CHARNEWS (Owner); SHANNON GOLDMAN (Contract Vendee) Street& Locality: 8605 Sound View Road, Southold Zone District: R-40 Low-Density Residential CTM 59-6-27.2 and 27.3 (combined/merged area is 97,088 sq.ft. including flood areas and wetlands) FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property is described land consisting of a total of 97,088 square feet, identified as 27.2 and 27.3 on the Suffolk County Tax Maps, District 1000, Section 59, Block 06. The land is located in the R-40 Low-Density Residential Zone District, which requires a minimum lot size of 40,000 square feet. BASIS OF APPLICATION: Article II, Section 100-26, based on the Building Department's March 31, 2006 Notice of Disapproval stating that County Tax Map Parcel Numbers 27.2and 27.3 are merged pursuant to Section 100-25, which provision states: "Merger. A nonconforming lot shall merge with an adjacent conforming or nonconforming lot which has been held in common ownership with the first lot at any time after July 1, 1983. An adjacent lot is one which abuts with the parcel for a common course of fifty (50) feet or more in distance. Nonconforming lots shall merge until the total lot size conforms to the current bulk schedule requirements." RELIEF REQUESTED: Applicant requests a Waiver to unmerge properties which have been merged into one parcel. The southerly portion, referred to herein as 'CTM 27.2', is proposed to be separated from the northerly portion, referred to as 'CTM 27.3.' Combined the land is 97,088 square feet when including the flood area and wetlands, and to separate CTM 27.2 from 27.3 would result in a lot that does not meet the code-required 40,000 square feet in this R-40 Low-Density Residential Zone District, for the southerly portion proposed with 23, 277 square feet. TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: The applicants are requesting a new dwelling and accessory swimming pool construction in a new location, set back less than the code-required 75 feet minimum from the freshwater wetlands and less than 100 feet separation under Chapter 97 of the Town Code. A Determination of Inconsistency was issued under Chapter 95, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP)standards. ZONING CODE, SECTION 100-26: Under § 100-26-A, if a lot has merged, the Zoning Board of Appeals may waive the merger and recognize original lot lines upon public hearing and upon finding that: (1) The waiver will not result in a significant increase in the density of the neighborhood. (2) The waiver would recognize a lot that is consistent with the size of lots in that neighborhood. (3) The waiver will avoid economic hardship. Page 2—June 29,2006 Appl. No.5887—C.Charnews CTM 59-6-27.2 and 27.3 (merged as one lot) (4) The natural details and character of the and character of the contours and slopes of the lot will not be significantly changed or altered in any manner, and there will not be a substantial filling of land affecting nearby environmental or flood areas. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 22, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Grant of a waiver to unmerge a land area of 23, 277 square feet, from the existing area of total land area of 97,088 square feet, is not consistent with lots in the neighborhood. A waiver would result in the creation of a nonconforming lot of 23,277 square feet instead of a minimum of 40,000 square feet for this R-40 Low-Density Residential District. The remainder of the land on the northerly portion (CTM 27.3)would be 73,811 square feet. The adjacent premises to the east (CTM 21) is improved with a dwelling and the lot size exceeds the code required minimum 40,000 square feet of area, as do the conforming properties adjacent and located along the south side of Soundview Avenue. While a few other properties in the area are less than 40,000 square feet, those are developed with a dwelling or are either merged with adjacent land, or would be able to meet the Lot Creation and Lot Exception provisions of Article II (100-23, 100-24, 100-25 of the Zoning Code). A single and separate search was prepared November 21, 2005 by Republic Abstract Corp. The 2005 search shows the last deed conveyance for CTM 27.2 on June 3, 1976 to Clement Charnews from John Charnews. CTM 27.3 was also acquired by Clement Charnews from John Charnews by deed dated June 3, 1976. For at least 26 years, the properties were not held in single and separate ownership, remaining in the same name (or common ownership) of Clement Charnews until July 18, 2005, when CTM 27.3 was conveyed by Charnews to Spiridakis, and the remaining area was left nonconforming in size and not meeting the requirements of Article II (Lot Creation and Merger Provisions) of the Zoning Code. 2. Proof was not submitted to show that a waiver will avoid an economic hardship It has been this Board's determination on numerous occasions in the past, that it is not sufficient for an applicant to satisfy the economic hardship requirement of the statute merely by submitting that the properties would be more valuable in an unmerged state rather than merged. This determination has been upheld by the Supreme Court and Appellate Division. In this instance, applicant has not offered any showing of hardship other than that found by this Board and the New York courts to be insufficient for a grant of waiver of merger. The property has been in common ownership with a merged area of 97,088 square feet since 1976. Although the northerly parcel was conveyed in 2005 with a conforming land size, the southerly portion of 23,777 square feet was merged for 29 years and conveyed out by the owner to another individual without meeting the requirements of the Zoning Code or Subdivision Code of the Town of Southold. Page 3—June 29,2006 Appl. No.5887—C.Charnews CTM 59-6-27.2 and 27.3(merged as one lot) Proof was not submitted to show that a waiver will avoid an economic hardship. The applicant indicated that the property would become more valuable as two separate building lots if the lot waiver were granted, but the record does not show that there is an economic hardship for the property to remain part of the original lot as recognized under Article II with an area of 97,088 square feet with the northerly portion of land. The town's assessment records show that only the northerly portion of land (CTM 27.3)was sold for$482,500 in 2005, and recently, during 2005-2006 the applicant entered into a contract of sale for the southerly portion (CTM 27.2) for $325,000. Under the contract of sale for the southerly portion, the contract vendee obtained wetland permits from the State D.E.C. and a sanitary permit from the County Health Department. There is no proof demonstrated in the record to show that the southerly portion of the applicant's property was maintained separately for purposes of building a new single-family dwelling. There also was no proof demonstrated to show the value of the property as exists with the merger to support applicant's claim of economic hardship, other than if the waiver were granted, then the parties under the contract of sale for the southerly portion (CTM 27.2)of the property would be able to close. Applicant is not obliged to sell when someone has a desire to unmerge the properties for the purpose of entering into a contract of sale, acquiring the vacant portion of the premises, or to provide a benefit for increased income. 3. No evidence was submitted by applicant with regard to environmental impacts and potential effects under Section 100-26A(4). The neighboring adjacent lots are already developed and improved with dwellings. The Board is not willing to create additional future lots, increased number of dwellings, increased traffic, increased water and sanitary demands, and other related environmental effects. Also, the lot nonconformities requested by applicant would create a lot meeting only 59% of the code requirement of 40,000 square feet, since one-acre zoning requirements have been in effect since the applicant's purchase (1976). Although there are several conforming lots in the area, many are greater than 40,000 square feet in size and developed with single-family dwellings in this neighboring area. To create (unmerge) additional lots that do not conform to the zoning requirements and that have been merged for a continuous period of time will result in increased number of dwellings, increased traffic, increased water and sanitary demands, and other related environmental effects. The Board is not willing to create additional nonconforming lots for future, increased number of dwellings, increased traffic, increased water and sanitary demands, and other related environmental effects. RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Chairwoman Oliva, it was RESOLVED, to DENY the requested Lot Waiver to unmerge CTM 1000-59-6-27.2 from 1000-59-6-27.3. The Charnews family owned these lots and deeded them among the family members over the years. The adjacent lot(27.3) was over one acre in size and was sold in 2005 to Anthony Spiridakis. The remaining lot is under one acre, is under contract to Shannon Goldman, who has spent the last year obtaining Health Department approval, Southold Town Trustees approval and NYSDEC approval. Prior to commencement of any construction activities,a continuous row of straw bales shall be staked end to end as shown on the approved plans. The bales shall be maintained, repaired and replaced as often as necessary to ensure proper function, until all disturbed areas are permanently vegetated. Sediments trapped by the bales shall be removed to an approved upland location before the bales themselves are removed. 5. Straw bales shall be recessed two to four inches into the ground at all times. 6. All fill shall consist of clean soil,sand and gravel that is free of the following substances:asphalt,slag,fiyash,broken concrete,demolition debris,garbage,household refuse,tires,woody materials Including tree or landscape debris,and metal objects. 7. The driveway must be surfaced with a permeable material. 8. All equipment and machinery shall be stored and safely contained greater than 100 feet landward of the regulated wetland or waterbody at the end of each work day. This will serve to avoid the inadvertent leakage of deleterious substances into the regulated area. Fuel or other chemical storage tanks shall be contained and located greater than 100 feet landward of the regulated wetland or waterbody at allk times. If this requirement cannot be met by the permitter, then the storage areas must be designed to completely contain any and all potential leakage. Such a containment system must be approved by NY SDEC staff prior to placement of equipment, machinery or tank storage within 100 feet of the regulated wetland or waterbody. 9. All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass and mulched with straw immediately upon completion of the project,within two(2)days of final grading,or by the expiration date of this permit, whichever is first. Mulch shall be maintained until a suitable vegetative cover is established. If seeding is impractical due to the season,a temporary mulch shall be applied and final seeding shall be performed as soon as weather conditions favor germination and growth. 10. Suitable vegetative cover is defined as a minimum of 85%area vegetatively covered and no unvegetated areas larger than one(1)square foot in size. 11. The permittee shall incorporate the attached Covenant(or similar language)to the deed for the property where the project will be conducted and file it with the Clerk of Suffolk County within 30 days of the effective date of this permit. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility,including relevant records,Is subject to Inspection at reasonable hours and Intervals by an authorized representative of the Department of Environmental Conservation(the Department)to determine whether the permittee is complying with this permit and the ECL.Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps,drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. Two types of pollutant sources are of great concern: that of stormwater runoff from public andprivate property and that ofpoorly-sited or malfunctioning on-site wastewater treatment systems." "Wastewater treatment is a major problem where the lots are non-conforming in size,particularly if the lots are on the water's edge. As the value of waterfront continues to increase (be this sound, lake or pond front), the pressure to upgrade and expand existing structures on undersized lots may result in increased levels of pollution to surface and ground waters." Additionally,the proposed action is inconsistent with Policy 6 for reasons stated below. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed residence on SCTM # 59-6-27.3 is sited at SO feet form a freshwater wetland; a minimum separation distance of 100' is required pursuant to Chapter 97 Please require that the applicant amend the application to meet the above policy.
