Box 1281 j Southampton, NY 11969 RE: Cutchogue Harbor Marina/Drainage Easement Dear Mr. Gilmartin: Pursuant to your letter dated September 10, 2009, your client was pursuing permits from the New York State Department of Environmental Conservation for the repairs to the bulkhead on the above-referenced property. We have been advised by the Engineering and Highway Department that maintenance and repair of the drainage culverts cannot take place until all required permits for the bulkhead repair are in place and such work is commenced. Please note that your client's plans that are submitted to the various permitting agencies with jurisdiction should indicate that the drainage culverts are existing and maintained by the Town. Upon your client's receipt of all required permits and commencement of the bulkhead repairs, please contact the Department of the Town Engineer(765-1560) and/or the Town Superintendent of Highways (765-3140)to coordinate the bulkhead repair with the Town's repair of the existing drainage culvert. The Town received a letter from Mr. Lawrence A. Willis, owner of the New Suffolk Shipyard recently requesting that the Town take action with regards to this location, a copy of which has been enclosed for your review. Specifically, the Town maintains a road drainage system where all water from the road is,channeled into a catch basin which drains into Wickham Creek. The distance between the road drain and the creek is less then twenty five feet. The drainage pipe which ran through a bulkhead owned by the marina failed, causing the collapse of the bulkhead and a subsequent sink hole landward of the bulkhead to develop. This sink hole has expanded to the extent that it now includes electrical wires, creating a very dangerous situation. The material from this collapse has also resulted in extensive shoaling adjacent to the owner's launching ramp. It is apparent that the collapse of this Town drainage pipe has resulted in extensive damage to the marina's property, created a hazard to navigation, created a dangerous situation and as importantly, continues to channel road runoff into Wickham Creek. I am requesting that this location be placed as a top priority at the Stormwater Runoff Committee meeting tomorrow. I am also requesting that the Town Board take a serious look at this situation and take immediate action-to remedy this situation. The Board of Trustees remains available to assist in this matter. This easement was granted and filed. As part of this easement the Town of Southold is required to maintain the drainage pipes and surrounding bulk heading. Michael Irving,the Director of Operations for New Suffolk Shipyard,has notified the Town of Southold on several occasions that there are serious problems with the sections of bulkhead and the drainage pipes that the Town of Southold is responsible for.There is now serious erosion that is creating a safety hazard as well as an environmental issue. Also this erosion is beginning to impede access to some of the slips in the marina. I am asking that the Town of Southold take immediate action to repair the areas of easement so that there is no further erosion and the areas no longer present a safety hazard. Please advise me as to when the necessary repairs will be completed. If you have any questions please contact Michael Irving at New Suffolk Shipyard. Upon review of the easement and contrary to the statements made in the July 13, 2009 letter from the owner of the New Suffolk Shipyard, the Town is not obligated to maintain and/or repair the bulkhead. CHM Subsurface Sewage Disposal Systems LWRP Consistency Assessment Form Continuation Sheet Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The project will make use of existing marina location and enhance this use. Policy 2 Preserve historic resources of the Town of Southold. OCT 1 3 2006 There are no historical or archaeological artifacts in the vicinity of the area where construction will be undertaken. Policy 5 Protect and improve water quality and supply in the Town of Southold. The project will improve water quality through the use of the latest subsurface sewage disposal technology. The Suffolk County Department of Health Services has granted a variance to the Suffolk County Sanitary code that will bring the systems into compliance with the SCSC. The new systems will help to eliminate any unwanted discharges of untreated wastewater into the adjacent creek. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. The project will protect the adjacent fish and wildlife habitats by using an approved modem subsurface sewage disposal system to treat wastewater before it can enter the adjacent waterway. Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources ofthe Town of South old. The project will enhance public access by providing needed sanitary facilities at an existing marina. Policy 10 Protect Southold's water-dependent uses and promote siting of new water dependent uses in suitable locations. The project will protect and enhance an existing marina water dependent use by upgrading the existing subsurface sewage disposal system. The existing facility is in the process of obtaining all necessary permits and approvals to comply with local and state regulations. 1 . .
