[':',)V L "-'"- j (1~Q~ Sl>uf!lC\/d TowiI (l~r' FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF NOVEMBER 9, 2006 ZB File No. 5959 - WALTER and KRISTIN PRESTON Property Location: 1750 Reydon Drive (and Private Drive), South old CTM 80-2-18.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicants' +/-25,200 sq. ft. lot is 180.65 feet along Reydon Drive and 136 feet along the westerly side. The parcel is improved with a single-family dwelling, shown on the October 11,2001 survey prepared by William R. Simmons III. BASIS OF APPLICATION: Zoning Code Section 100-33 (280-15), to locate two accessory structures (swimming pool and garage) in a yard other than the code-required rear yard, based on the application for a building permit and the Building Inspector's August 8, 2006 Notice of Disapproval. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 26, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 24x32 ft. two-car garage with 12x13 ft. cabana in the northwesterly front yard and a 20x40 ft. swimming pool also located mainly in a front yard. ALTERNATIVE RELIEF REQUESTED: During the October 26, 2006 public hearing, the applicant was requested to consider an alternative placing the garage at a greater distance from the westerly front lot line, and locating the pool closer to the proposed cabana/garage structure. Following the first hearing, the applicant submitted an amended plan locating the garage at 15 feet from the front lot line adjacent to the private ri(lht-of-way, and locating the pool at a minimum of 51 '2" from the southerly front line along Reydon Drive. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because there are other accessory garages located along the applicant owner's shared Private Drive which creates a de facto front yard precedent for the location of accessory garages along this access road. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, because the subject property fronts on both Reydon Drive to the East and a Private Drive to the West, creating two front yards and effectively no code-required rear yard in which to locate three proposed accessory structures: an 800 sq. ft. in-ground swimming pool and attached 156 sq. ft. one-story cabana with a proposed side yard set-back of 12' from the property line to the north, and 768 sq. ft. two-car garage with a proposed side yard setback of 10' from the northerly boundary and a front yard setback of 10' from the Private Drive. 3. The variance granted herein is substantial. Applicant owner wishes to locate an accessory garage in a front yard with a front yard setback of 10 feet from a Private Drive which is used by several neighbors as the primary access road to their properties, and the proposed setback for the in-ground swimming pool is 48'.5" from Reydon Drive, which places it partly in the owner/applicant's side yard. 4. The alleged difficulty has not been self-created but rather is created by the location of the subject property on two roads, creating an "architectural" front yard along Reydon Drive and a secondary front yard in the "architectural rear yard" of the dwelling. While it is possible to locate the proposed accessory structures on the southern part of the property or directly to the east of the existing dwelling, to do so would limit the possibilities of future expansion of the existing one-story dwelling which is modest in size at 836.44 square feet on the owners/applicants' 24,591 sq. ft. lot 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory two car garage with cabana and in-ground swimming pool, while preserving and proteGting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Goehringer, and duly carrie,d, to DENY the relief requested as applied for, and to GRANT alternative relief as per site plan dated 7/28/06, revised 10/26/06 drawn by John Rabkevich of P,mny Lumber, and floor layout date-stamped September 1, 2006, summarized and with the following conditions: 1. The proposed in-ground swimming pool is to be located a minimum of 15 feet from the northerly boundary of the property and with a front yard setback of 51 "2" from Reydon Drive. Drainage of pool water must be accomplished by the inclusion of on-site cisterns. Pool equipment must be contained in a sound-absorbent environment (the proposed garage or mechanical cabinet). Evergreen screening mlJst be planted along the northerly boundary to create privacy between the proposed pool and the neighbor's property and be continuously maintained by the applicants. 2. The proposed cabana shall be attached to the proposed accessory garage with a minimum side yard setback of 12' feet from the northerly boundary. The cabana may not include heat or an indoor shower. 3. The proposed accessory garage shall maintain a minimum 15' front yard setback from the Private Drive and a minimum 10' northerly side yard setback. 4. The swimming pool shall remain open to the sky, and not be roofed or enclosed. 6. These ZBA conditions shall be written into the Building Inspector's Certificate of Occupancy, when issued. 7. TI1e ZBA reserves the right to inspect at any time prior to issuance of a Certificate of Occupancy. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
