The Legislature further finds and determines that even if the adoption of the local law is an action within the meaning of SEQRA, the adoption of the law is a Type II action constituting a legislative decision in connection with routine or continuing agency administration and management, not including new programs or major reordering of priority. See 6 N.Y.C.R.R. Section 617.13(d)(15) and (21). As a Type II action, the Legislature has no further responsibilities under SEQRA 6 N.Y.C.R.R. I have reviewed these petitions and believe that they are adequate to enable the Town Board to set a date for a public hearing on the establishment of the special district. Attached are the worksheets used in evaluating the petitions. Since there are resident owners, the petitions must represent at least 50% of linear feet of the resident owners, as well as at least 50% of the linear feet of total owners. The worksheet for total owners indicates that there are signatures of 64% of the 7667 linear feet. However, the petitions of Milligan and Benson were found to have improper notarizations and so have not been counted. This revises the percentage of signatures to 56%, which is adequate to set a public hearing under Town Law 200. The worksheet for resident owners lists only 7 owners, although there are 12 houses along the roads. The term "resident owner" does not include seasonal residents such as summer cottage owners unless they vote in the town and thus consider such residence their permanent home. 74 Op St Compt 262. I have checked all the persons listed as resident owners, and they use the Orient address for all tax bills. The other homeowners do not. I therefore believe that the resident owner llst is accurate. There are signatures from 67% of the linear feet of resident owners, which meets the code requirements of at least 50%. I therefore conclude that matter may be set for public hearing. I need some help from you in reviewing them. As you can see from the attached papers, the owners have indicated a certain linear road frontage for each property. Could you let me know if these numbers are correct? Also, there must be signatures from a certain percentage of resident owners. Attached is a list of road frontages of resident owners, which should be all lots with houses on them. I'd appreciate it if you could confirm that the lots on the circled map are all the lots that have homes upon them, since you've been to the subdivision. If you can confirm this info for me, the petitions will be ready to be put on the June 13 Town Board meeting, to set a date for a public hearing on forming the district. The next step after that will be asking you to prepare specifications. Mr. Boylehart had submitted maps and a lot description, which I forward to you to use in developing the specs and accepting dedication of the roads. They are seeldng waiver of !endfill tipping fees in an amount that is expected to reach $10,000. I underst-nd that the material to be brought into the ]-ndfill is brush and vegetative matter which we grind up with our tub grinder. We do not have to pay to remove it from the dump. Ray Jacobs has pointed out that the work would be conducted by our Highway Department or through a contract let by our Highway Department. The Town normally waives fees for pro~ects-of this kind in which our Highways Department carries out the work. This project is a Highways Department project which the Highways Department will probably contract out. I support the waiver and I am asking the Town Board to take action on it at the April 18th meeting. If this vote is successful all 30 owners will, through a 5-year bonded tax district, pay all back-taxes due the County and all Town road costs and all bond interest. There will be no cost to the Town of $outhotd. In forming our Land's End Property Owners Assn. we received the support of just over 50% of the 30 owners, 19 being non-resident. On March 22nd we received the Town's rough estimate of costs. Instead of the anticipated $50,000 of earlier estimates, the new total is over $90,000. This higher figure will make a favorable vote very difficult to obtain. In meetings with Town officials we have identified one estimated item which appears unnecessary -- "Landfill Tipping Fees $i0,000." We believe that the removal of this one item Of $10,000 would be a significant factor in obtaining the necessary property owner votes to enable the Town to proceed. Therefore, the Land's End Property Owners Assn. petition the Town of Southold to waive the estimate tipping fees appearing on the Town's rough estimate of March 22, 1995 for the following reasons: 1) Meetings with Ray Jacobs, Town Highway Superintendent, and Jamie Richter, Town Engineer, determined that material delivered to the Landfill from Land's End would be light brush -- no rocks, no trees, no stumps, and no material requiring hauling away from the Landfill. Thus, no added costs to the Town. 2) Land's End Road System is completely in place. This includes curbs, drains, leaching pools, catch basins, underground util- ities and restorable road surfaces. Upon re-acquiring title, it is my understanding, you intend to petition the Town Board for the creation of a road district so that the cost of improving the roads to Town specifications can be borne by the ProPerty owners in your subdivision over a five year span. After the roads have been appropriately improved, you intend to offer them for dedication to the Town. Enclosed herewith is a copy of Article IV of the Town's Highway Specifications. This article, entitled "Final Dedication of Roads", sets forth the procedure to be followed. Assuming that this procedure is indeed followed by you in dedicating the roads at Land's End, I see no reason why the Town would not accept same. If dedication of a road is being offered at some point in time after the performance bond has been released, this procedure should be followed: A. Dedication papers shall be submitted to the Town Clerk and shall include: (1) A duly acknowledged dedication and release, together with the required County Clerk's recording fees, if any. (2) A survey map of the property, which shall show the actual location of the highway area within the highway right-of-way and a metes and bounds description of the right-of-way. (3) An abstract of title certified to the Town Board by a reputable title company. (4) A bargain and sale deed with covenant against grantor's acts in the proper form for recording in the County Clerk's office. Lands End at Orient Point: no change, 3. Old Farm Road: Legal papers approved. Dispute between Ray Jacobs and Planning Board over who will pay inspection fee. I advised attorney of this and he will advise whether client will pay for inspection. 4. Orient-by-the-Sea: Received correspondence from property owners inquiring into dedication. No formal application made. 5. Roxanne Road and Kimberly Lane: Received letter of valuation from Assessors, Road failed inspection. 6. Sebastans Cove Road: Roads need improvement. Ray Jacobs to supply cost estimate to me to send property owners to determine if they wish to establish road improvement districts, The above are the only current applications we have in our file. Repair asphalt pavement, as directed (i.e. potholes, alligatoring, distress cracking). 5. Alleviate puddling on paved areas, as required. 6. Remove brush and weeds from flow line and paved areas, as required. 7. Clean flow line of sand, silt, etc., as required (i.e. intersection of Lands End and Hain Road). 8. In a discussion with Ms. Valerie Scopaz, .... we suggested that the methodology of vegetation removal be selected and submitted for approval by the developer since a prescription type .~ecommendation may be construed as a final resolution. The said highways are the same as the highways set forth on a certain map entitled "Map of Land's End at Orient Point" and filed in the Suffolk County Clerk's office as Map No. 5909, on May 3, 1973, RESOLVED, that in accordance with the provisions of Section 171 of the Highway Law of the State of New York, consent be and the same hereby is given that the Superinten- ~ent~of Highways of the Town of Southold make an Order lay- ing out the aforesaid Town highways, and said highways to consist of the land described in the said dedication and release, and to extend as delineated upon the map thereto annexed, and it is further RESOLVED, that the Town Clerk be and she is hereby directed to forthwith cause such release to be recorded in the Office of the Clerk of the County of Suffolk, and upon its return, to attach it hereto.
