Reserving unto the grantor, his successors and assigns, the
following beach easement and ten foot walking right of way. Said
beach easement and walking easement to be in favor of the grantor
herein as well as the future owners of Lots 3 and 4 as shown on
the aforesaid minor subdivision map of "Cabot ' s Woods. " The
aforementioned beach easement is described as follows :
BEGINNING at a point on the northwesterly corner of the
subject premises at its intersection with the southerly side of
the ordinary high water mark of the Long Island Sound from the
said point of beginning;
RUNNING THENCE southeasterly along the ordinary high water
mark of the Long Island Sound 40 feet, more or less, to a point;
RUNNING THENCE South 3 degrees 08 minutes 20 seconds East 60
feet, more or less, to a point;
THENCE North 82 degrees 00 seconds West 40 feet to the
southwesterly side of the aforementioned described premises;
RUNNING THENCE along the southwesterly side of the
aforementioned premises North 3 degrees 08 minutes 20 seconds
West 60 feet, more or less, to the ordinary high water mark of
the Long Island Sound at the point or place of BEGINNING.
The southerly boundary line of the aforementioned ten foot
walking right of way is described as follows:
BEGINNING at a point on the northwesterly corner of the
above described premises where it intersects the southerly side
of the ordinary high water mark of the Long Island Sound which
point is also the northeasterly corner of land now or formerly of
Ross;
RUNNING THENCE along the southerly side of the above
described premises South 3 degrees 8 minutes 20 seconds East 80
feet, more or less
THENCE South 40 degrees 17 minutes 30 seconds East 365. 54
feet to a monument marking the southeasterly corner of land now
or formerly of Walter Ross.
The subject premises are herein conveyed subject to and
together with a 10 foot not exclusive vehicular right of way,
said right of way being for the purposes of ingress and egress
and installation and maintenance of all utilities, including
cablevision, and for the benefit of lots 3 and 4 in the
aforementioned minor subdivision, as well as providing for the
right of way hereinbefore granted to Walter S. Ross by Deed dated
August 22, 1953 and recorded in Liber 3571 page 303 , (said deed
reserving the right of the grantor to make reasonable changes and
alterations in the course and location of the right of way) ; the
southern boundary of which right of way is described as follows :
BEGINNING at the aforementioned monument marking the end of
the aforementioned walking right of way and the southeasterly
corner of land now or formally of Walter Ross;
RUNNING THENCE South 48 degrees 13 minutes 20 seconds East
247.70 feet;
THENCE South 85 degrees 42 minutes East 136. 70 feet to a
point on the southerly side of the subject premises which point
is also the center line of a certain 25 foot right of way for the
benefit of Lots 1, 2, 3 and 4 on the aforementioned minor
subdivision map as well as containing the aforementioned ten foot
right of way previously granted to Ross.
The subject premises are herein conveyed subject to and
together with the aforementioned 25 foot right of way, the center
line of which commences along the southerly boundary of the
subject premises 50 feet westerly along said boundary from the
southeasterly corner of the subject premises and continues on a
course South 85 degreees 42 minutes East 345. 00 feetto a }point,
which point being the southeasterly corner of Lot 1 on the
aforementioned minor subdivision map.
Together with a nonexclusive right of way 25 feet in width
over the easterly side of Lot 4 as shown on said minor sub-
division map, the northeastern border of which right of way
begins at the aforementioned southeasterly corner of Lot 1 and
runs South 49 degrees 02 minutes 50 seconds East a distance of
135. 00 feet.

The aforementioned 25 foot rights of way are for the
purposes of ingress and egress and installation and maintenance
of all utilities, including cablevision, and for the benefit of
Lots 1, 2, 3 and 4 in the aforementioned minor subdivision, as
well as providing for the right of way hereinbefore granted to
Walter S. Ross by Deed dated August 22 , 1953 and recorded in
Liber 3571 page 303 , (said deed reserving the right of the
grantor to make reasonable changes and alterations in the course
and location of the right of way.
TOGETHER WITH the non-exclusive right to the use of a right
of way commencing on the northerly side of Middle Road at a
monument which marks the boundary line between land now or
formerly of YC Holding Corp. and now or formerly of Minakyan and
running thence from said point of beginning North 47 degrees 46
minutes West 699. 15 feet; (2 ) North 46 degrees 29 minutes West
106. 50 feet; (3 ) North 43 degrees 01 minutes West 43 .10 feet; ( 4 )
North 52 degrees 58 minutes West 56 . 30 feet; (5 ) North 48 degrees
31 minutes 50 seconds West 653 . 01 feet ( 6 ) North 59 degrees 48
minutes 40 seconds West 20 . 38 feet; (7 ) North 37 degrees 38
minutes 30 seconds West 20. 37 feet; (8 ) North 49 degrees 02
minutes 50 seconds West 2456. 56 feet to the aforementioned 25
foot right of way, the westerly boundary of which right of way is
10. 00 feet westerly from the monumented line.
Said right of way being adjacent to the westerly line of
land now or formerly of Henry Reichman, now or formerly of YC
Holding Corp. and intended to be the right of way referred to in
deed recorded in Liber' 3819 at cp 13.
Subject to utility easements as they presently exist and as
indicated in the aforementioned minor subdivision map and as
attached hereto.
Subject to a sanitary and building setback being 100 feet
south of the approximate top of the bluff overlooking the Long
Island Sound and as shown on the aforementioned minor subdivision
map known as "Cabot' s Woods" .
Subject to any state of facts the examination of the
subdivision map known as "Cabot' s Woods" would show.
SUBJECT MOREOVER to the condition that in the event a public
highway shall be laid out and dedicated to the Town of Southold
extending in a general East-West direction, the right to the use
of so much of said right of way as may be southerly of said
public highway shall thereupon cease and terminate.
TOGETHER WITH AND SUBJECT TO the terms and right of way
agreement in Liber 4214 page 510 .
SUBJECT TO Declaration of Covenants and Restrictions in
Liber 9687 cp 215 and Liber 9951 cp 388 and as setforth in
Covenants and Restrictions attached hereto.
