WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,

the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with thc buildings and improvements thereon erected,

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights ofthe party ofthe first part in and to said

successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything

AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.

SCHEDULE "A"
ALL THAT CERTAIN PLOT, piece or parcel of land with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, Suffolk County, New York, known and
designated as and by the plots Nos. 168, 169, 170 and 171 on a certain map entitled "Map of Goose Bay
Estates", in the Town of Southold, Suffolk County, New York, said map being made by Lewis N. Waters,
L.S. of Oyster Bay, L.r., New York, dated September 12, 1934 and filed in the Office of the Clerk of the
County of Suffolk on the 13th day of November, 1934 as and by the Map No. 1176 (Abstract #1197) which
lots when taken together are more particularly bounded and described according to said map as follows:
BEGINNING at a point at the corner formed by the intersection of the westerly side of Pine Avenue
and the northerly side of Oak Avenue, and
RUNNING THENCE along the northerly side of Oak Avenue North 86 degrees 08 minutes 30
seconds West 60.0 feet to where the division line between Lots 171 and 172 intersects said northerly side of
Oak Avenue;
THENCE along said division line, North 3 degrees 5 I minutes 30 seconds East 140.0 feet;
THENCE South 86 degrees 08 minutes 30 seconds East 94.17 feet to the westerly side of Pine
A venue;
THENCE along the westerly side of Pine Avenue South 17 degrees 34 minutes 30 seconds West
144.11 feet to the point or place of BEGINNING.
TOGETHER WITH all the right, title and interest of the party of the first part of, in and to that
portion of the road or roads adjacent to said plots above mentioned, to the center line thereof, subject to the
right of other owners of plots on the said Map to pass over and reasonably use the same.
TOGETHER WITH all the right, title and interest of the part of the first part of, in and to that
portion of land lying in front of and adjacent to said plots to the mean high water line of Goose Creek,
subject to the right of other owners of plots on said Map to pass over and use the same.
TOGETHER WITH all the rights, title and interest of the party of the first part, if any, of, in and to
the land lying in the street in front of and adjoining said premises.
TOGETHER WITH the right to use for all reasonable purposes all that portion of land lying in front
of Plots Nos. 53 to 58, Plots Nos. 168 to 195 both inclusive, and Plots Nos. 277 to 310, both inclusive, said
right to be in common with other plot owners on said map, or owners who may hereafter acquire said plots
on said map subject to such reasonable rules and regulations with respect to the use thereof as Oliver Bros.
Building and Construction Corporation may from time to time put into effect, it being understood that
owner or owners of plots facing Goose Creek desire to erect a dock on said land, said owners or owner may
do so providing said dock does not prevent other owners of plots on said map passing over and reasonably
using the land herein referred to, and providing proper legal provisions are complied with, and consent of
Oliver Bros. Building and Construction Corporation is secured.
TOGETHER WITH a right to the use of the streets, avenues or roads shown on said map, said right
to be in common with other plot owners on said map.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by
deed dated July 19, 1989 recorded in the Office of the Clerk of the County of Suffolk on July 27, 1989 in
Liber 10901 page 432.
