FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The applicant's property is improved with a single-family dwelling and consists
of 58,911 'quare feet, identified as '5 and 9' on the Suffolk County Tax Maps, District 1000, Section 118, Block 03. The
land is located in"the R-40 Low-Density Residential Zone District, which requires a minimum lot size of 40,000 square
feet for each lot.
BASIS OF APPLICATION: Zoning Code Article II, Section 100-26, based on the Building Department's October 27,
2005 Notke of Disapproval stating that land identified as County Tax Map Numbers 118-3-5 and 118-3-9 are merged
pursuant to Section 100-25, which provision states:
"Merger. A nonconforming lot shall merge with an adjacent conforming or nonconforming lot which has been
held in common ownership with the first lot at any time after July I, 1983. An adjacent lot is one which abuts
with the parcel for a common course of fifty (50) feet or more in distance. Nonconforming lots shall merge until
the total lot size conforms to the current bulk schedule requirements."
RELIEF REOUESTED: Applicant requests a Waiver to unmerge properties which have been merged into one parcel.
The south<:rly portion, referred to herein as 'CTM 9' is proposed to be separated from the northerly portion, referred to as
'CTM 5.' Combined the land is 58,911 square feet, and to separate CTM 5 from 9 would result in a lot that does not
meet the code-required 40,000 square feet in this R-40 Low-Density Residential Zone District, for the northerly portion
proposed with 21,892 square feet.
ZONING CODE. SECTION 100-26:
Under S 100-26-A, if a lot has merged, the Zoning Board of Appeals may waive the merger and recognize original lot
lines upon public hearing and upon finding that:
(1) The waiver will not result in a significant increase in the density of the neighborhood.
(2) The waiver would recognize a lot that is consistent with the size of lots in that neighborhood.
(3) The waiver will avoid economic hardship.
(4) The natural details and character of the and character of the contours and slopes of the lot will not be significantly
changed or altered in any manner, and there will not be a substantial filling of land affecting nearby environmental or
flood areas.

FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on June 22, 2006, at which time written and oral
evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other
evidence, the Zoning Board finds the following facts to be true and relevant:
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,
the Board makes the following findings:
I. Grant o(waiver to unmer!!e a land area 0(21.892 sa. fi. (502 acre) in the R-40 residential zone (rom the existin!! area
of 53.898 sauare feet. would create a non-conforminf! lot that is not consistent with the size of other lots in the area. The
subject property (CTM 118-3-9) is improved with a single family dwelling located at the terminus of Bayberry Road, a
small private lane that also services several neighbors. The addition of another dwelling and driveway on the proposed
unmerged lot to the north (lot 124/CTM 118-3-5) will have a significant impact on safe vehicular access on this very
narrow, one lane road. While a few other properties in the area are less than 40,000 square feet, those are developed with
a dwelling or are either merged with adjacent land, or would be able to meet the Lot Creation and Lot Exception
provisions of Article II (100-23, 100-24, 100-25 of the Zoning Code).
2. Proof was not submitted to show that a waiver will avoid an economic hardshiv. The property has been in common
ownership with a merged area of 58,911 square feet since prior to the enactment of the minimum lot size requirement of
40,000 square feet in November 1971, and continuously, as shown on the Chain of Title prepared October 17, 2005 by
Stephen F. McMahon, President of Water Mill Abstract Corp. Proof was not submitted to show that a waiver will avoid
economic hardship. The hardship was created by Carl Schultheis Sr. and his executor when he obtained a reverse
mortgage on his property and dwelling for reasons that are unclear, but allegedly related to the maintenance and care of
himself and his son, Carl Schultheis Jr., an adult with a developmental disability. The lawyers involved in that
transaction could have advised Carl Sr. of the merger and could have advised him to sell the separate lot in order to
preserve tlle larger lot improved with his dwelling for purposes of inheritance to family members. The applicant and
grandson, Frank DiPillo Jr., who has Power of Attorney over Carl Sr. 's estate, testified at the Public Hearing on June 22,
2006 that he and his family cannot financially afford to payoff the property taxes that are in arrears in order to prevent the
State from taking the proceeds of the sale of the property. Moreover, he would use the proceeds from the sale of the
unmerged lot to pay off the existing debts and retain the house for family use. However, the owner, Carl Sr., has chosen to
deplete the value of his house and property to finance his living expenses and to care for his son. The applicant indicated
that the property would become more valuable to insure inheritance by family members as two separate building lots if
the lot waiver were granted, but the record does not show that there is an economic hardship for the property to remain
part of the original lot as recognized under Article II with an area of 53,898 square feet with the northerly portion of land.
An economic hardship is not sufficiently established for grant of a waiver of merger by submitting that the properties
would be more valuable in an unmerged state rather than merged. This principle has been upheld by the Supreme Court
and Appellate Division and in this Board's determination on numerous occasions in the past.
3. No evidence was submitted bv aovlicant with refwrd to environmental irnDacts and DOlential effects under Section 100-
26A(4)
The natural details and character of the contours and slopes of the lot will not be significantly changed or altered in any
manner, aUld there will not be a substantial filling of land affecting nearby environmental or flood areas. While the
proposed unmerged lot is flat and no major contouring or fill would be required for new construction, the lot on the
opposite side of Golden Pond Road has a natural pond that frequently overfills and floods during storms, subsequently
flooding the proposed unmerged lot. Neighbors testified at the Public Hearing on June 22, 2006, that should another
dwelling be constructed on that lot, both the new dwelling and those of the neighbors are at serious risk for flood damage.

4. The waiver will result in a sienificant increase in the density of the neiehborhood. To create (unmerge) additional lots
that do not conform to the zoning requirements and that have been merged for a continuous period of time will result in
increased number of dwellings, increased traffic, increased water and sanitary demands, and other related environmental
effects. The Board is not willing to create additional nonconforming lots for future, increased number of dwellings,
increased traffic, increased water and sanitary demands, and other related environmental effects.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New
York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Simon, and duly carried to
RESOLVED, to DENY the requested Lot Waiver to unmerge CTM 1000-118-3-9 from 1000-118-3-5.
VOTE OF THE BOARD: A YES: Members OIlva (Chairwoman), Goehringer, Dinizio, and Simon. (Member Weisman

REASONS:
(1) The waiver will not result in a significant increase in the density of the neighborhood
because:
The house is already on a double sized conforming lot. The adjacent 21,892 sflot is one of the
last remaining undeveloped vacant lots in the original subdivision.
(2) The waiver would recognize a lot that is consistent with the size oflots in that neighborhood
because:
The subdivision consists of predominantly 1/2 acre lots.
Some O1'mers intentionally merged the lots until the combined lots became one acre in size. In
the subject application, two lots were combined to place the existing house on one acre,
however, the vacant lot was retained as a separate lot. These properties have remained in the
family since the 40's.
The lots received separate tax bills and were purchased at different times: The house parcel on
one acre was purchased by Elsie Auerbacher in 1944, then the lot was later purchased by
Josephine Auerbacher in 1964. The lots remained single and separate until the waiver of merger
law was adopted in 1997
(The will of Josephine Auerbacher bequeathed the property to Elsie Auerbacher in 1989)
(3) The waiver will avoid economic hardship because:

Carl H. Schultheis Jr. is a menatally handicapped individual (Born with disability)living in a (1P
group home for mentally handicap adults.
Carl H. Schultheis Sr. is entering a Veteran's Nursing Home in New Jersey, on July 2004 had
placed a $220,000 reverse mortgage on the house parcel which accrues high monthly interest (to
date $250,000 owed). The power of attorney & successor trustee- Frank DiPillo (son) is faced
with mounting debt and the State taking the proceeds of the sale.
If the 101: is sold the proceeds payoff the reverse mortgage and the house can be saved. If the lot
can not be sold separately then the only alternative to the family which has owned these
propertil~s since the 40's is to sell the lot and house as one parcel in order to satisfy the debt.
(4) The natural details and character of the contours and slopes ofthe lot will not be significantly
changed or altered in any manner, and there will not be a substantial filling ofland affecting
nearby e:nvironmental or flood areas because:
Nassau Point has natural slopes, the existing house does not cause flooding. On the opposite
side of the road (accross Golden Pond Road) is a natural pond. The lot has sufficient depth to
provide ample setbacks. The driveway can be improved so that it falls solely on the house lot, or
could bf: developed as a shared driveway.

As confirmed at the time of submission of the above documentation, the
application requesting a Lot Waiver is complete and has been processed for a public
hearing to be noticed for June 22, 2006.
The second submission, however, requesting an area variance is not complete for
processing and is returned in the enclosed envelope, in order that a complete re-
submission may be filed with the following in an original' and six sets for processing:
a) application to the Building Department for a Notice of Disapproval regarding
different relief;
b) application requesting variances and referring to the Sections of the Zoning
Code applicable to the new relief to be sought, and noted in the Notice of
Disapproval,
c) confirmation as to whether or not the Building Inspector will require approval
under the subdivision regulations by the Town Planning Board; and if
required, the date an application has been delivered under the review process
of the subdivision regulations (Planning Board presubmission review with
applicant).

years. Since June of 1990 I was an Associate Broker with Celie Realty in Mattituck and
am now an Associate Broker with Prudential Douglas Elliman Real Estate in Mattituck. I
hold a Brokers license #30UH0746367 and as such have acted in many sales and
purchases of Real property in the Township of South old and I am well acquainted with
Real Estate in this area.
On March 16, 2006 I was requested by Patricia Moore, Esq. with offices located at 51020
Main Road, Southold, NY to offer a letter of opinion of value of certain properties owned
by Carl Schultheis, located at 1305 & 1285 Bayberry Road, Cutchogue, Township of
Southold, County of Suffolk, State of~ew York
The property located at 1285 Bayberry consists of a 3 br, 1.5 ba, ranch 2-car garage and
basement; it is sited on a .94 acre of wooded property. The property located at 1305
Bayberry is a vacant wooded building lot .50 ofan acre in size.
In my educated opinion that the overall market value of the two parcels being sold as one
would be: $ 695,000.00.
If the properties were to be sold single and separately than I am of the opinion that the
house located at 1285 Bayberry would have a market value of: $595,000.00.
The vacant land located at 1305 Bayberry Rd, would have a value of: $450,000.00
The above value estimates are based upon comparable sales data obtained at the office of
the Suffolk County Clerk, Suffolk County Center Riverhead, NY 11901 and duly recorded
between March 18,2006 and within one year prior to that date.
