and testament, and in consideration of THREE HUNDRED THOUSAND ($300,000.00) DOLLARS, paid by the
party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever, AN UNDiViDED 8i27 iNTEREST iN
PREMISES DESCRIBED HEREIN,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Peconic, Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at the southwesterly comer pfthe premises herein described on the northwesterly side of'Middle
Road ( C.R. 48) said point being the southeasterly comer of land now or formerly of Cutchogue Associates:
RUNNING THENCE North 44 degrees 44 minutes 20 seconds West along land now or formerly of Cutchogue
Associates, 5135.00 feet to the Long Island Sound;
THENCE on a tie line course of North 71 degrees 13 minutes 00 seconds East, 21.60 feet to land conveyed to
Elizabeth K. Wurtz, et al., by deed in Liber 10407 cp 447;
THENCE South 44 degrees 44 minutes 20 seconds East 420 feet to the northeasterly side of the 50 foot dght
of way;
THENCE North 67 degrees 27 minutes 10 seconds East along the northeasterly side of the 50 foot fight of
way, 162.00 feet to a point;
THENCE North 44 degrees 44 minutes 20 seconds West still along land of Wurtz, et al., 390.00 feet to the
Long Island Sound;
THENCE northeasterly along Long Island Sound along a tie line course of North 71 degrees 13 minutes 00
seconds East, 545 feet more or less to land now or formerly of Clarence Diller and others;
THENCE South 45 degrees 52 minutes 5Oseconds East along the last mentioned land, 1985.0 feet to a point;
THENCE South 45 degrees 45 minutes 30 seconds East still along land now or formerly of Diller and others,
2757.53 feet to land now or formerly of Dauscher, Hayes and Simon by deed in Liber 10407 cp 443;
THENCE South 60 degrees 48 minutes West, 394.76 feet to a point;
THENCE South 29 degrees 12 minutes East 315.78 feet to the northwesterly side of Middle Roaf;
THENCE South 69 degrees 17 minutes 50 seconds West along the northwesterly side of Middle Road, 315.33
feet to the point or pace of BEGINNING.
TOGETHER with all right, title and interest, Jf any, of the party of the first part, in and to any streets and roads
BEGINNING AT a point on the northwesterly side of Middle Road ( C.R. 48), distant 315.33 feet northeasterly
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and
also all the estate which the said decedent had at the time of decedent's death in said premises, and also the
estate therein, which the party of the first part has or has power to convey or dispose of, whether individually,
or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
