Smith, owner, scale 1" to 80' made by Franklin F. Overton, M.E. , surveyor, 1912, and filed in Suffolk County Cle'rk' s tar QQ Office, on the 27th day of May, 1913, and numbered 551 and bounded as follows:— Easterly by a two rod road laid down on said 1 ��^-ttn� map 100 feet; Northerly by Lot 3,3 on said map 198.2. feet on a v 8OV line running South 790 37' W. to land of the heirs of Samuel Davids deceased; Westerly by land of the heirs of Samuel Davids, deceased, 0330c) 100.2 feet, and Southerly by Lot F. on said map 205. 2 feet on a line parallel with the northerly line of these premises and 100 a feet distant therefrom. Together with a right of way from the Easterly side of said premises over the two rod road laid down on said map to and from the Indian Neck Road or Highway and to and from Indian Neck Bay. AND ALSO the privilege of using the beach adjoining Little Peconic Bay and lying between the two rod road laid down on said map on the east and the land of the heirs of Samuel Daivds, deceased, on the west and below a lien running parallel to and 80 ft . distant from present high water mark of Little Peconic Bay for the purpose of bathing and boating and keeping boats in connection with others, but not to erect any buildings or structures thereon. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND theparty of the first part covenants that the party of the first part has not done or suffered anvthing whereby thercaidpremises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of ' the first part will receive the consideration for this convc)ance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of-paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other eurpose.
