SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in
this application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTSIDESCRIPTION: The applicants' 30,824 sq. ft. parcel has 100.44 feet along Nassau
Point Road in Cutchogue, and is improved with a two-story frame house, accessory building, shed and
swimming pool, as shown on the site plan prepared by Mark K. Schwartz, A.LA. dated 4/19/2006.
BASIS OF APPLICATION: Section IOO-242A (referring to ZBA Interpretation No. 5039 dated 1/24/02) and
100-244, based on the Building Inspector's April 24, 2006 Notice of Disapproval concerning proposed
additions and alterations to the existing dwelling, which constitutes an increase in the degree of
nonconformance when located less than 15 feet from a single side yard and less than 35 feet for both side
yards combined.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on June 22, 2006, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the
property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REOUESTED: The second-floor roof of the applicants' existing dwelling is
proposed to be removed and reconstructed, and the first floor and basement will remain. Also proposed is an
extension of the existing one-story porch on the north side of the dwelling with kitchenlbreakfast nook
proposed at a minimum of 14 feet from the northerly side property line. The total side yards are proposed at
34 feet.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
I. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. Placement of the proposed new construction in the front and side yards will

have no visual impact on adjacent properties and is in keeping with the style and scale of dwellings in the
neighborhood.
2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to
pursue, other than an area variance. The lot is only 100 feet wide and has existing side yard setbacks of 14'
and 20' for a total of34' instead ofthe code required 35'.
3. The variance granted herein is not substantial. Applicants are requesting a one foot variance for a side yard
in order to maintain the existing 14' setback of the as-built heated porch and foundation, which will be
enlarged as part of the living room of the house. All other proposed construction Ca two story addition in the
front yard, and a second floor renovation with new roof pitch to obtain code complaint ceiling heights) are
conforming.
4. The alleged difficulty has not been seU:created. The house was built prior to the code requirements for a 35
ft. total side yard, 15 ft. minimum and 20 ft. remaining side yard.
5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on
physical or environmental conditions in the neighborhood. All proposed construction is within existing
setbacks to bulkhead and do not require variances.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of an enlarged dwelling while preserving and protecting the character of the neighborhood
and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test
under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member
Goehringer, and duly carried, to
GRANT the variance as applied for, subject to the following condition: That there shall be an open,
unobstructed clearance along the existing southerly side yard of the house for a width of 20 feet.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's
diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning
code. This action does not authorize or condone any current or future use, setback or other feature of the subject property
that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this
action.

Part A: AREA VARIANCE REASONS (attach extra sheet as needed):
(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties if granted, because:
Proposed renovations to existing house include enlarging existing heated I story porch which
will be part of living space of house. The existing structure is at 14 feet from the side property
line, 15 feet is required.
All within existing setbacks to bulkhead therefore not requiring variances: the existing
renovation includes two story addition in front (conforming) and second floor renovation which
includes a new roof pitch to obtain code compliant ceiling heights (conforming)
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue, other than an area variance, because:
The setbacks are being maintained. The porch has a foundation and heat- will be incorporated
into living space to make use of the existing structure. The existing structure and addition to the
existing structure will remain I story in height. Very minor variance request- project is primarily
renovations of existing structures.
(3) The amount of relief requested is not substantial because: one foot variance due to change in
code required setbacks after original structure was constructed. The width of the lot is only 100
feet and 10' and IS' side yard setbacks were required when Nassau Point was developed.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district because:

e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy,
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
