That the said Board of Trustees and the Town of South old are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. . . James F. Box 9398 Riverhead, New York 11901 RE: EVE MACSWEENEY 1205 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 50-2-13 Dear Ms. Dalli: The Board of Town Trustees took the following action during its regular meeting held on Wednesday October 18, 2006 regarding the above matter: WHEREAS, Twomey, Latham, Shea, Kelley, Dubin, Reale, and Quartararo as agent for EVE MACSWEENEY applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 22,2006 and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 18, 2006 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, \lVHERE:A~Jbe Boardl1as considered all theJ!'lstimon)' and_documentation_submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 . . WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of EVE MACSWEENEY to re-vegetate the top of the bluff in a 15' wide continuous buffer zone as restoration for clearing violation from October 2005; area to be planted approximately 3,200 square feet; this area will be planted with native trees and plants that were removed; Plant eight each of Eastern Red Cedar (Juniperus virginiana), Black Locust (Robinia pseudoacacia), and Wild Black Cherry (Prunus serofina); all trees to be six foot in height; Plant 100 Rosa Rugosa, 100 Myrica Pensylvanica, 100 Montauk Daisies; all plants to be 2 gallon size; all trees and plants must be planted by December 29, 2006, with this area to be a designated non disturbance buffer; and two inspections, one at the completion of planting, and one five years from the completion of planting for survivability, and all as depicted on the plan surveyed by Stanley J. Isaksen, Jr. June 11,2005, received Dec. 5, 2006, revised by Kathryn Dalli of Twomey, Latham, Shea, Kelley, Dubin, Reale, & Quartararo, LLP, and approved by the Board of Trustees 12/8/06. Construct removable 8' section at toe of bluff. Existing vegetation will be protected and new vegetation will be planted along length of stairway. Located: 1250 Soundview Ave., Southold. Isaksen, Jr., dated 6111/05, is beyond Tidal Wetlands Act (Article 25) jurisdiction Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Pan (61) no permit is required. Be advlsed, no construction, sedimentation, or disturbance of any kind may take place seaward of tbe tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibihty to ensure that all precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction whjch may result from your project. SCTM# 1000-050-02-013 Purpose of visit: To review the decks on the home. Backl!found: The Certificate of Occupancy #4150 issued 02/03/1971, describes the property as a "Private one family dwelling" The property card includes the tax assessors hand drawn sketch which includes decks on the Northwest and Northeast sides of the property. The building permit #4679 describes the footprint of the building to be built, to be approximately the same dimensions as the tax assessors sketch on the property card. Since the house was constructed before 1982 there were no drawings available in the Southold public records for inspection. Findinl!s: The decks are located on the Northwest and Northeast sides of the house. The primary support for the Northwest deck is through the substantial girders that support the floor joists (see photo #1). The primary support for the Northeast deck is through the extension of the floor joists (see photo #2) The upper and lower decks are partially supported outboard from the house on concrete piers. The deck support structure was well built and has been well maintained since completion. Conclusion: The supporting structure for the decks was part of the original structure built prior to the issue of the current Certificate of Occupancy in 1971. Foster a pattern of development in the Town of Southold that enhances community character,! preserves open space, makes efficient use of infrastructures, makes beneficial use of a coastal location, and minimizes adverse effects of development. Yes. Project consists of revegetating a portion of the premises at the top of the bluff towards existing house with Norttiern Bayberry ( Myrica pensylvanica), Beach Rose (Rosa rugosa), and Montauk Daisy in addition to existing vegetation which will further protect the natural features. of the bluff. Revegetation will follow natural contours of existing bluff and landward to existing residence. All planting will be performed by hand, using local species native to the area. There is no excavation for the plantings for the removal of sojl/fill at the site. The project will not in any way change the character of the neighbprhood or affect any historic or cultural center. The project will have no impact or! the economic base of the community. Policy 2. Protect and preserve hIstoric and archaeological resources of the Town of Southold. Yes. There are no known historic Dr archeological conditions on the subject site. Proposed project is for revegetating a portion of the site at the top of the bluff landward towards the existing house. Species to be planted include Northern Bayberry and Beach Rose, local species to the area. The proposed revegetation will not affect any historic or significant archeological sites in close proximity to the subject site as a result of the proposed revegetation. Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. Yes. The proposed revegetation wlII not include any excavation of any materials from the land and applicant proposb to revegetate by hand. All soil/fill will remain at the site with no change in grade or slope of existing contours of subject site. The revegetation will improve the quality of scenic vegetation to the public, while preserving the existing vegetation, and fortifying the existing bluff which will contribute to the scenic quality of the landscape. There will be no removal of any existing vegetation at the site. Policy 4. Minimize loss of life, st~uctures, and natural resources from flooding and erosion. Yes. There will be no hard erosion icontrol structures constructed at the premises. Applicant wishes to establish new ~egetation along the bluff and landward towards the existing residence. Applicant wm use vegetative non-structural measures to increase the protective quality of th~ existing natural features. There will be no clearing of existing vegetation and *,ith the proposed new vegetation, will strengthen the natural protective qualities of the bluff. . . Policy 5. Protect and improve water quality and supply in the Town of Southold. Yes. Project will maintain existing vegetation and will establish new vegetation along the top of the bluff, thereby providing soil stabilization. Proposed location of area to be revegetated will follow natural contours of bluff, thereby maintaining natural surface water flow characteristicsi presently at the site. Water quality will be protected from any adverse impaqts inasmuch as no excavation is contemplated and there will be no fill placed or rembved from the site. Policy 6.
