WITNESSETH, that the party of the first part, in consideration of ten dollars paid by the party oTp

BEGINNING at a point marked by a monument on the Southeasterly line of the
westerly branch of Calves Neck Road (which point is the Northwesterly corner of land of
Frank C. Hendrickson and wife and the westerly or Southwesterly corner of the premises
herein described); running thence along said Southeasterly line of Calves Neck Road North
26 Degrees 22 minutes 00 seconds East, a distance of 168.68 feet to a point marked by a
monument; running thence on a curve to the right having a radius of 22.39 feet, a distance
along said curve of 41.62 feet to a monument on the Southwesterly line of Calves Neck
Road; running thence along said Southwesterly line of Calves Neck Road two courses, as
follows: (1) South 47 Degrees 08 minutes 10 seconds East, a distance of 90.24 feet to a
point marked by a monument; thence (2) South 45 degrees 04 minutes 30 seconds East, a
distance of 149.29 feet to a point marked by a monument and land of Arthur L.R.
Francisco and wife; running thence along said land of Francisco, South 50 Degrees 22
minutes 00 seconds West, a distance of 189.10 feet to a monument and land of Frank C.
Hendrickson and wife; running thence along said land of Hendrickson North 46 degrees
25 minutes 20 seconds West, a distance of 188.33 feet to a monument at the point or
place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the Grantors herein

AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for

The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
