The meeting began at 4:16 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? Adoption of LPC meeting minutes from November 21, 2006 MOTION made by Ray Huntington, seconded by Chris Baiz, to accept the minutes of November 21, 2006. Motion carried 4/0. (Eric Keil not present to vote) Inquiries: ?? LPC’s attorney legal advice in responding to landowner’s request for residential uses upon the easement, is that request be denied as allowing residential uses would violate conditions of a “bargain sale”. LPC’s position is that the Town would be eliminating a building lot, thereby reducing density. Melissa is to request that LPC’s attorney provide all members (via electronic mail) with a written legal reasoning for not allowing “residential uses” on the property. EXECUTIVE SESSION. Melissa had telephone correspondence with landowner and made a verbal offer authorized by LPC at a prior meeting. Landowner would prefer a fee simple sale for liability reasons; however, is interested in moving forward with a PDR sale as LPC would prefer to purchase a development rights easement. Melissa told Committee that landowner wants to make sure easement allows for agricultural production as may be amended by Town Code in the future. LPC is agreeable to this wording. ?? Melissa and Councilman Tom Wickham met with landowner and presented a purchase offer as outlined by Land Preservation Committee members via electronic mail. MOTION made by John Sepenoski, seconded by Chris Baiz, to retroactively present a purchase offer to landowner (details set forth in electronic mail) for a development rights easement on the agricultural farmland and one five-acre lot as was offered to the Town by landowner. Tim Caufield gave an update on Peconic Land Trust’s offer to landowner to purchase fee title of the farmland from landowner with intent of PLT to sell development rights easement to Town. Town will need to get an updated appraisal. MOTION made by John Sepenoski, seconded by Chris Baiz, to request an update to the appraisal prepared on the Arrieta property. Motion carried 5/0. ?? MACARI PROPERTY SCTM #: 1000-96-2-10 Zoned: A-C Location: 4735 Cox Lane, Cutchogue FWet: 0 Total Acreage: 26.5 acres (GIS 27.67 acres) MWet: 0 CPF: Yes Subdividable: Yes Reviewed appraisal [executive session]. Tim Caufield gave an update to Peconic Land Trust’s negotiations to purchase the Macari property. PLT has signed a contract of sale for fee title. PLT has offered the development rights to the Town. PLT is willing to share their appraisal with the Town. LPC members reviewed their commissioned appraisal as well as appraisal information received from Peconic Land Trust. MOTION made by Ray Huntington, seconded by Chris Baiz, to present a purchase offer to Tim Caufield of Peconic Land Trust for the purchase of a development rights easement with no restrictions on agricultural structures except for those imposed by Town Code. Motion carried 5/0. END OF EXECUTIVE SESSION ?? KORTSOLAKIS PROPERTY SCTM # 1000-31-3-12 Zoned: R-40 Location: 8875 Route 25, East Marion FWet: 0 acres Total Acreage: 19.5 acres (GIS 18.69 acres) MWet: 0 acres Subdividable: Yes CPF: Yes Status update from 12/1/06 meeting. Stephen Searle and Tim Caufield, both from Peconic Land Trust, gave a status update and a potential concept plan for the Kortsolakis property. PLT has been hired by Town Board to work on this potential PDD project. LPC was asked if Committee would be in favor of preservation of approximately six acres of the property located at the northern most end of the property. LPC not in favor or recommending preservation at this time without knowing what the total plan is for the property. General: ?? Peconic Land Trust discussed affordable farming proposal and potential. Stephen Searle, together with Tim Caufield, discussed the concept of affordable farming and potential for keeping the price per acre of farmland viable for farmers if the Town steps in. PLT plans on discussing with Town Board. ?? Windmills discussion (requested by Councilman Krupski) Al Krupski gave short presentation of plans for windmills on Town PDR’s, and Town’s Senior Environmental Planner Mark Terry’s proposed Town Code regarding windmills. LPC discussed limits to placing windmills on development rights sold lands provided windmill constructed only meets electrical needs of farm agricultural production at yearly peak times preventing farmland from turning into a windmill farm for the production of electricity. Melissa to forward draft legislation to Committee members. ?? MARCO – Tim Caufield gave short status update on Marco property and a potential concept plan will be presented to LPC at a future date. ??
