PROPERTY FACTS/DESCRIPTION: The applicants property contains 24,075 square feet and has frontage along two roadways, 230.80 feet along Cedar Drive and 250 feet along Miller Road (a/k/a Bungalow Lane). The premises is improved with a single-story dwelling and accessory garage, as shown on the august 25, 1994 survey prepared by Rampart surveying, P.C. BASIS OF APPLICATION: Zoning Code Section 100-242A (referring to Interpretation under Walz Appeal No. 5039) and 100-244, based on the Building Inspector's My 22, 2006 Notice of Disapproval, amended June 6, 2006 concerning an addition to the existing dwelling which will constitute an increase in the degree of nonconformance at less than 40 feet from the front yard lot line and for a swimming pool location in a yard other than the code-required rear yard, at 800 Cedar Drive (and Miller's Road), Mattituck; CTM 106-10-23. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 27, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct an addition with covered porch at 25' fro the front line adjacent to Cedar Drive and an addition at 31 feet from Cedar Drive, a deck addition at 33'8" from the front property line adjacent to a private dirt road (Miller Road, and an accessory 16' x 32' swimming pool 25'7" from the front lot line and 31'5" from southerly property line, all as shown on the 2-27-06 plot plan and construction diagrams prepared by Penny Lumber. Rabkevich CTM No. 106-10-23 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: (1) An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties if granted. The property fronts along a private dirt road. The setbacks for the addition will be similar to setbacks on other properties in the immediate area. The location of the pool gives the appearance of a back yard, due to the shape of the property which is not square and has two front yards and only one side yard. (2) The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance, because the property is more of a V shape than the commonly found square or rectangular parcels in most areas, with greater length of the north and east property lines. The shape of the parcel creates difficulty to place any additional construction to the existing house. (3) The amount of relief requested is not substantial. (4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. (5) The alleged difficulty has not been self-created because the odd shape if this property would require some degree relief from the code requirements. (6) Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and a swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member' Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the 2-27-2006 plot plan and construction diagrams prepared by Penny Lumber. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
