(631)765-1809•Fax (631) 765-9064 s rQCir SUPPLEMENTAL FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 14, 2006 ZB File No. 5936 — GREG and RITA TYLER Property Location: 300 Bayer Road, Mattituck CTM 139-3-23 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA if implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 10,498 square foot parcel has 70 feet along Bayer Road and 150 feet in lot depth, and is improved with a 1-1/2 story, single-family dwelling with deck, and two accessory structures (pool and a shed), as shown on the May 30, 1989 survey prepared by Roderick VanTuyl, P.C. BASIS OF APPLICATION: Zoning Code Sections 280-15 and 280-124 (formerly 100-33 and 100- 244), based on the Building Inspector's May 23, 2006 Notice of Disapproval, amended August 1, 2006, concerning: (1) lot coverage in excess of the code maximum of 20% for total new construction as proposed, (2) proposed porch at less than 35 feet from the front yard lot line, and (3) accessory garage proposed partially in a side yard rather than entirely in the code-required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 31, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to place an accessory detached garage measuring 16 ft. by 24 ft. in size at +/-57 feet from the rear property line and 3 feet from the side property line, and with an increase in lot coverage of 384 square feet. Also proposed is a 6 ft. extension at the front of the dwelling for a 26 ft. long front porch with a 23'6" setback from the front lot line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2—September 14,2006 ZB File No. 5936—Greg and Rita Tyler CTM No. 139-3-23 1. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants' home has a 21' rear yard deck extension, which defines the area of the proposed garage substantially a side yard (the garage is 68'10" from the front lot line, and 58' from the rear line, near center on the property, rather than totally behind the deck). Twelve feet from the rear yard lot line is an existing 512 sq. ft. swimming pool, and approximately 38 feet from the rear line and 3 ft. from the side line is an accessory storage shed. The remainder of the applicant's rear yard, behind the deck, is a cesspool system, which cannot be reasonably relocated. The applicants agree to plant tall bushes to screen the new garage on the closest side, facing the neighboring property and to increase the setback from the easterly side line to a minimum of four feet. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance since the property contains only 10,498 square feet and the width of the land is only 70 feet. 3. The variances granted herein are substantial. The lot coverage increase represents 3.152% (or 315 square feet) over the allowable 20% code limitation. Although the front porch is only one-story and reduces the front yard setback by only six feet, the overall nonconforming for a new setback of 23'6" is a substantial reduction of 32% reduction of the minimum code-required 35 ft. front setback. 4. The difficulty has been self-created. 5. No evidence has been submitted to suggest that variances in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. This determination requires the garage to be a minimum of four feet from the side lot line and appropriate screening to provide a visual buffer from the neighboring yard near the garage. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to DENY the relief as applied for, and to GRANT alternative relief, subject to the following conditions: 1. That the garage shall not be used for habitable space or living area, and shall be used for garage and storage purposes as permitted under the accessory uses listed at Section 100-33 (280-15), and 2. The garage shall be a minimum of four feet from the side lot line and 68'10" from the front lot line, and 3. A visual buffer shall be planted and maintained with a minimum of 3 ft. high evergreens for the length of the garage; and Page 3—September 14,2006 ZB File No. 5936—Greg and Rita Tyler CTM No. 139-3-23 GRANT the setback requested for a front porch addition as applied for, as shown on the construction diagrams dated 4-18-2006 and site plan dated 6/30/2006, prepared by Penny Lumber. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. She informed us that she hadn't looked at the location of the new building prior to the hearing and thought it was to be directly in line with-the side windows of their house. Upon looking at the site and seeing it will be more to the rear yard area of our property, her objections changed and she admitted she should have come to look before the hearing. I also had a meeting with Mrs.Jarrach the property owner and walked her down my yard and showed her the proposed area where the garage is to be located. We discussed the moving of the garage back a little farther and over farther from the property line. We told her that bushes will be planted on the side of the garage toward her property. We can move the garage back a foot and over at least a foot more from the line. The cesspools prevent us from moving the building to far over and that was explained to Mrs.Jarrach. Mrs.Jarrach told me if we could move the building as we discussed she would feel better. We will make every effort to meet Mrs.Jarrach's request and comply with the boards wishes should our permit be granted.
