(631) 765-1809 · Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF OCTOBER 5, 2006 RECEIVED CT 19 Southold Tow~ Cleri ZB File No. 5945 - CUTCHOGUE-NEW SUFFOLK FREE LIBRARY Property Location: 27550 Main Road, Cutchogue CTM 109-6-2.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is nonconforming with an area of 31,666 square feet, located in the R-40 Low-Density Residential Zone District, with a building established as a library since about 1985. BASIS OF APPLICATION: Building Inspector's July 14, 2006 Notice of Disapproval citing Sections 100-242A (based on ZBA Interpretation No. 5039 in the Walz Application) and 100-244 (280-124) concerning a proposed addition and alterations to an existing library building, for the reason that there will be an increase in the degree of nonconformance. The code requires a minimum of 50 ft. rear yard for nonconforming lots measuring between 20,000 and 39,999 square feet in total, and a minimum front yard setback of 40 feet (instead of 40 feet for the rear yard noted on the Notice of Disapproval). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 28, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to make alterations and roof addition as described in the diagrams prepared 5/5/2006, updated 6/6/200.6, by Raymond W. Nemschick, R.A. The majority of construction will not exceed the existing building envelope, dormers will be added over the first floor, and alterations to the existing basement without major excavation for the new support. The existing rear yard setback is and will remain at 19 feet (exclusive of stairways), and the code requires a minimum of 50 feet. The existing front yard setback facing the Main Road is 38 feet to the front entrance, and the code requirement is 40 feet. This setback will also remain unchanged. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2 - October 5, 2006 ZBA #5945 - Cutchogue Free Library CTM 109-6-2.2 1. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new dormers and alterations to the library building will allow for utilization of the lower floor of the library, after building a new foundation under portions of the building (slightly raising the building for installation of the foundation walls). The new construction will not create a new nonconformance and will be minor with respect to the code required setbacks of the building that has existed in this location for many years. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The building has remained in this nonconforming location for many years, with the most recent expansion in 1996. The proposed renovations and dormer additions to this historic landmark will also require a determination by the Town's Landmark Preservation Commission. 3. The relief granted is not substantial. 4. The difficulty has been self-created based upon the size and nonconforming setbacks of the existing building. 5. No evidence has been submitted to suggest that a variance in this hamlet community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of dormer additions and building renovations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT the variances as applied for, as shown on the construction and site diagrams prepared 5/5/2006, updated 6/6/2006, by Raymond W. Nemschick, R.A., subject to applicant obtaining a Certificate of Appropriateness from the Town Landmarks Preservation Commission. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. If the requirements of the town code, pertaining to Landmarks (Local Law No. 22) are met, a Certificate of Appropriateness (C of A) will be issued. Please note the entire existing Church structure, circa 1860% is considered a/oca//andnmrk This section of the Library contains a first floor, eonstxueted atop a dirt crawl space; 12" thick stone fmmdafion walls appmx 36" below grade; and a small wood framed mezzanine known as the "Local History Room". a. Mechanically the former Church area is presently heated and cooled with two (2) electric heat pumps. The indoor air handler units are located in the crawl space, and the outdoor heat pump units are located on grade outside. b. The current electrical service demand is 200 amp of the total 600 amp service c. All domestic water and sewage is on site The last major addition to the Library was consUucted in 1986 and is comprised of two distinct sections. The "Circulation/Entry" is stick-framed construction set atop a concrete crawl space. The "Adult Library" portion of the most recent addition is heavy timber and steel framed construction. The basement, currently used for library staff and infrastructure, is poured concrete and steel framed. The first floor, adult library, is flamed with wood joists supported on the steel beams and columns. The room is a two story high space with exposed heavy timber columns and girders spanning between acting as roof and lateral support only. a. Mechanically, this area is served by indoor air handler units in the basement, each with hot water coils for heating and DX coils for cooling. Hot water is applied by a gas-fired boiler in the basement. The outdoor condenser units are located at grade behind the building. b. The current elec~eal service demand is 400 amp of the total 600 amp service c. Provide for compatible use or reuse of the historic resource, while limiting and minimizing inappropriate alterations to the resource. The proposed public/office space and residential apartment are compatible re-uses of the structure provided that the historic character of the parcel is preserved by minimiTing the size and number of parking areas and the existing vegetation is retained in the design of the proposed improvements. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. E. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality: 1. Preserve existing vegetation which contributes to the scenic quality of the landscape. 2. Allow for selective clearing of vegetation to provide public views without impairing values associated with the affected vegetation. 3. Restore historic or important designed landscapes to preserve intended or designed aesthetic values. 4. Restore or add indigenous vegetative cover that presents a natural appearance. To further this policy it is recommended that all trees greater than 6" in diameter measured 3' above the trunk be retained on-site. All improvements including parking areas should be designed to incorporate or avoid trees that meet this criterion. Policy 5. Protect and improve water quality and supply in the Town of Southola[ 5.5 Protect and conserve the quality and quantity of potable water To further this policy and protect ground water quality it is recommended that the Planning Board require the following best management practice for the newly constructed parking areas: 1. Minimize parking surface areas to the greatest extent practical. 2. Require all new parking areas be constructed with pervious materials (stone) and/or grass pavers. As per the landscape survivability guarantee, the applicant agrees to replace any of the landscape which dies within three years of planting; be it therefore RESOLVED, that pursuant to Southold Town Code 280-131 Part I, the applicant agrees to incorporate all the requirements, comments, and recommendations of each reviewing agency as referenced above and as indicated on the site plan and corresponding attachments; and be it further RESOLVED, that the Southold Town Planning Board has reviewed the proposed action under the policies of the Town of Southold Local Waterfront Revitalization Program and has determined that the action is consistent provided that best management practices are implemented; and be it further RESOLVED, that the Southold Town Planning Board grant approval on the site plan prepared and certified by Raymond W. The owner, agent and/or applicant shall receive approval from the Superintendent of Highways on all work on the Town Right-of-Way on Cases Lane at the time of construction. The owner, agent and/or applicant must notify the Superintendent's office prior to the commencement of any work in the area. 4. The site plan approval requires that all work proposed on the site plan shall be completed within three (3) years from the date of this resolution.
