WITNESSETH, that the party of the first part, in consideration often dollars and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being in the at Southold, Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a point on the boundary line between land now or formerly of Southold Builders, Inc. and
land of C.W. Booth, said point of beginning being South 48 degrees 53 minutes 40 seconds West, 398.51
feet along said boundary line from an iron. pipe on the westerly line of Hortons Lane; from said point of
beginning running along said land now or formerly of Southold Builders, Inc., South 41 degrees 35
minutes 00 seconds, East 154.75 feet to the northerly line of a 50 foot private road known as "Jennings
Road";
THENCE along said northerly line of said 50 foot private road known as "Jennings Road", South 48
degrees 25 minutes 00 seconds West, 139.55 feet to the easterly line of a 50 foot private road known as
"Marley Road';
THENCE along said easterly line of said 50 foot private road known as "Marley Road", North 35 degrees
15 minutes 30 seconds West 156.73 feet to said land of C.W. Booth;
THENCE along said land of Booth, North 48 degrees 53 minutes 40 seconds East 122.30 feet to the point
of BEGINNING.
TOGETHER with a right of way over said 50 foot private road known as "Marley Road" from the westerly
corner of the premises southeasterly to said 50 foot private road known as "Jennings Road" and thence
northeasterly over said "Jennings Road" to Hortons Lane, for the purpose of ingress and egress to and
from said premises and to and from Hortons Lane, and for the further purpose of installation,
maintenance, repair and replacement of public utility lines, pipes and conduits, on the surface, below the
surface and above the surface of said right of way, in such manner as not to interfere with surface
transportation over same.
BEING AND iNTENDED to be the same premises as conveyed to the grantors by deed recorded in Liber
5090 page 262.
TOGETHER with all right, title and interest, if any, of the party of the first part, in and to auy streets anti roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appartenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party ol'the second part forever.
AND the par~y of the first part covenants that the party of the first part has not done or suffered anything whereby
the said p~6mises have been encnmbt~)~ in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive, such consider-
ation as a trust fnnd to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improve~nent before using any part of the total of the same for
any other purpose.
The word "party" shall be constrned as it' it read "parties" whenever thc sense of Ihis indenture so requires.
