FORTH Grantor agrees not to erect or maintain within the easement area any physical obstructions, of any kind or nature whatsoever exept as the Grantee may specifically consent to in writing. However, the deed does not have a metes and bounds description of the roads as we require. The description in the deed references the 1971 subdivision map, and your subsequently filed certificate of abandonment places that description in question. Please revise the deed to give a metes and bounds description. We also need an up-to- date title abstract showing us that the roads are not subject to liens or other title impediments. The roads require a drainage recharge basin to operate properly. You have given us a drainage easement to ensure that the Town can properly maintain the recharge basin. However, we need to modify the recorded map to show the existence of the drainage basin. Please have your surveyor add the easement to the map and have it recorded in place of the existing map. RESOLUTION FOR STREET IMPROVEMENT WHEREAS, a written petition dated May 23, 1994, was duly filed with this Board requesting the permanent improvement of highways in this Town known as Bayberry Lane, Wild Cherry Way and Stony Shore Drive and described as follows: All that certain piece or parcel of land, situate, lying and being at Southold, Town of Southold0 County of Suffolk and State of New York, known and designated as Bayberry Lane, Wild Cherry Way and Stony Shore Drive, and bounded and described as follows: The easterly line of Bayberry Lane begins at a point on the southerly line of Middle Road at the northwesterly corner of lot no. 1 shown on "Map of Shorecrest", filed in the Suffolk County Clerk's Office as map no. 5584, and running thence along lot no. 1 three courses: (1) S.30°30'50"W.- 35.45 feet; thence (2) S.14°25'E.-109.51 feet; thence (3) S.56°45'20"E.- 61.96 feet to the northerly line of Stony Shore Drive; the northerly line of Stony Shore Drive runs thence along lot no. 1, 2, 3 and 4 on said map N.75°35'00"E.-498.30 feet to the easterly line of Wild Cherry Way and the northwesterly corner of Lot no. 5; the easterly line of Wild Cherry Way runs thence along lot numbers 5, 6, 7 and 8 S.14°25'00"E.-575.0 feet to Lot no. 9; thence along lot no. 9 and the Park and Playground S.28°37'30"E.-348.22 feet to land now or formerly of Cassidy; the southerly line of Wild Cherry Way runs thence along said land S.73°03'20"W.-44.10 feet to land now or formerly of Mutkowski; thence along said land S.67°14'W.-55,90 feet to a Private Road and the westerly line of Wild Cherry Way; the westerly line of Wild Cherry Way runs thence along said Private Road and along land now or formerly of Mallon N.14°58'W.-35.03 feet; thence along said land N.56°45'20"W.-60.0 feet to the southwesterly corner of lot no. 10; thence along lot no. 10 two courses: (I) N.33°14'40"E.-78.04 feet; thence (2) N.28°37'30"W.-237.47 feet to the southeasterly corner of lot no. 11 and the westerly line of Bayberry Lane; the westerly line of Bayberry Lane runs thence along lot numbers 11, 12, 13, 14, 15 and 16 N.56°45'20"W.-794.01 feet; thence continues along lot no. 16 two courses: (1) No.14°25'W.-127. 68 feet; thence (2) N.60°56'40"W.- 34.39 feet to Middle Road; the northerly line of Bayberry Lane runs thence easterly along Middle Road on a curve to the right having a radius of 1877.0 feet, a distance along said curve of 100.08 feet to the easterly line of Bayberry Lane and the point of beginning. WHEREAS, said petition was duly signed by owners of real estate owning real estate to the extent of at least one-half of the entire frontage or bounds on both sides of such highways and also signed by resident owners owning not less than one-half of the frontage owned by resident owners residing in or along such highway; and WHEREAS, the said petition was duly acknowledged or proved as to each signer in the same manner as required of a deed to be recorded; and WHEREAS, at a meeting of said Town Board duly called and held on July 26, 1994, an order was duly adopted by it and entered in its minutes, reciting the filing of such petition, the improvements proposed and the maximum amount proposed to be expended for the improvement as stated in such petition, to wit, the sum of $50,000.00 and specifying that the Board would meet to consider the petition and hear all persons interested in the subject thereof concerning the same, at the Southold Town Hall, at Southold, in said Town, on the 23rd day of August, 1994, at 8:00 o'clock in the evening of that day for the purpose of considering the said petition and hearing all persons interested in the subject thereof concerning the same; and WHEREAS, the said order, duly certified by the Town Clerk, was duly published and posted as required by law; and WHEREAS, a hearing was duly held by this Town Board at the place and on the date and time hereinbefore mentioned, and at such place and time, the said Town Board did duly consider the said petition and hear all persons interested; NOW, THEREFORE, after such hearing and upon evidence given there at and pursuant to the provisions of Section 20 of the Town Law of the State of New York; it is hereby RESOLVED that this Board does hereby determine that it is in the public interest to make the improvements petitioned for, to wit: The permanen't paving of the highways set forth ins aid petition and the construction of such curbs, gutters, catch basins and drainage facilities as may be necessary; and it is FURTHER RESOLVED that the Town's Engineering Inspector has prepared definite plans and specifications and made a careful estimate of the expenses for the performance of the work; and it is FURTHER RESOLVED that the Town has advertised for sealed bids for furnishing all labor, materials and equipment for the reconstruction and restoration of all roads and drainage facilities in the Shorecrest at Arshamomaque Subdivision; and it is FURTHER RESOLVED that upon the award of the bid, and completion of the improvements to the Superintendent of Highways and the Town's Engineering Inspector, the Town will accept dedication of Bayberry Lane, Wild Cherry Way and Stony Shore Drive. What you've just heard is the language by which the residents or over half the resident of Shorecrest Acres have asked, and petitioned, the Board to establish a special taxing district, just for their area, to raise the money to improve the roads in that area. This is an interesting feature of roads, that were never dedicated to the Town, and left kind of in limbo by the developer some years ago, and now need to brought up to a certain level before they can be dedicated over to the town. I need your help. Town Law 200 requires signatures of owners of real estate fronting or abutting upon either side of the road to the extent of at least eighty percent of the entire frontage. We have signatures from the owners of parcels 15, 17, 18, 19, 20, 22, 23, 24, 25, 27, 28, 29, 30, 31, 32 and 33. I do not have signatures from the owners of parcels 16, 21, 26 and 34. I don't have clear maps, so I can't figure out whether the properties that have submitted signatures add up to 80% of the total frontage. You have the maps. Can you check out the percentage and let me know. Thank you. Also, can you give me an up to date estimate of the cost of road improvements and bonding. Ray Jacobs was in last week and put it at $55+, but I~d like something in writing for my file. Please get back to me on this ASAP, since the owners are eager to get the process going. As I see it, the next step is to have the Town Board set a date for the public hearing to set up the district. Once the district is set up, we immediately try and get it on the tax roll. Hopefully this will let us issue a bond immediately, so the project can go out to bid this year. There may be a slight problem if the bid comes in at over $50,000 (less cost of bonding), because there will have to be another public hearing to amend the district to the higher amount. However, the applicants have gone ahead and executed the petition with the existing $50,000 figure. Therefore, the input from the Town Engineer is important in deciding if the submitted petition is adequate. The abstract of title is three years out of date and must be brought current. The town uses this information to determine whether the petition has been signed by sufficient owners as required by law, so it must be up-to-date. The Petition is not executed at this point. It currently provides that the maximum assessment on the district would be $50,000. The Town Engineer feels that this figure may not be complete, since it includes no costs for engineering, specs or administration. When he has the survey and plans requested above, he will be able to fine-tune this figure so that the Petition can be accurate. Dedication procedures are outlined in section A108-50 of the Southold Town Code. 3) At this time improvements in the roads are needed to bring them up to the 1980 specifications such that the dedication could be accepted. The cost of doing this is approximately $50,000. 4) The Supervisor will seek support from the Highway Department in the following three ways, if it is the wish of the owners in the area to make these improvements. a) Engineering regarding impeded drainage. b) Securing construction contracts for the owners at Town prices. c) Use of Town equipment to connect a poorly functioning drain. 5) If the owners of property wish a district to be formed to finance improvements then the Town would assist in the steps necessary to achieve this, including bookeeping. Dear Sir: On behalf of and with the approval and support of my entire community (Shorecrest), I am writing to you in your capacity as the Assistant Town Attorney and ask that you convey our problems (not of our making) and feelings to the respective town officials. If you recall, I paid you a brief visit on Aug. 14, 1992 inquiring about certain procedures and also expressing my concern regarding our community at Shorecrest at Arshamomoque. You mentioned what you considered a si- milarity, the West Creek Community (I know some of the residents who live there). This would appear to be either a lack of information on your part or perhaps you assume we are not cognizant of the actual differ ences. The West Creek Estates Community was.initiated as a private enter prise. Shorecrest, instead, was always intended to be public, not privat~ as the records show. The town officials have repeatedly said that in order to solve the prob- lems of road repair and dedication~ it should be worked out directly with them; but the fact that they refuse to tackle the problem from its root shows that they are unwilling to talk seriously, which should be based on the fact that the town erred in releasing the bonds without due process. You offer only lip servic~ ~ithout substance and integrity-- we refuse to fade away. It %~as the previous administration that violated Town Zoning and Planning, Real Property Laws, and also the releasing of the street performance bond without due process of the law. Even if the present administration did not cause these acts of malfeasance against the residents of Shore- crest at Arshamomoque, they, nevertheless, are equally to blame for their indifference and stonewalling attitude. I personally have always thought and believed that right should ultimately prevail over wrong; here, un- fortunately, it is not 'the case and has become something ugly and dis- turbing in our lives. Let us get this ghost outer the closet and deal with it. Let us stop this embarrassing legacy from being passed on to the next administration. Can anyone in this Town Hall rise above him or herself and do what has (2) to be done for the residents of Shorecrest at Arshamomoque? The search for truth and justice should be the duty of all elected officials; they ought to be role models. The fate of our democracy hangs on what each of us do in our everyday lives. For us to be treated the way we have by the Town of Southold both in the past and at present is very disappointing. We feel it is an insult to our strong traditional family values. Some of our children are now grown up and ask us why the Town of Southold is doing this to us. I wish the Town Supervisor or one of the councilmen/women could give them an honest answer. I wish to know how the respected officials of this town would feel and react if their lives would have been touche~ by this same e~cperience. Do they not know that this form of psychological punishment has already inflicted a deep wound in each and everyone of us? Morality is also greatly involved in situations such as these. One cannot always follow orders, so to speak. God has given us a brain and a heart, too; in this case, they need to use both if they want to show to the residents of Shorecrest at Arshamomoque that the robes they wear are those of justice. Over the past fifteen years, Southold Town has collected from the residents and property owners of Shorecrest nearly one-quarter of a million dollars in real estate and property taxes, but not one dollar has been spent or appropriated for the repair and maintenance of the rapidly deteriorating roads at Shorecrest. Taxation without representa- tion is unfair, unjust, and most certainly un-American. Let us get together and have an honest and meaningful dialogue to resolve this problem. We can offer you a face saving solution. However, we will pursue this gross injustice and we are prepared to take whatever steps are necessary to gain a lawful resolution. Title to these streets was attached and transferred to Suffolk County because of non- payment of taxes by the developer. At the point Of the termination of development, a number of questionable transactions and omissions occurred which appeared to breach applicable Town Zoning and Planning, Real Pro- perty laws, and also the releasing of the street performance bond with- out the "due process of the law". We are writing to you in your capacity as the director, Division of Real Estate of Suffolk. County and hope to find in you that special sense of justice, the justice which the Town of Southold has denied to the residents of Shorecrest. We would like you personally to peruse the enclosed letters, particularly that dated 6/29/90 by Dominic Piscitelli, Title Guarantee Closer, which relates in detail all the acts of malfeasance committed against us by the Town of Southold. I assume that you are an attorney, and if so, you will be able to see through the contents of the above cited letter. The Town of Southold has brought upon us these inhumane injustices and covered them up well. The Title of these roads must remain in the possession of your Department until the Town of Southold decides to take the roads as they should have done in the past. Nevertheless, we are always in favor of getting together with the town officials and having an honest and meaningful dialogue to resolve this problem. Southold officials insist that this problem is a Town matter, but the fact that they deprived us of "Due process of law" for the past ten years shows that they really mean that this problem should continually remain covered up in this small town. Mr. Fishbein, we have confidence and trust in you, and hope that you too (2) will help to bring about an equitable solution to this ugly problem. This is one of those special cases which requires the use not only of one's head, but one's heart as well. Please do not treat this problem with indifference--to ignore it is to approve of the ugly way the Town of Southold is treating us, for they will have to bear the embarrassing' consequences that may arise as a result of this injustice.
