into, and I don't know how it can be done
without a survey. I will give you a copy..
SUPERVISOR MURPHY: Thank you, Don. Is there anyone else, who would
like to speak in favor or opposed to this road improvement district?
CHARLES H. REHWINKEL: My name is Rehwinkel. I live accross the street
from the previous speaker. I've lived there since 1974. The road was built
by the Town, as he said. It was approved by the Town. It was accepted by
the Town, and when I got out there, I thought it was pretty good. About
twelve years ago, I think, it was redone by Wilsberg Brothers. Since then
it's been in the state of deterioration. What we want, I thing, is to bring it
back to what it was. Now, some of the things that the previous speaker has
said is true, but the problem I think here is he walks around with the attitude
that he owns this place, and everybody has to do exactly what he wants. I
had the idea that I am squatting on his property.
SUPERVISOR MURPHY: We're talking about the road improvement.
CHARLES H. REHWINKEL: The road improvement, that's .~.I'1'1 with tfte'West
Creek Estates, and we've been pushing this for five years, we've been pushing

and now we come to the bitter end. This is the third time around. We've been
working with the Town Board. We are the ones that are paying for the.......,
not him. And now we're coming this close, and now all of a sudden out of the
clear sky, he comes up and jumps in, and he's going to throw a monkey wrench
into it. All I want is a road that he wants, and some of these trees he's talking
about, there've been an asset to the place. That's all I have to say right now.
SUPERVISOR MURPHY: Is there anyone else? Yes, ma'am.
GRACE COLLINS: My name is Grace Collins. I live on Shepard Drive. We
have been there only three and a half years, but at the time we bought the
property, it was a puddle, like this, in the road. I don't know if any of you
have been down Shepard Drive lately, but the puddle is now a lake. The children
swim in in the summer. The ducks swim in, and it is absolutely impassable.
We have been interupted at dinner so many times by people who are stuck in
the middle, can't get out and come to use our telephone. It's not so bad. It
doesn't happen all the time, but it is annoying, and one woman was so livid,
that she thought it was our fault. She was screaming at us, like we were crazy.
And it's not even our road, so I think we've been passing the buck, at least
that I know of for three years. I had written to Mr. Wilsberg asking him what
he was doing with the $25.00, that we were each paying. I never got an answer,
but he did cash the check. Enough pussy footing around. I think Mr. Frederick
is really knit picking. I don't know any of the places that he's talking about.
We only live a few houses away from him, but I don't know what he's talking
about, except this lake really is disaster. I think it's time now to get something
done, and not just put it off again.
SUPERVISOR MURPHY: Okay. Thank you. Is there anyone else, who would
like to address the Town Board on the proposed road improvement. Yes, ma'am.
MARGARET JELLET: My name is Margaret Jellet, and I live on Glen Road. My
husband and I have lived there, we owned property there since 1968. We built
our house in 1969, and we've lived there as full time residents ever since then.
Much of what Mr. Frederick has said,we're very much aware that the road has
problems. This is why we're petitioning the Town to do something about it.
One of the reasons, why we have problems with the road, is because the road
was abandoned by the developer through non-payment of taxes. I'm sure you
all know that. There are many problems with the road, such as what Mrs. Collins
has referred to. Much of what Mr. Frederick said about the road might be
true, but I wasn't aware that Mr. Frederick is a surveyor. And I would also
like to take exception to one of his statements, that in 1970, there were five
full time residents. It wasn't five full time residents. There were at least seven
full time residents at that point. In 1969, there were seven full time residentss,
not five. It has come to a point,where the road has many problems. It's about
time something got done about it, and what we're asking the Town Board to
do is to help us out, and give us a road that is taxable. A road that is safe,
and a road that will not pose problems for us in the future. We know there
are problems with the road. This is why we've petitioned the Town Board to
help us to do something about it.
SUPERVISOR MURPHY: Thank you. Anyone else like to address the Town

EMMA POLIWODA: I'd like to ask a question. I'd like to know if this road,
which is now giving us access to the......
SUPERVISOR MURPHY: Could you identify yourself?

the access we have to the creek, is going to be changed in any way? I'd like
to know that. He has a map. Are we going to have access to the other road?

J. KEVI N McLAUGLI N: I don't know what you call Sleepy Hollow. It's not
designated on the map.
EMMA POLIWODA: Well, it's the next road over.

DONALD FREDERICK: That's right, that's what we're talking about.
EMMA POLIWODA: You can't have access to the creek if you do that. So how
can you get to the creek, if they put up a guard rail?
SUPERVISOR MURPHY: Kevin, maybe you want to meet with the lady later.
We're talking about a road improvement district.
EMMA POLIWODA: Yes, but it depends a lot on.......1 know very well that
we have a road that needs to be fixed and repaired, but they want a private
road, and not a public road. In other words, they feel that the access to the
creek is denied, that very few of the general public will come down this road.
SUPERVISOR MURPHY: We're tlI1king about improving a road that's going to be turned
over to the Town. It will become a Town road. It will be a Town road, and
it will...
EMMA POLIWODA: They should tell the people that live there exactly how the
road will be when it's improved.
SUPERVISOR MURPHY: It will be a Town road, built to Town specifications
at that time, and used by all residents of the Town.
EMMA POLIWODA: Are we going to lose the right to use that creek?
SUPERVISOR MURPHY: I have no idea about that property. That's not what
we're here for. We're here on a road improvement.
EMMA POLIWODA: It makes a very big difference if you live there.
SUPERVISOR MURPHY: Maybe you should talk to Mr. McLauglin outside after.
Maybe he could let you know on that point. We're talking about building a road,
improving the road to prior Town specs, and then turning it over to the Highway
Department. The road has deteriorated to a condition where its very dangerous.
People's lives and homes are in danger, because emergency vehicles cannot respond
down there at all times. That's why we're here tonight. Is there anyone else
who would like to address the Town Board on this proposed road improvement
district? Kevin?
J. KEVIN McLAUGLlN, ESQ.: Yes, if I could very briefly. I think there may
be some misunderstanding as to the difference between the fifty foot bed of
the road, that is provided in the approved subdivision map, which is approved
by the Southold Town Planning Board in 1963. It is a fifty foot wide bed of

road, how much of which is presently paved I really don't know, but as you've
said, what we're looking for is to improve within that fifty foot bed of the road,
up Town specifications, and that's what we're here asking before this evening.
I think that it's been shown to you that it's a dire necessity for the residents
to have something done to this road. They are going to pay for it, as part
of their improvement district, and we ask you to look favorable upon our
application.
SUPERVISOR MURPHY: Thank you. Anyone else? Sir?
ROBERT WENDELL: Bob Wendell. I've lived on Glen Road since 1974. I would
like the Board to approve the road.

body who was instrumental. It was Frank Yakaboski, who acted as intermediary
for free, between the West Creek Estates, and the Wilsbergs. He handled a
lot of this running back and forth, and there was no bills, as I understand. it,
and I'd just like to publicly thank him at this time. Thank you.

been planted out in the right of way. Creating several bInd drives where
these residents have to back far out into the road before they can see
or be seen. I myself have had several near misses and I am sure there
must have been others. There are now some 30 homes here in West Creek
Estates and I feel that we deserve to have our roads at least as good as
they were in 1970.
Before any construction is started I would urge that you as our
Town Board along with the Superintendent of Highways make an on sight
inspection to see first hand exactly what the existing conditions are.
I wish to further state that I am prepared to substantiate every
statement I have made here.

entitled " Map of West Creek Estates" and filed in the office of the
Clerk of the County of Suffolk on August 29, 1963, as Map No. 3848,
hereby request, pursuant to Section 200 of the Town Law of the State of
New York, that the Southold Town Board improve the aforesaid roads
situate in West Creek Estates as contained in the "Map of West Creek
Estates", a copy which is attached hereto, by construction and paving
of such private roads providing curbs, gutters, culverts, and other
improvements for necessary and proper drainage.
It is respectfully requested and petitioned that said improvements
shall be made in accordance with the specifications and requirements of
the Town of Southold.
The maximum amount proposed for the improvement aforesaid to be
expended is the sum of Forty Thousand ($40,000.00) Dollars.
It is proposed that the expense of constructing such improvements
shall be borne by local assessments upon the several lots and parcels
of land especially benefited thereby on an equal basis per lot and not

according to assessed valuation as more fully provided by the statutes
applying in such cases.
The undersigned constitute resident owners owning at least one-
half (1/2) of the frontage owned by resident owners residing in or
along the private roads and/or constitute owners of real estate
fronting or abutting upon either side of the private roads covered by
the petition to the extent of at least eighty (80%) percent of the
entire frontage or bounds; and the undersigned respectively reside at
the places and own the number of frontage feet along said roads set
after their respective signatures.
WHEREFORE, your petitioners pray that you, the said Town Board of
the Town of Southold, proceed as provided by said Section 200 of the
Town Law to the end that the improvement hereby petitioned for may be
duly authorized and completed.

Once again I write concerning the roads in the West Creek
Estates subdivision in Southold. This time I write in behalf
of, and at the direction of, The West Creek Estates Property
Owners Association in accordance with a motion passed at
their July 8th meeting. I attach a copy of your reply to my
previous letter. Acting on your advice, and on your recommend~
ation to Bill Pfeffer-then our president_the association re~
tained the services of Richard Lark to represent them in
forming a road district, thus enabling the Town of Southold
to upgrade the roads and assume responsibility for maintenance.
A petition signed by forty five property Dwners in the sub-
division was submitted to your office on August 19, 1986 by
the attorney. However the attorney failed to make an agreement
with the developers and owners of the roads, Ernest and Harold
Wilsberg, and the road properties were purchased by Suffolk
County at tax sale in November, 1986. The developers, with the
sale of their last remaining lots weveral years ago, ceased
paying property taxes as well as having ~ibandoned maintenance
of their roads. They, however, continued to accept payment of
yearly fees mandated in the covenants filed by them.
Need~ess to say, the association was extremely disappointed
with the outcome and requested an explanation from the attorney.
Mr. Lark responded: " At the time Mr. Pfeffer asked me to
hand~e this matter for the association, I was unaware of the
Wilsbergs.uesire to e~tract money from che association, and
~outhold Town's unwillingness to acquire the roads because of
their condition"~ The latter part of Mr. Lark's statement is
difricult to understand in view of your offer of assistance
on behalf of the town.
It is now known that the county filed the tax deed to the roads
on February 23rd of this year, and that after six months have
elapsed, the Wilsbergs will have lost all rights to redeem
ownership of the roads-if indeed they wish to do so. It is also
understood that the county, rather than putting the roads up

roads to the town.
The association, in an effort to find how this situation could
have developed, reviewed the files of the Southold Town Plan-
ing Board and made some interesting findings. The minutes of
the May 7, 1963 board meeting contains a resolution by the
board to forward a letter to the town board requesting they
be rurnished with the cust of the 'considerable length' of high-
way in West Creek Estates for which the town had paid for the
construction.as a pilot project.Yrom what is known ~he con-
siderable length amounts to approximately eighty percent of
the roads in the subdivision. It would appear that the town
had already authorized, constructed, and paid for the roads
by the time of this meet~ng. At the subsequent meeting on May
~l, 1965 where the subdivision was granted final approval, the
board resolved to waive rules and regulations requiring park
and playground or cash equivalent; and to waive the require_
ment for a performance bond. Interestly the roads were not
being dedicated to the town. ~here is no ind~ca~ion why this
unusual and generous arrangement was being given the deve~opers.
Other town records may provide rurther information.
It is with this background that the property owners'in chis
sUbdivision now find themselves in limbo, devoia of many town
services for which taxes are paid. They must contend by them-
selves 'with pOcho~es, storm cleanup,snow removal, and the
road and drainage conditions pose a safety hazard to young and
old. Attempts to have the town assume the roads have previous-
ly met with rebuff from both town and developers. The only
good news-if we can call it thac_is that the de'velopers may
rinally be out of the picture. Therefore, in view or the un-
usual and generous coopera~ion given the developers by a pre-
vious town administration, the association requests the same
cooperation be given the property owners in this subdivision;
and that the town expedite the subdivision roads from county
to town ownership. The assoc~ation stands readY to meet with
you, and the town board if necessary, to solve this long
scanding problem. Thank you.

having an interest therein, as determined by a title search.
If the roads in question are intended to be dedicated to the Town, it may be
necessary that all lot owners execute and deliver instruments dedicating and
releasing their interests in the road beds in question, Would you please
advise me of whether or not all interested persons will execute all required
releases, as revealed by a title search, and whether you will assume the duty
of obtaining such releases.
If you can assure me that the lot owners intend to execute and deliver all
necessary releases, I can proceed to order the required title searches and
proceed with the dedication proceedings, which must be accomplished prior to
making the necessary improvements.

Dear Mr. Penny:
The problems with obtaining decent roads in the West Creek
Estates subdivision in Southold appear to be nearing a
solution, and if - as Frank Yakaboski reports - the county
legislature acts on the redemption approval in November,
the title problems may be resolved by year end. Hopefully
by this time next year, the roads will have been upgraded
and be under town control.
It would be most ungrateful of us if we did not express
our appreciation to you, and also to Frank Yakaboski, for
the interest, advice, and assistance we are being given in
obtaining title and initiating the formation of a special
