Slotkin, M.D. 'Dei_ision Rendered April 14, 1982 „ By this appeal, applicants seek a variance to the provisions !''Action 100-30 for permission to use residentially zoned ;ppf,operty to be used as a three-profession office-type building. The premises in question is located on the north side of Route 2S and the east side of Ackerly Pond Road, Southold, r comprises approximately .59 of an acre. The property is w ` d with a lk-story wood frame house and accessory garage. designated on the Suffolk County Tax Map as District 1000, a r�c :on 70, "Block 5, Lot 4. -A majority of the properties ending the subject premises is zoned "business"; and the ($t l immediately north of these premises is zoned residential ll as the property immediately east of the subject premises. a ` etb4��' At the hearing, it was shown by dollars and cents proof (, the land in question could not yield a reasonable return if jfor any of the uses allowed in this district by applicants encing: the amount paid for the land in question; its 0, nt value; maintenance expenses; land taxes; the amount of 4. xjages and other encumbrances. Testimony was offered by real "te brokers testifying the value of the premises with improve- rs s to be around $60,000 , and if in another residential 'tion between $72,500 and $75,000. The brokers also testi- ' that during the period of, time this property was listed with r offices, only one offer to purchase was made, and that f er was made subject to obtaining this use variance. Apparently reasons for this lack of interest by potential customers was € to the expansion of the surrounding businesses and the busy et intersections. In considering this appeal, the board determines that the den of unnecessary hardship has been satisfied in that the d cannot yield a reasonable return if used only for a .purpose wed in this district; that the circumstances are unique; t the use applied for will not alter the essential character .'the neighborhood; that the use will not prevent the orderly reasonable use of adjacent properties or of property in 'acent use districts; - that the use will not prevent the orderly reasonable use of permitted or legally established uses in district wherein the proposed use is to be located, or of mitted or legally established uses in adjacent use districts; t the safety, health, welfare, comfort, convenience and order the town will not be adversely affected by the proposed use its location; and that the interests of justice will be rved by allowing the variance conditionally as noted below. On motion by Mr. Sawicki, seconded by Mr. Grigonis, it was RESOLVED, that the application of Jay P. Slotkin, M.D. , peal No. 2932, is hereby granted SUBJECT TO THE FOLLOWING CON- - ITIONS:.
