SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is
implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's property is nonconforming with an area of
31,666 square feet, located in the R-40 Low-Density Residential Zone District, with a building
established as a library since about 1985.
BASIS OF APPLICATION: Building Inspector's July 14, 2006 Notice of Disapproval citing
Sections 100-242A (based on ZBA Interpretation No. 5039 in the Walz Application) and 100-244
(280-124) concerning a proposed addition and alterations to an existing library building, for the
reason that there will be an increase in the degree of nonconformance. The code requires a
minimum of 50 ft. rear yard for nonconforming lots measuring between 20,000 and 39,999 square
feet in total, and a minimum front yard setback of 40 feet (instead of 40 feet for the rear yard
noted on the Notice of Disapproval).
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on September 28, 2006, at
which time written and oral evidence were presented. Based upon all testimony, documentation,
personal inspection of the property, and other evidence, the Zoning Board finds the following
facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant wishes to make alterations and roof
addition as described in the diagrams prepared 5/5/2006, updated 6/6/200.6, by Raymond W.
Nemschick, R.A. The majority of construction will not exceed the existing building envelope,
dormers will be added over the first floor, and alterations to the existing basement without major
excavation for the new support. The existing rear yard setback is and will remain at 19 feet
(exclusive of stairways), and the code requires a minimum of 50 feet. The existing front yard
setback facing the Main Road is 38 feet to the front entrance, and the code requirement is 40
feet. This setback will also remain unchanged.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:

1. Grant of the variances will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The new dormers and alterations to the library
building will allow for utilization of the lower floor of the library, after building a new foundation
under portions of the building (slightly raising the building for installation of the foundation walls).
The new construction will not create a new nonconformance and will be minor with respect to the
code required setbacks of the building that has existed in this location for many years.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The building has remained in this
nonconforming location for many years, with the most recent expansion in 1996. The proposed
renovations and dormer additions to this historic landmark will also require a determination by the
Town's Landmark Preservation Commission.
3. The relief granted is not substantial.
4. The difficulty has been self-created based upon the size and nonconforming setbacks of the
existing building.
5. No evidence has been submitted to suggest that a variance in this hamlet community will have
an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of dormer additions and building renovations, while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Goehringer,
seconded by Chairwoman Oliva, and duly carried, to
GRANT the variances as applied for, as shown on the construction and site diagrams
prepared 5/5/2006, updated 6/6/2006, by Raymond W. Nemschick, R.A., subject to
applicant obtaining a Certificate of Appropriateness from the Town Landmarks
Preservation Commission.
Any deviation from the variance given such as extensions, or demolitions which are not shown on
the applicant's diagrams or survey site maps, are not authorized under this application when
involving nonconformities under the zoning code.
This action does not authorize or condone any current or future use, setback or other feature of
the subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.

The proposed additions and altm'ations to an existing library building on this non-conforming 32,670
square foot lot in the Residential R40 District is not pcmfitted pursuant to Article XXIV Section 100-
242A, which states;
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use, provided that such
action does not create any new non-conformance or increase the degree of non-conformance
with regard to the regulations per~ainlng to such buildings."
Article I1][, Section 100-244, states tl~ nonconformin~-lots measuring between 20,000 and 39,999
square feet in total size requi~ a rear yarc~setback of~t. Currently, the library building is noted as
being +/- 19 feet. The propo~ed_c, onstruetiOn maintains'-that sethac .kT-""~,~.~
Pursuant to the ZBA's interpretation in Walz (//5309), such additions and alterations will thus
constitute an increase in the degree of nonconformance.
Furthermore, the proposed construction, is not permitted without review and approval by the Southold
Town Landmark.q Preservation Commission, because the property is listed on either the Southold
Town, New York State end/or the National Registers of Historic Places and requires review by the
Southold Town Landmarks Preservation Commission.
If the requirements of the town code, pertaining to Landmarks (Local Law No. 22) are met, a
Certificate of Appropriateness (C of A) will be issued. The C of A is required before a Building Permit
will be approved. Information about the requirements for applying for a C of A is available at the
information counter in the Building Dapat hnent.

APPLICATION FOR BUILDING PERMIT
INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for i~.spection throughout the work. ','
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shalI expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

WHEREAS, the public hearing on the appeal application of the
CUTCHOGUE'FREE LIBRARY, Appeal Ne, 3315, was held and concluded on
'February 14, 1985,.at 'which time no oppesit(on was'received and the
applicant.was.heard in behalf.of this.application;
WHEREAS, the board men'bets have v~wed and are familiar with
the premises in question and its surrounding area; and
WHEREAS, the board made the following findings of fact:

5. For the record it is noted that the January 16, lg85
certification of the Building Inspector indicates that the site
plan as proposed before the Planning Board will meet all other
zoning requirements, and which this beard is in agreement with;
Also, in considering this appeal, it is the opinion of the
board:
1. That the relief as requested is not substantial and
that the area chosen is the most feasible, particularly in light
of the fact the subject premises is a corner lot and the building
is set back substantially from the main highways;
2. The proposal (s'consistent with the character of the
area since the use has been established and the site abuts premises
in the business district on the east, which is required to have a
minimum of 35-feet from the rear property line (15 feet less than
that required for thl.s site);
3.. There w(ll be no effect on population density and thereby
will not effect available governmental f~clltti~s;
4. That in view of'the manner t~ which the difficulties
arose, Justice will be served by allowing the variance, as.applied.

GENERAL INFORMATION
1. The oldest part of the library is located in what was originally a wood framed church
structure which now houses the "Children's Library". Please note the entire existing
Church structure, circa 1860% is considered a/oca//andnmrk This section of the
Library contains a first floor, eonstxueted atop a dirt crawl space; 12" thick stone
fmmdafion walls appmx 36" below grade; and a small wood framed mezzanine known as
the "Local History Room".
a. Mechanically the former Church area is presently heated and cooled with two (2)
electric heat pumps. The indoor air handler units are located in the crawl space,
and the outdoor heat pump units are located on grade outside.
b. The current electrical service demand is 200 amp of the total 600 amp service
c. All domestic water and sewage is on site
The last major addition to the Library was consUucted in 1986 and is comprised of two
distinct sections.
The "Circulation/Entry" is stick-framed construction set atop a concrete crawl space.
The "Adult Library" portion of the most recent addition is heavy timber and steel framed
construction. The basement, currently used for library staff and infrastructure, is poured
concrete and steel framed. The first floor, adult library, is flamed with wood joists
supported on the steel beams and columns. The room is a two story high space with
exposed heavy timber columns and girders spanning between acting as roof and lateral
support only.
a. Mechanically, this area is served by indoor air handler units in the basement, each
with hot water coils for heating and DX coils for cooling. Hot water is applied by
a gas-fired boiler in the basement. The outdoor condenser units are located at
grade behind the building.
b. The current elec~eal service demand is 400 amp of the total 600 amp service

Former Church Structure
Construction of new poured concrete foundation walls housing a Community room below
the Children's Library (former Church) will include; temp support of the existing church
structure to be lifted appmx ~" in height, leveled and reset to the original height; removal
of existing wood floor framing; installation of new first floor steel framed concrete deck
supporting 150lbs/sr.
Construction of the new first floor will include; general stack area for the entire
Children's Library and new Programming room. Please note the existing mezzanine
(local history room) and the wall below it shall remain in as is condition and will need to
be supported during the proposed alterations.
Construction of a new second floor gallery will include; steel framed concrete deck
supporting 1501bs/sf; existing heavy timber truss framing o£the former church structure
to be exposed to extent shown in the floor plans and sections provided.
4. New Mechanical, Electrical, Plumbing and Fire suppression will be provided in all afore
mentioned spaces.
Former 1986 Addition - Circulation Area
Construction of the new basement connector will include; poured concrete foundation to
same depth as existing staff area and proposed community room in place of existing
crawl space acting as corridor between; removal of existing wood girders and installation
of new steel girders to support the existing floor flaming; new cat-walk and stair
connecting both second floor levels with ramp according to ADA standard 1:12 slope.
2. New Mechanical, Electrical, Plumbing and Fire suppression will be provided in all afore
mentioned spaces.

Former 1986 Addition - Adult Library
Alterations to existing basement will include; construction of new poured concrete
footing in place of existing column footings to provide adequate additional structural
capacity to new second floor mezzanine.
Alterations to existing first floor will include; general stack area for the entire Adult
Library and new young adult area requiring temporary shoring of the existing roof and
walls as the in-place heavy timber girders are removed and replaced with steel; heavy
timber girders will to be stored, milled and re-used aesthetically: existing heavy timber
and steel columns will remain and be sistered with new steel columns from the basement
to the underside of new second floor structure.
Construction of a new second floor mezzanine will include: steel framed concrete deck
supporting 1501bs/sf.
Construction of new Elevator fi, om basement thru second floor as annotated on the plans
provided.
New Mechanical, Electrical, Plumbing and Fire suppression will be provided in .all afore

This amended site plan is for the proposed renovation of an existing two story building of 10,720 sq.
ft. public use space where the 2,100 sq. ft. is public space, 2,100 sq. fi. is office space, misc. space
and one (1) two (2) bedroom apartment on the second floor on a 136.6 acre parcel known as Peconic
Landing in the R-80 zone located on the north side of New York State Road 25, approximately
1103' west of Gull Pond Lane in Greenport. SCTM #: 1000-35-1-25.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department as well as the records available to me, it is my determination that
the proposed action is generally CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP provided the following best management practices are
required to further the policies of the LWRP.
POLICY STANDARDS
Policy 2 Preserve historic resources of the Town of Southold.
2.1 Maximize preservation and retention of historic resources.
B. Provide for compatible use or reuse of the historic resource, while limiting
and minimizing inappropriate alterations to the resource.
The proposed public/office space and residential apartment are compatible re-uses of the
structure provided that the historic character of the parcel is preserved by minimiTing the size
and number of parking areas and the existing vegetation is retained in the design of the proposed
improvements.
Policy 3 Enhance visual quality and protect scenic resources throughout the Town of
Southold.
E. Preserve existing vegetation and establish new indigenous vegetation to enhance
scenic quality:
1. Preserve existing vegetation which contributes to the scenic quality of the
landscape.
2. Allow for selective clearing of vegetation to provide public views without
impairing values associated with the affected vegetation.
3. Restore historic or important designed landscapes to preserve intended or
designed aesthetic values.
4. Restore or add indigenous vegetative cover that presents a natural
appearance.
To further this policy it is recommended that all trees greater than 6" in diameter measured 3'
above the trunk be retained on-site. All improvements including parking areas should be
designed to incorporate or avoid trees that meet this criterion.
Policy 5. Protect and improve water quality and supply in the Town of Southola[
5.5 Protect and conserve the quality and quantity of potable water
To further this policy and protect ground water quality it is recommended that the Planning
Board require the following best management practice for the newly constructed parking areas:
1. Minimize parking surface areas to the greatest extent practical.
2. Require all new parking areas be constructed with pervious materials (stone) and/or grass
pavers.

WHEREAS, Cutchogue New Suffolk Free Library, is the owner of the property located on the s/e
corner of New York State Route 25 and Case's Lane known as 27550 Main Road in Cutchogue.

WHEREAS, on June 30, 2006, the Southold Town Building Department issued a Notice of
Disapproval that the proposed construction will required a variance under Town Code Sections
100-242 A & 100-244, furthermore the proposed construction requires Southold Town Landmark
Preservation review / approval and Southold Town Planning Board site plan approval; and
WHEREAS, on August 17, 2006, the agent, Raymond W. Nemschick, Architect, submitted a
formal site plan for approval; and
WHEREAS, on September 14, 2006, the Architectural Review Committee reviewed the
associated site plan materials and approved the site plan as submitted and the Southold Town
Planning Board accepted the endorsement; and
WHEREAS, on September 19, 2006, the Suffolk County Department of Planning responded
after a review and determined this matter is for "local determination as there appears to be no

significant county-wide or inter-community impact(s)" and the Planning Board accepts this
pursuant to 239L & M General Municipal Law; and i~:, ~ .. :
WHEREAS, on September 22, 2006, the Cutchogue Fire District reviewed and approved the
proposed construction indicating that the "district does not feel that a fire well or hydrant is
needed due to the
properties location in a near proximity to an existing water supply" and the Planning Board
accepts the approval; and
WHEREAS, on October 5, 2006, the New York State Department of Transportation reviewed the
referral the NYSDOT assigned the case number 06-340 noting that there is no work proposed
within the State highway right-of-way and no highway work permit is required at this time; and
WHEREAS, on October 5, 2006, the Southold Town Zoning Board of Appeals granted a
Variance as applied for and described under Appeal Number 5945; and
WHEREAS, on October 17, 2006 the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, pursuant to 6 NYCRR Part 617, makes a determination that
the proposed action is a Type II and not subject to review; and
WHEREAS, on October 23, 2006, the Southold Town Building Inspector reviewed and certified
the site plan for "Library is a permitted use by special exception in this R-40 district" and the
Planning Board accepts the certification for approval; and
WHEREAS, on November 2, 2006, the Architectural Review Committee reviewed the proposed
changes as required by Landmark Preservation and issued "conditional approval pending receipt
of changes in drawings modifying entry dormer" and the Southold Town Planning Board
accepted the endorsement; and
WHEREAS, on November 8, 2006, the Southold Town Engineer reviewed the site plan materials
and issued a report letter with comments and the Planning Board accepts the report; and
WHEREAS, on November 13, 2006, the Southold Town Landmark Preservation has not issued
the certificate of appropriateness from the Hearing Held on October 30, 2006 and the Planning
Board will accept changes and or revisions as required by Land Mark Preservation; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public
Hearing, has received affidavits that the applicant has complied with the notification provisions;
and
WHEREAS, the following items shall be required:
· All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the light
in such a manner as to contain the light and glare within property boundaries. The
lighting must meet town code requirements.
2. All signs shall meet Southold Town Zoning Codes and shall be subject to the
approval of the Southold Town Building Inspector.

3. As per the landscape survivability guarantee, the applicant agrees to replace any
of the landscape which dies within three years of planting; be it therefore
RESOLVED, that pursuant to Southold Town Code 280-131 Part I, the applicant agrees to
incorporate all the requirements, comments, and recommendations of each reviewing agency as
referenced above and as indicated on the site plan and corresponding attachments; and be it
further
RESOLVED, that the Southold Town Planning Board has reviewed the proposed action under
the policies of the Town of Southold Local Waterfront Revitalization Program and has
determined that the action is consistent provided that best management practices are
implemented; and be it further
RESOLVED, that the Southold Town Planning Board grant approval on the site plan prepared
and certified by Raymond W. Nemschick, Architect dated October 31, 2006 known as A-2.01and
the building elevation plans labeled A-4.01, A-4.02, A-4.03 and A-4.04 dated October 31, 2006
and authorize the Chairperson to endorse the final site plan with the following conditions:
If necessary, the applicant/agent/owner shall obtain certification from a design
professional for the existing septic system or approval from Suffolk County
Department of Health Services for the approved construction. This approval must
be to the satisfaction of the Southold Town Building Department. If the septic
approval changes from the approved site plan, the Planning Board reserves the
right to the review of a new site plan application.
The owner, agent and/or applicant shall receive approval from the Southold Town
Landmark Preservation in the form of a certificate of appropriateness approving the
construction and submit such certificate to the Southold Town Planning
Department for review. If such approval varies from this approved site plan,
requires changes to the approved site plan, the Planning Board reserves the right
to the request a revised site plan.
The owner, agent and/or applicant shall receive approval from the Superintendent
of Highways on all work on the Town Right-of-Way on Cases Lane at the time of
construction. The owner, agent and/or applicant must notify the Superintendent's
office prior to the commencement of any work in the area.
4. The site plan approval requires that all work proposed on the site plan shall be
completed within three (3) years from the date of this resolution.
Prior to the request for the Certificate of Occupancy, the owner or authorized agent
must request the said Building Inspector and the Planning Board to perform an on-
site inspection to find the site improvements are in conformity with the approved
site plan.

6. If the as-built site improvements vary from the approved site plan, the Planning
Board reserves the right to request a certified as-built site plan detailing all the
changes.
7. Any changes from the approved site plan shall require Planning Board approval,
and any such changes without Planning Board approval will be subject to referral
to the Town Attorney's Office for possible legal action.
8. The Planning Board will issue a final site plan approval in the form of a letter
following a site inspection and at the time the site improvements are found to be in
