second part, does hereby grant and release unto the party of the second part, the heirs or successors and

01AP ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
LOT lying and being Southold, Town of Southold, Suffolk County, New
X31 •0 York, known and designated as Lot P:o. 29 on a certain map
entitled "Map of West Creek Estates, Property of Ernest E. and
Harold W. Wilsberg, situate at Southold, Suffolk County, New
York" , made by Otto W. Van Tuyl from surveys completed January
28, 1963, and filed in the Suffolk County Clerk ' s Office on
August 19, 1963, as map No. 3848.
TOGETHER with an easement and right to ingress and egress
over any roads described in said filed Map to and from Bay View
Road, subject, however, to the right of ingress and egress
granted, or that may be hereafter granted, to other owners of
numbered lots on said Map and others to whom the same may be
granted over the roads and extensions on said Map. Further
subject to the right of the sellers, their heirs and assigns, to
dedicate the lands included therein to the Town of Southold as a
public highway, which right of dedication is hereby reserved.
k _ Upon such dedication the easement and right hereby granted shall
terminate.
TOGETHER with the right of access to and the use of the
private beach fronting on West Creek at the end of Glenn Road,
for the purpose of using same for boating and bathing purposes,
such rights to be exercised in common with other subsequent
grantees of land from the grantors, and said rights of access to
and use of said beach shall survive any dedication of any kind
or nature of any lands or land except to the Town of Southold.
SUBJECT to any state of facts an accurate survey may show.
SUBJECT to the Zoning Ordinance of the Town of Southold,
County of Suffolk and State of New York.
SUBJECT to covenants, restrictions, easements, reservations
and agreements of record, if any.
\� IT IS EXPRESSLY UNDERSTOOD AND AGREED that in the event the
\ sellers, their heirs and assigns, dedicate the roads set forth
�V in the filed subdivision map to the Town of Southold, the right
of access to and the use of the private beach on West Creek at
the end of Glenn Road granted in this deed, shall cease,
terminate and be of no effect as to the said Town of Southold.
