FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING HELD SEPTEMBER 14, 2006

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 1.1645 acre parcel is improved with two (2) existing one
story buildings, as shown on the plan prepared by S.L. Maresca Associates, Consulting Engineers, dated 2-
24-03, updated 3-29-03 with landscaping details.
BASIS OF APPLICATION: Notice of Disapproval issued by the Building Inspector on January 27,2006 for the
reason that the proposed accessory building construction would be in violation of a condition related to the
Building Inspector's March 15, 1990 Notice of Disapproval Issued for this property, and a Variance
determination with Conditions under ZBA Appeal No. 3931, regarding a request for a minimum of 30,000
square feet of land area per use under Zoning Code Section 100-102. Zone District: B General Business.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 31, 2006, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, and other evidence, the Zoning Board finds the following facts to be true and reievant:
AREA VARIANCE RELIEF REQUESTED: On May 30, 1990, the Board of Appeals granted a variance (Appeal
No. 3931) to allow a second business use in the B Zone on a property less than 60,000 square feet, with the
condition that building #2, used as an electrical contractor business and located in the rear yard of said parcel,
would not exceed the 35 x 50 feet as shown on a survey dated Dec 22, 2987 by R. Van Tuyl, The
owner/applicant proposes to build a 42 x 16 x 60 foot Morton Building to serve as an accessory warehouse for
the storage of vehicles and supplies related to the operation of the two principal businesses on the subject
premises, which the Building Inspector states would be a violation of a condition accepted and issued under
Appeal No. 3931.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:

1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The appiication has received site plan approval from the Planning Board and
approval from the Architectural Review Committee. The businesses to the west (a car wash) and the east
(Tyler Electric) are heavily screened from views of the subject property by mature evergreens and hedgerow.
The proposed accessory storage buiiding (#3) is sited far back from Route 25 and screened by the existing
principal building to the north (#1). The site plan dated 2/24/06 shows a row of evergreens along the south
edge of the proposed accessory structure to further screen it from views from Route 25. The existing two
businesses on the subject property, North Fork Custom AudioNideo, and GJS Electric, (building #1 and
buiiding #2 respectively on the site plan submitted and dated 2/24/06) are similar to other business uses in the
area.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than the relief requested. The Building Inspector states that an accessory structure cannot be
built in connection with a use related to the second business on the subject premises without a variance from
the Board of Appeals. The proposed accessory warehouse does not constitute an expansion of either of the
two existing business.
3. The variance granted herein is substantial. The third proposed accessory structure to be used as a
warehouse is 2,250 square feet, each of the existing principal buildings (#1 and #2) measure 1,785 square
feet each. However, the additional proposed accessory structure does not exceed the allowable lot converge
on the subject property.
4. The alleged difficulty has been self-created because the owner/appiicant chose to build an accessory
storage structure that will be used for storage for both of the two businesses on the subject premises in
violation of a condition set forth in ZBA Appeal No. 3931 dated May 30, 1990.
5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on
physical or environmental conditions in the neighborhood. Potential ground water runoff toward Route 25 on
this north/south sloping property will be controlled by proper drainage and infrastructure as shown on the site
pian dated 2/24/06.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a new accessory buiiding to a second business on the subject property, while preserving
and protecting the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairwoman Oliva, and
duly carried, to
GRANT the variance as applied for, as shown on Drainage and Site Plan dated February 24, 2006 by
S. L. Maresca Associates, Consulting Engineers, and elevation diagram prepared by Allied Design
Architectural & Engineering Group, P.C. subject to the following condition:
That the proposed accessory structure be used only for warehouse storage and not for the expansion
of either of the two existing principal business uses on the subject premises.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams
or sUlVey site maps, are not authorized under this application when involving nonconformities under the zoning code. This
action does not authorize or condone any current or future use, setback or other feature of the subject property that may
violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not

increase the degree of nonconformity.

In response to your memo dated August 1,2006, the Planning Board (PB) has reviewed the revised site plan
and offers the following comments:
· We are site planning this project under the Building Departments Notice of Disapproval dated
January 27, 2006 and amended May 30,2006, The notice indicates that "because the accessory
building is slated to be used for part of that 'second business', it is violation" of the previously issued
ZBA decision, appeal # 3931, which states" '" a second business that will not exceed 35 x 50 fe. ".
· The Planning Board is currently reviewing a site plan prepared and certified by Steven L. Maresca of
S.L. Maresca Associates dated February 24,2006 and last revised March 29, 2006.
· The Planning Board accepted the site plan application and began the site plan review process on
April 1 0, 2006.
· The Architectural Review Committee, after review and discussion of the site plan material, accepted
the project on May 4,2006. See attached minutes.
· The Southold Town Engineer responded on May 31, 2006 after review and determined that revised
drainage calculations would be required for stone parking surfaces and questioned if the proposed
landscaping is sufficient.
. Please find attached letter to the applicant from this Department, dated June 13,2006, detailing
changes that should be made to the site plan including addressing the Town Engineer's comments,
parking, and covenants and restrictions regarding cross access. To date, the Planning Board has not
received a revised plan or materials to review.

. Mattituck Fire District responded on June 14,2006 after review stating, "no additional water supply
is required; however they recommend that all drives and road meet the Southold Town
Requirements for clearance of roads and right of ways". See attached letter.
· Suffolk County Planning Department, on June 21, 2006, responded after review and determined this
matter is for "local determination as there appears to be no significant county-wide or inter-
community impact(s)" .
· New York State Department of Transportation responded on June 22, 2006 after review and
indicated their previously issued Highway Work Permit expired on June 1,2005 and a permit
extension will be necessary. See attached letter.
· The L WRP Coordinator responded on July 31,2006, after review and indicated the proposed action
is generally consistent. See attached letter.
· Prior to Planning Board issuing site plan approval, this application will require the following
approvals from various involved agencies: Southold Town Building Inspector, Town Engineer,
SCDHS, SCWA and NYS DOT.
· The Planning Board has concerns regart!ing the subject property's access onto New York State Road
25 and is further reviewing access with NYS DOT to ensure maximum safety. The Planning Board
has no objection to this proposed project provided safe access onto NYS 25 is provided.
We hope these comments will be useful to the ZBA in its review of this appeal.

Board held a work session on Apri110, 2006 and accepted this application.
The site plan application will need to include the following to continue processing:
1. The site plan will need to address the comments of the Town Engineer which wete accepted by the
Planning Board at their work session on Monday, June 12,2006. A copy of that letter has been
enclosed for your review.
2. Parking spaces number 4-12 associated with the parking for existing building # 1 must comply with
Town Code ~100-191 (q which states that all parking stalls must be a minimum of 9' x 19'.
3. All handicap parking stalls and access aisles must comply with New York State Code and ADA
requirements.

As per a request from your office, I have reviewed the revised site plan for the above
referenced project. This site plan has been prepared by the office of S.L Maresca Associates,
Consulting Engineers and has a revision date of 3/29/06. Please consider the following:
1. Drainage Design Calculations provided on the site plan indicate a run-off coefficient of
0.35 for stone parking areas. The Town requires a coefficient of 0.6 for stone parking
surfaces. The drainage calculations should be amended and the design modified as
needed to accommodate this change.
2. Existing Landscaping has been indicated on the site plan. Is this sufficient or will the
Planning Board require new Landscaping to screen the new construction?
With the exception of the item listed herein, the proposed construction meets the minimum

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department as well as the records available to me, it is my determination that
the proposed action is generally CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the L WRP provided that the following standard best management
practices are implemented.

Matter of JOSEPH SHIPMAN. Variance. to the Zoning
Ordinance, article X, Section 100~102, fOr permission to
institute a second business, Bulk,- Area and Parking
Requirementsw Property contains less than required business
area. Property Location: 6619 Main Road, Laurel, County Tax
MaP No. 1000, Section 125, Block 01, Lot 19.7.
WHEREAS, a public hearing was held and concluded on May 15,
1990 in the matter of the Application of JOSEPH SHIPMAN, under
Appeal No. 3931; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1~ The premises in question is located along the
northwest side of Main Road, Route 25, Hamlet of Laurel, and is
identified on the Suffolk County Tax Map as District 1000,
Section 125, Block 01, Lot 19.7.
2. This is an application for Variances from the Zoning ,_
Code Article X, Section 100-102, for permdssion to institute a
second business, bulk, area and parking requirements. Property
contains less than required business area.

3. Article X, Section 100-102, No building or premises
shall be used and no building or part thereof shall be erected
or altered in the B District unless the same conforms to the
Bulk Schedule and Parking and loading Schedules incorporated
into this chapter by reference, with the same force and -effect
as if such regulation were set for the herein in full.
4. The subject premises is improved with. two framed
buildings, located to the rear of the property is a 50 X 35
building approximately 9 1/2 ft. from the southeast prcperty
line, 12 112+- ft. from the northwest property line and the
second building is located 53+- ft from the north side of Main
Road, Route 25 and 25 1/2+-ft. from the west property line.
5. In considering the application, the Board finds and
determines:
(a) that the circumstances of the application are uniquely
related to the premises and its establishednonconformlties;
(b) that there is no other method for appellants to
pursue; and haVing a second business on this location will'
require other variance relief;
(c) that the variance will not in turn" cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(d) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.
Dinizio, it was
RESOLVED, to GRANT a Variance in the matter of the
application of JOSEPH SHIP~ as applied under Appeal No. 3931,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the 35 X 50 ft. building in the rear of said
parcel will be used asa second business that will not to
exceed 35 X 50 ft. as it presently exists on the survey dated
December 22, 1987 by R. Van Tuyl.

2. That the applicant place screening forward"of- the rear
parking area, thence starting at a point approximately 135 ft.
south of the west side rear corner property monument and running
east approximately 120+- with the exception that the applicant
may put a driveway for ingress/egress between the screening area
not to exceed 10 ft. in width.
3. That the evergreens be approximately 3 ft. in height
and be continuously,maintained.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Sawicki and Dinizio lAhsent Charles Grigonisl. This resolution
was duly adopted.
