F('r II Variance to the New York Stete Ulliform Fire Prevention and Building Code DECISION PETITION NO. 2006-0777 Upon the application of Jason Taylor, R.A., flied pursuant to 19 NYCRR 1205 on October 24. 2006, and u~ on all other papers in this maller, the Department makes the following determination; NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the construction of a one-family dwelling, two stories in height, located at 75 Arcadia Rlln, Town of Soulhold, County of Suffolk, State of New York. Relief is requested from: 19 NYCRR Part 1220, The Residentia' Code of New York Stale, Section R1003.9, which speclfias that no combustible material shall remain against the underside of hearths and hearth extensions after construction. (The petitioner requests combustible material against the underside ot a hearth extension.) FINDINGS ,)F FACT 1. A masonry fireplace was constructed in a naw one.family dwamng. In doing so, wood was used to form the hearth extension. 2. Befora the wood form was removed, an elaborate system of approximately 35 runs of "Pex" piping, used for a radiant floor heating system, were installed over the form. 3. The petitioner states that at this time, removing the piping to access and remove the wood form would create a physical and financial hardship. 4. The' petitioner proposes to install two layers of Y,-Inch fiber insulation board directly under the bluestone hearth to impede heal transfer through the masonry and concrata down to the wood form below, which would prevent pyrophoric carbonization of the combustible material. 5. The petitioner has further proposed to install sheet metal nashing directly under tha bluestone hearth to prevent any embers from penatratlng the heath in ttle event a deep creek occurs. The petitioner, who is a licenced design professional, has submitted a signed and sealed detailed drawing of the proposed modifications to the hearth extension. 7. The local code enforcement official has been consulted in this maUer and does not object 10 the granting of a routine variance under the provisions of 19 NYCI~R 1205.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would be ullnecessary in light of the alternatives, which are the installation of fiber insulation board and sheet metal flaShing directly under the bluestone hearth. These alternatives will ensure the achievement of the Code's intended olljective, such that granting a variance would not substantially adversely affect the Code's provisions for healthy, safety and security. DETERMINATION WHEREFORE IT IS DETERMINED that the applic:ation for a variance from 19 NYCRR Part 1220, Section R 1003.9, to permit combustible material against the underside of a hearth extension, be and is hereby PROPOSED TJ BE GRANTED with the following conditions: 1 That two layers of Y,-inch fiber insulation board be Installed directly under the bluestone hearth in accordance with the submitted drawing. 2 That sheet metal flashing be installed directly under the bluestone hearth in accordance with the submitted drawing. This DECISION is issued under 19 NYCRR 1205.1l.
