On June 9, 2005, I sent you a letter outlining the Committee'sioffer for the purchase of a
development rights easement on your property. As we discussed yest~rday, it has come to our
attention that a Declaration of Covenants and Restrictions was filed a~part of the1982 subdivision
that created the subject lot. The 1982 subdivision created two lots -- t e 17-acre lot on which you
are asking the Town to purchase a development rights easement and a 3.1-acre lot now known as
SCTM# 1000-86-6-32. It appears that the Covenant and Restriction i eludes both the 17-acre lot
and the 3.1-acre lot and that it prohibits further subdivision of either 10 .
The Land Preservation Committee's appraisal and offer was ~ased on the assumption that
the property is subdividable. The prohibition against further subdivisioh restricts development of
the property to one (1) dwelling only. Since there is an existing dwellin~ on the property and the
remaining property can not be subdivided, there are no existing develljpment rights for the Town to
purchase; therefore, the Land Preservation Committee must withdraw Hs June 9, 2005 offer to
purchase a development rights easement.
I have enclosed copies of Planning Board minutes (septembej' 14,1981, March 8,1982,
and March 22, 1982) relating to the Covenants and Restrictions. It is nfortunate that this
information did not come to light earlier in the land preservation applic tion process. Please feel

At a regular meeting of the Southold Town Planning Board, Monday
March 22, 1982 the following action was taken:
RESOLVED that whereas, a formal application for the approval of a
minor subdivision plat entitled Minor Subdivision of John and Nancy
Pearson was submitted to the Planning Board on September 8, 1981
and an application fee of $50 was paid on September 11, 1981, and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, SouthOld, New York, on March 8, 1982 at
7:45 p.m. and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of John and Nancy
Pearson for approval of said subdivision plat prepared by Roderick
Van Tuyl, P.C. dated August 5, 1981, and amended December 8, 1981 be
approved and the chairman be authorized to endorse approval on said
subdivision map subject to the execution of the covenants and restrict-
ions as approved by the Town Attorney and the following eight con-
ditions within a six (6) month period from date of resolution:
1. No residential structure shall be constructed within 100
feet of the upland edge of the tidal wetlands along
Richmond Creek.

2. No sanitary disposal facility shall be installed or con-
structed within 100 feet of the upland edge of the tidal
wetlands along the shoreline of Richmond Creek.
3. Erosion and sediment control measures shall be required
during and immediately after construction on each lot to
insure that stromwater runoff will not carry eroded and
other deleterious materials into Richmond Creek and the
tidal wetlands that border the Creek.
4. No stormwater runoff resulting from the development of
the subdivision or any of the lots shall be discharged
directly into the adjacent body of water.
5. A conservation or scenic easement having a minimum width
of 50 feet shall be established along the shoreline of
Richmond Creek to insure that no development adverse to
the aesthetic attributes of the shoreline will take place
along the shoreline.
6. No lot shall be subdivided or its lot lines changed 1IT
any manner at any future date unless authorized by the
Town of Southold Planning Board.
7. Approval of this subdivision shall be made subject to the
subdivision's meeting the requirements and standards of
the Suffolk County Department of Health Services
8. The above conditions shall be filed as covenants and re-
strictions in the office of the County Clerk on or prior
to the granting of approval to this subdivision.
Upon receipt of three (3) final maps, listing the eight (8) conditions,
and a copy of the recorded covenants and restrictions, the Chairman
will endorse approval on said maps, two of which will be returned to
your office

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on January 6,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision - John
and Nancy Pearson", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map sub-
ject to the following eight conditions deemed necessary to help preserve the
natural and aesthetic attributes of the shoreline of Richmond Creek:
1. No residential structure shall be constructed within 100 feet of the
upland edge of the tidal wetlands along Richmond Creek.

At a regular meeting of the Southold Town Planning Board, Monday
December 7, 1981 the following actions were taken:
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act for
the minor subdivision of John and Nancy Pearson (Vescur), located
at Southold. An initial determination of non-significance has been
made.
RESOLVED that the Southold Town Planning Board approve the sketch
map of the subdivision entitled John and Nancy Pearson (Vescur),
located at Southold.
The covenants and restrictions, submitted to this office October 13,
1981 were acceptable to the Town Attorney and the Planning Board.
Would you submit 12 copies of the final subdivision map. to our office,

THIS INDENTURE made this

hereinafter called the Declarant.
WHEREAS, the Declarant is the owner in fee simple of a certain parcel of land
situate in the Town of Southold, Suffolk County, New York, and designated on the
Suffolk County Tax Map as District 10m~Section 75/Block 7 and Lot 6 containing
approximately 20 acres, being the same premises acqui red by the Declarant by deed
dated and recorded in the Suffolk County Clerk's Office on

premises and every portion thereof is hereby held and shall be conveyed subject to
the conditions, covenants and restrictions hereinafter set forth, and that every

thereto, covenants and agrees that the premises so purchased shall be held subject
to the covenants, conditions, and restrictions hereinafter set forth.
1. No lot or plot as shown and designated on the Minor Subdivison map
approved by and filed with the Southold Town Planning Board shall be further subdivided.
2. That the covenants, conditions and restrictions contained herein shall
be construed as real covenants running with the land and shall continue andremain
in full force and effect at all times as against the owner of the premises or any
portion thereof in perpetuity. Said covenants, conditions and restrictions shall be
binding upon, inure to the benefit of and be enforceable by the Declarant, their heirs,
successors and assigns; any owner of any portion of the aforesaid premises, their heirs,
successors and assigns, and the Town of Southold, and its successors and
assigns, and the failure of any of the foregoing to enforce any of such covenants,
conditions and restrictions shall in no event be deemed a waiver of the right ot do so

Your letter of July 15 does not provide us with the information
requested in our letter to you of July 9.
Our clients, Doctors John and Nancy Pearson,
to purchase the 20 plus acres parcel from John Vescur.
for a minor subdivision at this time.

We are not applying
The survey submitted to you shows that the entire parcel has but
50 feet of frontage on South Harbor Road. In the future, we may wish to
subdivide the 20 acres into two oversized plots, each having its own
access to the road. Perhaps the 50 feet could be evenly divided so that
each parcel would have 25 feet; or, perhaps a common driveway should be
considered.
We would appreciate having this matter reviewed by your board
and we would consider any recommendations you may suggest. Please acknowledge.

Dear Mr. Wickham:
On April 4, 1977, I appeared before your Board relative to the pres-
entation_of a sketch-plan showing a 4-1ot minor subdivision on the
former Stankewicz property. You advised me that the Board had not
been happy with the front lot containing 8.3 acres, and indicated
that you wanted to have a revised plan submitted to you.
You further indicated that it would be a better plan if the front
lot was completely eliminated and that there would be a 50-foot wide
road from South Harbor Road to the 3 water front lots. You also in-
dicated that the property owners adjoining the subject property were
a -Mr. Lappe and a Mr. Manitta, who were both farmers, and who might
be interested in acquiring additional farm land.
Please be advised that both Mr. Lappe and Mr. Manitta have been con-
tacted, and both indicated that they had no interest in acquiring
this land.
As such, I would ask your Board to re-evaluate your previous deter-
mination and advise me of your present feelings.
