This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifYing that the solder used in system contains less than 2/10 of I % lead.
5. Conunercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For exlsting buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

DATE OF PUBLIC HEARING: June 19, 1997
FINDINGS OF FACT
PROPERTY DESCRIPTION: Lots 1000-103-7-11 and 103-7-12 are each
vacant and consist of sizes at 39,956 sq. ft. and 39,932 sq. ft.,
respectively. The frontages along Stillwater A venue are conforming
with 193 feet as to Lot jill, and 190 feet as to Lot #12.
RELIEF REQUESTED BY APPLICANT: Approval of Waiver under
Article II, Section 100-26 for a future single-family dwelling on lot
identified as 1000-103-7-11.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated
June 2, 1997, which reads as follows: under Article II, Section
100-26, "under Article II, Section 100-24A(1) the lots in question
SCTM #1000-103-7-11 and 1000-103-7-12 were created by deed dated
2/1/1923 and, by later deed dated 10/26/1964. Each lot was
conforming with the minimum lot requirements set forth in bulk
schedule AA as of the first date of Lot Creation. Under Section
100-25A, the lots in question are located in R-40 Low-Density
Residential Zone District, and today these lots are nonconforming in
total lot area. These lots have merged as they have been held in
common ownership since July I, 1983."
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
Each Lot No. 11 and Lot No. 12 is relative to the original lot lines
when it was confirmed by subdivision approval from the Southold
Town Planning iloard in 1971, known as -'Big Green Acres. -, Clarence
Fleet, and later Evelyn Fleet, were the sole owners of each Lot #11
and Lot #12 since 1923.
1. The waiver will not result in a significant increase in the
density of the neighborhood.

2. The waiver will recognize a lot that is consistent with the
neighborhood.
3. The waiver will recognize the exterior dimensions of previously
created lot lines shown on the Map of Green Acres subdivision map.
The subdivision map was signed by the Planning Board June 23,
1972 and filed with the County Clerk on July 12, 1972.
4. The land will not require a change or alteration ill contours or
slopes, or substantial filling of land.
RESOLUTION/ACTION: On motion by Member Ostermann, seconded
by Chairman Goehringer, it was

above.
