(631)765-1809 Fax (631) 765-9064 0 06 FINDINGS, DELIBERATIONS AND DETERMINATION Southold Town Cled MEETING OF OCTOBER 5, 2006 ZB File No. 5943—Margaret Travis Radacinski Property Location: 69435 CR 48, Greenport CTM 35-1-8 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further SEQRA steps as planned. . PROPERTY FACTS/DESCRIPTION: The applicant's property has two front yard lines: (1) adjacent on the east side by Sound Road, (2) adjacent on the south side by the North Road. The property consists of 21,484 sq. ft. of land area with 100 ft. street frontage to the east and 200 ft street frontage to the south. The property is improved with a single-family, two-story dwelling as shown on survey prepared by Anthony W. Lewandowski, L. S. dated April 10, 2001. BASIS OF APPLICATION: Request for a Variance under Section 100-231, based on the Building Inspector's July 10, 2006 Notice of Disapproval concerning a proposed fence which will exceed the code limitation of four feet in height when located along a front yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 28, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant/owner seeks an area variance for an existing 6'-6.5' high fence in the front yard of the subject property. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property fronts on C.R. 48 (North Road) and is located at a very heavily trafficked, noisy, and dangerous four-way intersection with Rt. 25 and Sound Road, controlled by a blinking traffic light. The new fence along C.R. 48 that was placed by the owner/applicant varies from 6.0' to 6.5' in height and replaced a four-foot high fence that was destroyed by a truck, which hit a tree and also damaged two trees on the owner/applicant's property. There are no sidewalks or other houses in proximity to the 6' high fence that was erected, and the property line is also vegetated with bramble and trees. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than relief requested since a 6' high fence is not allowed in a front yard without a variance. The 6' portion of the fence is 44' In length while the remainder of the subject property is fenced with 4' high fencing primarily to protect the owner applicants dogs from straying on to the streets or neighbors property Moreover, the 6' portion of the baffled fence is technically in the owner/applicant's architectural side yard. 4. The difficulty has not been self-created, since increasing traffic and noise threatens the safety and well being of the owner and her dogs on the subject property. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 6'-6.5' high fence that will protect her property and baffle some of the noise caused by heavy traffic along CR 48, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on site plan dated 8/05/2005 by Frank Uellendahl, Architect, and the applicant's rough design sketch date-stamped July 21, 2006. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. When I first came to Greenport I enclosed the back part of my property with a simple fence whose only purpose was to prevent my dogs from straying onto the road; four feet was suffient for that purpose. However, the portion of fence that I wish to replace was recently destroyed by a truck which hit a tree, pulled down about 12 feet of fence, and damaged two trees on my property. Since this was not the first time a vehicle has destroyed part of my fence I thought I should choose a more substantial design as I doubt it will be the last time this happens. My secondary reason for this request is an effort to somehow abate the noise from motorbikes that makes the weekends unbearable. Up to a dozen bikes at a time amass at the Greenport light, directly opposite my house, then leave all together in a thunderous roar. Complaints to the police have brought no relief. Therefore I would like to build a six-foot, baffled fence along that one section of my property behind the traffic light - the height and design, I hope, will make the noise less intolerable. I realise that I will probably not have an answer from you within a month'so I would like to add that it is not out of disrespect to you that I am going ahead with the fence before I have your decision. I need to have the fence repaired immediately as I have a new puppy arriving in early August (the two dogs I brought with me both had to be put down recently at 16 and 17 years of age), and I thought it would be easier, and cheaper in the long run to cut a six-foot fence down to four feet, than to take down a four-footer and rebuild it to six. AREA VARIANCE RELIEF REQUESTED: Applicant was disapproved in her building permit application to the Building Department for the location of the existing shed at a minimum of six (6) feet from the southerly property line facing the North Road. REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicant proposes to construct a new dwelling with an accessory garage attached to the dwelling by a porte-cochere, or roof-covered portico to be used for vehicles to drive through and park or access the garage. The as built storage shed is one story height and will not be visible. The shed is very small (6' x 10'). 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Applicant has two front yards and has chosen a location of the dwelling centered with equal distance from both front property lines, reducing the size of the remaining yard on her parcel. 3. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because a stockade fence makes it almost invisible from the street. No evidence has been presented to suggest there would be an affect or impact on neighboring properties. 4. PROPERTY FACTS/DESCRIPTION: The applicant's 21,484 sq. ft. parcel has 100 feet along Sound Road and 200 feet along the north side of North Road, and is improved with a single-family, two- story frame house, as shown on the April 10, 2001 survey prepared by Anthony W. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 20, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct second-floor decks and stairway down to a deck off the first floor, as shown on the August 3, 2005 site map, revised August 5, 2005 by Frank Uellendahl, Architect. The proposed second-floor deck addition is proposed in the center of the widest part of the lot, and the remaining yard to the east contains a driveway and sanitary system facilities, which cannot be reasonably changed. 3. The relief sought is substantial and requires a variance for the entire addition, based on the configuration of the property and frontage along two streets. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5.
