Booth; THENCE along said land of Booth, North 48 degrees 53 minutes 40 seconds East 122.30 feet to the point of BEGINNING. TOGETHER with a right of way over said 50 foot private road known as "Marley Road" from the westerly corner of the premises southeasterly to said 50 foot private road known as "Jennings Road" and thence northeasterly over said "Jennings Road" to Hortons Lane, for the purpose of ingress and egress to and from said premises and to and from Hortons Lane, and for the further purpose of installation, maintenance, repair and replacement of public utility lines, pipes and conduits, on the surface, below the surface and above the surface of said right of way, in such manner as not to interfere with surface transportation over same. BEING AND iNTENDED to be the same premises as conveyed to the grantors by deed recorded in Liber 5090 page 262. TOGETHER with all right, title and interest, if any, of the party of the first part, in and to auy streets anti roads abutting the above-described premises to the center lines thereof; TOGETHER with the appartenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party ol'the second part forever. AND the par~y of the first part covenants that the party of the first part has not done or suffered anything whereby the said p~6mises have been encnmbt~)~ in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive, such consider- ation as a trust fnnd to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improve~nent before using any part of the total of the same for any other purpose.
