(631) 765-1809•Fax (631) 765-9064 P 2 6 2006 FINDINGS, DELIBERATIONS AND DETERMINATION :M *over Clan MEETING OF SEPTEMBER 14, 2006 ZBA Ref. 5930- Julia Vidulich Street& Locality: 375 Goose Creek Lane, Southold CTM 78-8-20 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further requirements under SEQRA. The Zoning Board of Appeals held a public hearing on this application on August 31, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Article III, Section 280-136, sub- section 13 of the Zoning Code, to establish an Accessory Apartment within the existing principal building. The applicant resides in the dwelling, and the dwelling has a Certificate of Occupancy of record, noted as # z9309 dated November 20, 1978 for a single-family dwelling, and Certificate of Occupancy#z-31029 dated July 7, 2005 for additions and alterations to the dwelling. PROPERTY FACTS/DESCRIPTION: This property is 19,999 square feet in area with 100 feet along a private road (Goose Creek Lane) and 200 feet in depth. The property is improved with a single-family dwelling and detached accessory shed, shown on the August 13, 2003 survey prepared by John C. Ehlers. FINDINGS OF FACT In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-136(13) to establish an Accessory Apartment and finds that the applicant complies with the requirements for the reasons noted below: 1. The Accessory Apartment will be located on the second floor in conformity with Section 280-136(13), as proposed. The accessory apartment will contain less than 40% of floor area of the entire dwelling structure. 2. Julia Vidulich has applied and confirms that she has owned and resided at the property, and that she will continue her ownership and residence of the main unit as a single-family dwelling. 3. The applicant's plans comply with the on-site parking requirements and provide for a total of three (3) parking spaces on site, two for the principal use and one for this new Accessory Apartment. 4. The applicant's building complies with the code requirements of a dwelling unit as defined in Section 280-13 of the Zoning Code. Page 2—September 14, 2006 • . ZB#5930—Julia Vidulich CTM 78-8-20 5. The plans indicate that exterior entry to the Accessory Apartment of the existing one-family dwelling will retain the existing appearance of a one-family dwelling. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony, documentation, and other evidence, the Zoning Board determined the following Findings of Fact to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby adjacent residential uses. 2) This Accessory Apartment shall be in conjunction with the owner's residence in the principal single- family dwelling unit, and as proposed will not prevent the orderly and reasonable use of adjacent properties. 3) This accessory use will not prevent orderly and reasonable uses proposed or existing in adjacent use districts. 4) No evidence has been submitted to show that the safety, health, welfare, comfort, convenience, order of the Town would be adversely affected. 5) This zoning use is authorized by the Zoning Code through the Board of Appeals, as noted herein, and a Certificate for Occupancy (or Certificate of Compliance) from the Building Inspector is a code requirement before an Accessory Apartment may be occupied. 6) No adverse conditions were found after considering items listed under Sections 280-143 and 280-144 of the Zoning Code. 7) A Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Ch. 280 of Zoning for an Accessory Apartment use. BOARD RESOLUTION: On motion by Member Weisman, seconded by Chairwoman Oliva, it was RESOLVED, to GRANT a Special Exception for an Accessory Apartment in conjunction with applicant's single-family residence, as applied for, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The owner shall occupy the dwelling as her residence. 2. There shall be no backing out of vehicles onto the street. 3. A Certificate of Occupancy or written compliance document shall be obtained from the Building Department before occupancy of the Accessory Apartment. 4. A chain ladder or other emergency equipment shall be installed on the second floor area which meets the requirements of the Building Codes. Box 1179 Southold, NY 11971-0959 RE: JULIA VIDULICH#5930 SPECIAL EXCEPTION ACCESSORY APARTMENT Dear Chairwoman Oliva: We have lived in the beautiful town of Southold for 28 years in the house we built on a ''/3 acre parcel which is next door to Julia Vidulich, who is proposing a special exception accessory apartment. When we purchased our property it was zoned for 1 family residential usage. Both lots are 100'x 200'. There is only 28-1/2' which separates our two homes and this is the side which Julia Vidulich wants to have a special exception accessory apartment. We wanted to have a family and raise our children within a town which placed children first and we have done that. We have raised 2 children who benefitted in many ways from the quiet, beautiful community we live in. Education K - 12 in the Southold School District, sports teams, dance classes, community fundraisers, Town of Southold Recreation classes all within our wonderful Town of Southold. Both my husband and I work within the town of Southold and have looked forward to many more happy memories in our home with our children and grandchildren. When we purchased our land and built our home, we believed this was a residential community and not a community from which a rental apartment would be built 13-1/2 feet from our sideyard . This structure was built on top of the garage and towers 28 feet above us with a rear deck as the only access to this apartment. It is invasive enough that this structure towers above us but we will also have to endure the loss of privacy from tenants walking down a narrow sideyard between our two properties to gain entry to this apartment from the rear of the house. These tenants will now peer into our kitchen and family room windows. The depreciation of our home and property would become a severe financial loss to us in addition • • • to the loss of privacy. So we have to suffer financial and privacy loss so that our next door neighbor gains financially? What kind of equity is this? The new structure on top of the Vidulich garage was built without having any access from within the existing house. Why would you add space to your existing home without any access to it from within your home? Was the structure originally built with the intention to meet the minimum square footage to then have an accessory apartment for income purposes? We believe this to be so. One look at the plans for the accessory apartment makes it crystal clear that an apartment was planned all along when this structure was built on top of the garage. Both the front and rear of this structure are supported by pilings which extend 4' off the front and 6' off the back of the existing foundation. The owner employs a full-time, live in woman to care for her mother, owns 2 cars in Southold, owns this home in Southold and a home in the Florida Keys (Marathon, Florida). Nor does Mrs. Vidulich work. This is not a case of financial hardship, but, rather an attempt to gain financially while we suffer the loss of privacy and depreciation to the value of our home.. We face tough questions if this accessory apartment is approved by the Town of Southold. 1. Who is going to maintain the peace and quiet while she vacations all winter in Florida? 2. Who will pay for and maintain snow removal (which Doug Wendell has done for 28 years with a walk behind snowblower) ON OUR PRIVATE ROAD with no cost to the 2 other families who live on our road? 3. Where will 3 required parking spaces be placed on a private right of way which is 1 lane wide? 4. How many people will live in this apartment and will we have the right of first refusal on any prospective tenants she interviews? 5. Where will the trash from the apartment be stored and can it be guaranteed not to be on the sideyard we share ? 6. Will Mrs. Vidulich be required to pay more for the maintenance of the road as she is adding onto the amount of families living on our road? Where in all of this does someone gain so much while another one loses so much? Where is our protection? We are opposed to your granting this special exception accessory apartment. We respectfully request that Chairwoman Oliva and the entire zoning board carefully examine this application and protect us as well. Thank you.
