Meeting Hall, 53095 Main Road, Southold, NY. Supervisor Russell opened the meeting at 7:00
PM with the Pledge of Allegiance to the Flag.

SUPERVISOR RUSSELL: Please rise and join with me in the Pledge of Allegiance to the Flag.
Would anybody like to come up and address the issues on the agenda? Mrs. Egan.
JOAN EGAN: Good evening, everybody. Joan Egan. I am working off the one from this
morning, so I hope you will bear with, alright? I didn't have time to review this. Item 840.
SUPERVISOR RUSSELL: Yes?
MS. EGAN: That is a day trip?
SUPERVISOR RUSSELL: Those are daytrips to Jamesport.
MS. EGAN: Uh huh.
SUPERVISOR RUSSELL: And they are required, actually. PSD's, public safety dispatchers
are required to take on going training with regards to emergency management etc.
MS. EGAN: And you do feel that it is necessary?
SUPERVISOR RUSSELL: To send them to Jamesport? Absolutely.
MS. EGAN: I don't understand 841.
SUPERVISOR RUSSELL: That was actually, we had received money to the tune of $100,000
for a road related improvements. That is what they call the New York state multi-modal grant,
along with $80,000 we had in house, as part of a committed fund to do some capital, I am sorry,
for some drainage projects particularly up at Westphalia in Mattituck for storm-water mitigation
to keep it from going into the creeks and the bays.
MS. EGAN: Oh, good. Okay.

SUPERVISOR RUSSELL: And that is just an in-house accounting procedure.
MS. EGAN: And 842 is part of that also, correct?
SUPERVISOR RUSSELL: Yes, that is.
MS. EGAN: Good. 843, I don't think that that is a necessary trip. I really don't. You all will
be going away in January, this can be done by telephone or computer. That is how I feel.
SUPERVISOR RUSSELL: Just as a point of clarification, that actually in Melville and I find
that people only go to Melville when they have to, so I would imagine she has some continuing
education requirements.
MS. EGAN: Well, I think she has enough to do here, especially in regard to that phone meeting
that was done last week which I still feel deep down was illegal and wrong and cruel. Oh, the
844, C & S Engineers. Where are they from?
JUSTICE EVANS: C & S is from Connecticut. It is for the airport on Fishers Island.
SUPERVISOR RUSSELL: It is a firm from Connecticut and that is for lighting at the Fishers
Island airport. And that, I believe, is paid for by the F ederal Aviation Administration.
MS. EGAN: So we are better off to use somebody from Connecticut rather than locally here?
JUSTICE EVANS: Well, they are closer. Transportation costs...
MS. EGAN: Speak up.
SUPERVISOR RUSSELL: The problem is that when you try to use a firm from Long Island, it
really exacerbates the costs because of the transportation of materials etc to come from this side
as opposed to the three minute trip from the Connecticut shoreline.
MS. EGAN: Good.
SUPERVISOR RUSSELL: Trying to save the taxpayers money.
MS. EGAN: Now the audit on 847, where are they located?
SUPERVISOR RUSSELL: I am sorry?
MS. EGAN: 847.
SUPERVISOR RUSSELL: That is the firm that does the audit, that is the independent auditor
that does the audit ofthe Town's records.
MS. EGAN: And where are they from?

SUPERVISOR RUSSELL: I believe they are located in Melville.
MS. EGAN: You don't have a firm out here that can do it?
SUPERVISOR RUSSELL: Well, the idea is to go farther a field to get an independent auditing
firm that has no connection to a Town fiscal officer or any member or significant individual from
the Town.
MS. EGAN: Good point. Oh, now on item 851 in regard to police and there are quite a few
things in regard to police here, did you ever find out about that inoculation?
SUPERVISOR RUSSELL: I thought you did and told me about it. That is how I found out,
from you.
MS. EGAN: I never was really positive that I did get the correct answer. I think I spoke with
one of the secretary's up there and she did say that, it still never was clear in my head that that
$3,300 should have been put from inoculations to the on line for the tires or something. Well, I
don't know.
SUPERVISOR RUSSELL: Yeah, I believe you raised a good issue of whether shouldn't the
insurance company be paying for that, since we are insured.
MS. EGAN: Yeah. I am not sure either. Now, the item 853, we sure are spending an awful lot
of money which I think Mr. Carlin brought up at the last meeting, you know, for the Laurel Lake
and the park and still nothing positive done for the senior, for the recreation center here. But that
is further down the line. Now I see Mr. Reisenberg and I am not going to attempt, I will attempt,
Tomaszewski; yeah, I think they are going away for a couple of things and again, I don't know
that these trips are necessary. Doesn't strike the people outside as good.
SUPERVISOR RUSSELL: Just as a clarification, those are day trips. They are not staying
overnight. They are day trips. They will be, the town will be picking up the cost of their lunch
but.. ..
MS. EGAN: Oh, I know we pick up the cost...
SUPERVISOR RUSSELL: Of their lunch but there IS no junket here, it IS a day trip.
Particularly when you have to go to Hauppauge.
MS. EGAN: Now, we, on item 858; we are retiring a dispatcher. Are we replacing that
dispatcher?
SUPERVISOR RUSSELL: We already have.
MS. EGAN: Wonderful.

SUPERVISOR RUSSELL: And that is going to be a big lose to the Town. I will talk about that
later, to lose a guy like Claude.
MS. EGAN: I believe I read in the paper that the budget modification was changed for the
police department. And I think that was a very, very foolish thing to do. You have enlarged the
town in many areas; is your head falling off, Mr. Ross? And you need more police and you need
them behind you. Shouldn't be against them. And that is shame on all of you who did that. And
I believe you will regret it in many different ways. I didn't see anything on this agenda for the
highway department. Is there anything on the new, the one that you did today? Later?
SUPERVISOR RUSSELL: I don't think that we did any highway business today. I don't think
we had any specific agenda item regarding highway business today. Obviously we have a
budget to hear later and he is a big component of that budget but, I don't think there is any
specific item, any housekeeping or anything of any kind for the highway department today.
MS. EGAN: And we are still spending on item 863 a tremendous amount on the dump. And I
understand, I see that Mr. Bunchuk, yeah, 864, that he is traveling to Syracuse for two days. He
treats himself pretty well for his trips and I don't think that's necessary.
SUPERVISOR RUSSELL: Have you ever been to Syracuse in November? I have, when I
wrestled in college.
MS. EGAN: I have also, football games. Well, okay on that. Item 865, I think we need more
police men. Money well spent there. And I guess that would take an act of Congress to change
the thing for the program for the aging. You know how I feel about that. What is the enhanced,
872, the enhanced 91 I program?
SUPERVISOR RUSSELL: That is an integrated emergency 911 system. It is integrated in that
it is actually a county program that the town is participating in and that is the enhanced 911
computer based, emergency services. GIS based emergency calls.
MS. EGAN: Good. Incidentally, not all the phones are working properly at the police station.
You said you thought they had gotten up to the 60's, I said maybe the 80's. And 873?
SUPERVISOR RUSSELL: The emergency inter-municipal agreement?
MS. EGAN: Yeah.
SUPERVISOR RUSSELL: Actually, the county of Suffolk is providing some items of need to
Southold Town, such as a generator for Fishers Island for its emergency shelter there. They
require an inter-municipal agreement because they said, we will give you the generator but we
want to make sure it is being maintained. So that is all part and parcel to several joint efforts
between myself and this Board and the county on emergency management.

MS. EGAN: Now, on item 876, those bid acceptances for cars from the police department, we
didn't send one over to one ofthe schools, I guess. Huh?
SUPERVISOR RUSSELL: They didn't express any interest.
MS. EGAN: Did you try?
SUPERVISOR RUSSELL: I did not. I believe that we had someone reaching out and calling.
MS. EGAN: Oh, okay. Thank you.
SUPERVISOR RUSSELL: Would anybody else like to comment on any item? (No response)

price is $5,000.00 (five thousand dollars). The property will be acquired using Community
Preservation Funds. The seller may claim a bargain sale.
The property is listed on the Community Preservation Plan Project list of properties that should
be preserved due to significant wetlands and natural wooded areas. The purchase of the
acquisition is for the preservation of open space. The property is adjacent to land currently
owned by the Town of Southold. The purpose of the acquisition is to allow the property to
remain in its undisturbed present state.
As per Chapter 117 (Transfer of Development Rights) of the Code of the Town of South old,
Section 117-5, the Land Preservation Coordinator and the Town Board have reviewed the
acquisition and have determined that sanitary flow credits will not be transferred from this
property.

WHEREAS, the Board of Commissioners of the Fishers Island Ferry District (the
"Board" and the "Ferry District", respectively), in the Town of Southold (the "Town"), Suffolk
County, New York, pursuant to the resolution adopted and subscribed by each ofthe members of
the Board as of October 24, 2006 and, together with the petition in due form, duly submitted to
the Town Board (the "Town Board") of the Town (certified copies of such resolution and
petition are attached hereto and made a part hereof), has requested the Town Board to call a
public hearing to hear all persons interested in the subject thereof, being the increase in the
maximum cost of the construction of the new and expanded ferry terminal on the land heretofore
acquired and now owned by the District, being the site of the former ferry terminal in the City of
New London, Connecticut, including bulkheading, placement of fill, construction of a new
ticketing and administration building, installation of utilities, concrete vaults for two
underground storage tanks for fuel and waste oil, a perimeter drainage system, parking areas for
vehicles, a wider easement for ingress and egress and the necessary facilities and appurtenances
thereto, the resulting terminal area, including said building to be approximately double the size
of the existing terminal all as more fully described in the "Preliminary Engineering Report",
dated May 31, 2001, prepared by Docko, Inc., licensed engineers, and the addendum thereto
dated September 19, 2003 prepared by the District, showing the revised costs, on file in the
office of the District and the office ofthe Town Clerk of the Town, and the Resolution and Order
After Public Hearing adopted by the Town Board on October 7, 2003, as well as the original
furnishings, equipment, machinery and apparatus required for the purposes therefor (herein
called the "Project"), the estimated maximum cost thereof having been increased from
$10,500,000 to $11,025,000, to be paid from grants expected to be received from the United
States and/or the State of New York and funds from such other sources as may be available,
including current funds of the District. No additional indebtedness shall be incurred therefor;
and
WHEREAS, the Town Board has complied with all procedures requisite to
ensuring that the Project will have no significant adverse impact upon the environment and
permits for construction of the Project have been applied for and obtained from all known

necessary agencies, including the Connecticut Department of Environmental Protection, the U.S.
Army Corps. of Engineers and said City of New London and copies of such permits are available
for inspection in the office of the Secretary of said Board of Commissioners, and in the office of
the Town Clerk ofthe Town; and
WHEREAS, the Town Board in the role of Lead Agency, has undertaken the
requisite proceedings pursuant to the New York State Environmental Quality Review Act
("SEQRA") and has determined that the Project is an Unlisted Action thereunder having no
significant adverse impact upon the environment and, further, has issued a Negative Declaration
and filed same with the Town Clerk.
NOW THEREFORE, IT IS
ORDERED, that a public hearing be held by the Town Board on the 21st day of
November, 2006, at 5:15 o'clock P.M. (Prevailing Time), at the Southold Town Hall, 53095
Main Road, in the Town of Southold, to consider the proposed increase in the estimated
maximum cost of the Project from the revised estimated maximum cost of $10,500,000 to the
new revised estimated maximum cost of $11 ,025,000, as hereinabove referred to; said increase in
the estimated maximum cost is expected to be financed by grants from the United States and the
Sate of New York and such other sources as may be available therefor, including current funds
of the District. No obligations of the Town will be issued; and it is
FURTHER ORDERED that all persons desiring to be heard concerning the
subject matter of the above referenced public hearing will be given an opportunity to be heard at
the time and place aforesaid; and, it is
FURTHER ORDERED that the Town Clerk shall cause a copy of the Notice of
Public Hearing in substantially the form prescribed in Exhibit "A" attached hereto and made a
part hereof, (i) to be published once in "THE SUFFOLK TIMES", a newspaper published in
Mattituck, having a general circulation within the Town of Southold, (ii) to be posted the sign
board of the Town and in five conspicuous public places within the District, and, (iii) to be
mailed by first class mail to each owner of real property in the District subject to the assessment,
levy and collection of amounts to pay any portion of such increase in the estimated maximum
cost, including payment of amounts equal to the principal of and interest on obligations

PETE HARRIS: Pete Harris, Greenport. I would just like to say a few words pertaining to the
reading in tonight's agenda about Claude Kumjian. I really don't have enough time to stand here
and tell you what this town is losing. I have never seen a person that is so professional and loves
his job and has put his life and soul into serving the citizens of Southold Town. I have had the
opportunity to be in the command center at headquarters when the stuff has hit the fan and I have
seen other people, the sweat start running down their brow and I, Claude Kumjian never even
flinched. He just went about his job in a professional manner, as a, you know, safety dispatcher
for this Town. It is just, it is a great day for Claude Kumjian but it is a sad day for Southold
Town. Because I only wish that everyone who worked for this town had that energy and zeal
and loved his job the way that Claude Kumjian has. And he is sorely going to be missed.

SUPERVISOR RUSSELL: I want to second what Pete said. I have to tell you, I found out, I
have known Claude for a lot of years but being an Assessor, you don't really have a fundamental
understanding of how an important role someone plays in this town until I became Supervisor
five PSD's short and realized how critical and dedicated Claude was to this community and in
fact, was down at police headquarters sometimes on his own time helping maybe, you know, one
of the newer dispatchers because of the work load and the demands that we were putting on them
until we were able to resolve some of those contract issues. So, I couldn't agree with you more.

BOB GHOSIO: I just wanted to tell the Town Board that I am very pleased in that having been
selected to be the new Trustee. I appreciate the fact that you folks appointed me right away,
since there was a vacancy and I just want to let you know I look forward to following in Mr.
Krupski's footsteps and doing a fine job.
SUPERVISOR RUSSELL: He is a pain and a prat to work with, don't be so quick to follow in
his footsteps.

John Holzapfel was there and stepped aside. And it is a mark of how John operated and it is an

opportunity for you and for the Trustees. John had a style of operation that was completely non-
political and was professional and he did a wonderful job for the Trustees over many years. The
Trustees, in my experience, function best as a completely non-political body, concentrating on
environmental issues, on the applications and all the paperwork that they have to deal with. I
hope you can follow that tradition. I think it is important and I, at least, am going to be looking
for steps that the Trustees take in their appointments, in the other actions that they take to
demonstrate the non-political nature of that office which has served this Town so well for many
years. I am really glad that you are there, I think you will do a wonderful job at it.
MR. GHOSIO: Thank you very much. I think that if you look back at the history that I had with
the CAC and if you look at the campaign that I ran, I think you will find that I will keep it as
apolitical as possible. I don't believe that it should be a political position either and my whole
motivation for wanting to do this was to serve just like I did with the CAC except maybe get
more involved in the inner workings of the Trustees office. My intentions are good and I thank
you for your kind words.
SUPERVISOR RUSSELL: I would suggest that every position in Town government should be
non-political and if you really cared about this Town, you wouldn't put your own interests or
your political interests ahead of the rest of the community's. Would anybody else like to
comment on any issue? Dave?
DAVE BERGEN: Dave Bergen, Cutchogue. This time in my role as Trustee and I want to
thank Mr. Wickham very much for his comments, I agree 100 percent and I am sure knowing
Bob that we will continue, as we have been completely apolitical with our decisions this year, we
will continue to be apolitical because that is something that we feel very strongly about. We
have done that this past year and we will continue to do so. And thank you very much in your
decision to appoint Bob tonight, he is going to be a great addition to the team, so thank you for
your support.
SUPERVISOR RUSSELL: I will second what Tom said about John Holzapfel, too. John
Holzapfel actually made this possible to get an early start for you, Bob, because John was the
Trustee until the certification of the result which wouldn't be for another week or so. So John,
recognizing the need to get the new candidate, whoever won, up and running was gracious
enough to step aside. He was gracious enough to step up when we needed him. I can't say

Finally, I have a notification that it has been, this budget has been posted on the Town Clerk's
bulletin board outside and it has also has appeared as a legal in the local newspaper.
SUPERVISOR RUSSELL: Okay, with that being said, would anybody like to come before the
Town Board and address any issue regarding the budget as proposed? (No response) I hear
none. We actually, there might be some miscommunication, the official Town Board meeting is
at 7:00 tonight and this is a budget hearing, specifically for the budget but I think what I would
like to do is maybe hold this meeting open if I can get a motion and while we are here, give these
people an opportunity to address the issue they want to address.
JUSTICE EVANS: I don't know if you can do that.
TOWN CLERK NEVILLE: I don't think so. This is only a public hearing, it is not the meeting
though, Scott.
7:30 continuation of public hearing
SUPERVISOR RUSSELL: Would anybody like to come up before the Town Board and address
the issue of the budget? The proposed preliminary budget? Tom Skabry.
TOM SKABRY: Tom Skabry, President, CSEA Town of Southold. I see there was quite a bit
of hurdles jumped over the last couple of weeks regarding this funding for the Highway
Department. I just wish to take this time to bring the Town Board members up to speed. Over
the summer, three-quarters of the summer we had an employee of the Highway Department was
operating one of four CASE International side mowers, this individual was hit by a piece of
flying debris, it hit him in the face. Narrowly missed his eye by a couple of inches. Irregardless
if he was or was not wearing safety glasses. A couple of inches lower could have hit him in the
artery, in the neck, could have bled to death. There was no radio communications with him.
This individual actually drove back to his pickup truck that he used to go out to get his tractor
and actually bumped into another highway employee. This is a serious issue as far as the CSEA
is concerned. I did make a report of my findings, I am going to send it to the Superintendent of
Highways attention and the Supervisor. Basically it was an agreement, we have four mowers
that are of the age of 1982 to 1985. The safety equipment that was attached to these mowers at
the time was adequate at the time. I can tell you they are not adequate right now. Speak with the
Supervisor and Pete Harris, they both have agreed to regain the practice of replacing these
mowers over a period of time which for some reason the practice had stopped and that is the
reason we are dealing with mowers that are 25 years old. Originally we would like to have four,
obviously that is a major tax burden to the taxpayers, so we were thinking that it would be nice if
we could have two mowers replaced right now, for a couple of reasons. I am sure Pete is going

to come up here after I am and explain to you that we have two mowers that are basically
inoperable and they need some substantial amount of money dumped into them just to get them
operating again, still not alleviating the hazards to the operator and the public. Let's see, going
back down, like I said, a report was filed to both the Supervisor and the Superintendent of
Highways. There was a bunch of safety standards, a lot of problems. Inadequate training on the
equipment, improper guards. The guards are not up to today's standards and as technology
advances, the equipment that is out there right now actually will afford the worker more
protections, it will protect the public that much better i.e. there are even better shields on the
newer equipments, there are more lighting signals, waming signals for oncoming traffic as these
mowers are used on sides of roads including Sound Avenue. There is multiple reasons of why
we need to upgrade our equipment. One suggestion we suggested also if you consider it, was
getting new mowers with enclosed cabs. This will do a couple of things. The mowers that we
currently have, during the hot, dry summer months, I can tell you from my personal experience,
driving down Cox's Lane in Cutchogue and it looks like there are farm fires out there. That is
how much dust is out there. The enclosed cabs will have air filtration systems, to protect the
employee and the Town, well, the employee from suffering work related injuries and the Town
having to pay increased medical costs. So it will be a savings that way. Potential savings, I
should say. It will give some minimal protections towards hearing problems, protection from the
heat and most enclosed cabs, obviously, will probably have some form of environmental control
on it. And cover the traffic signals. I can tell you from my personal experiences on these
mowers, not only did I actually get hit in the hearing protection I was using at the time but it
happens that it was thrown by the machinery, not too long after this situation on a different piece
of machinery a little bit larger, the new John Deere you have probably seen on the sides of the
road but on the case mowers themselves, there is no protection from the hydraulic lines if they
break. The operator is completely surrounded by hydraulic lines. I did have one that broke on
me. It did cover me with hydraulic oils. Fortunately, I was not injured. I believe two summers
ago we also had another operator who sustained the same type of exposure to hydraulic oils as
that hydraulic, the hydraulic line on his side mower attachment also broke. This is the major
situation, for whatever reason, the Town has fallen back on the schedule of replacement of these
mowers. They do have a lifespan, from what I understand, between five and ten years. An
effective lifespan, before you have to start dumping money into them to keep them running. I
just hope the Town would, you the Town Board, would consider re-appropriating some funds
into the budget to purchase two mowers, possibly two mowers next year or one and one. We
need to get the ball going. It is a matter of catch-up. One of the ideas that I had circulating out
there was possibly maybe buying two mowers. In order to reduce the tax burden for this fiscal
year, possibly putting it into a capital project. Span it over a couple of years, as these mowers do
have a lifespan of maybe 10. Obviously we have proved that we can stretch them out to 25
years, it will reduce the tax burden on the current budget. That is one idea I have. But I can't
implore how much it means both to me as an operator and also as a representative of the workers
and also looking out for the best interests of the Town itself, as far as having to deal with safety
and health complaints that might have to be filed, we don't want to go that route. We are taking
them the nicer route of waiting a couple of months, waiting for the budget to come through
which we thought was already a done deal and start a schedule of replacing these mowers that
desperately need to be replaced. That is all I have on that one. Does anybody have any

COUNCILMAN KRUPSKI: Where do you, these mowers, where do they come from and do
they come equipped and ready to work or do they have to be, does the mower have to be attached
to the tractor when the Town gets it? How does that work?
MR. SKABRY: I can tell you I have personally witnessed, over the summer time, there was one
case mower where the mower attachment was so shot that they bought it from, I guess Case
International, where they just basically replaced the mower attachment to the tractor itself.
SUPERVISOR RUSSELL: Pete is the administrator there, so we will have Pete address those
types of issues and where the bidding comes from etc. I am assuming we are buying off a state
bid. But I guess because you are the CSEA president, I am just going to ask if we could maybe
narrow the questions to Tom that we have on employee issues, so that Pete can get up and
address the larger issues, the administrative issues.
MR. SKABRY: Okay, thank you.
SUPERVISOR RUSSELL: Thanks, Tom.
PETER HARRIS, HIGHWAY SUPERINTENDENT: Good evening, ladies and gentlemen.
Peter Harris, Greenport. Superintendent of Highways. I would like to address Albert's question.
Upon the, receiving the, when we purchased, Albert, the machine is fully intact, ready to go from
day one, from the time it rolls into the yard it is ready to go. It is a specifically mounted unit that
is built right onto the machine. Other than using the tractor for mowing purposes, we, in the fall
and during the summer season when we also put a tremendous amounts of snow fence up for
many different organizations throughout the Town of Southold, we also utilize these tractors for
it with these hydraulic snow fence pounders that get mounted on the back on a three point hitch.
As Tom stated, two of these tractors were bought back in 1982 and we did have one of the units
this year, the actual mowing unit actually snapped right off from fatigue, from old age; right off
the machine on the side of the road. But moreover than that, it is a case of the fact that the model
of the tractor that we are dealing with, we only have one supplier where we have been able to
find parts. And we have had so many numerous mechanical problems with them, we call in for
parts, the parts come, they are the wrong parts. You have a manual, looking at part numbers
right there, you call them up, you give them the part, okay, they say they got it right now, they
send it and it is still the wrong part. Case International tractors, those particular model tractors,
they are obsolete. They are old, they are tired. I have two of them right now that they are out of
commission, and the reason why I didn't authorize any money to be spent on them because I was
anticipating being able to replace them because it is just like throwing good money after bad. It
is just like when your police vehicles, they have a certain useful lifespan and then we get rid of
them. Well, it is no different from a police officer being safe out in his car doing his job than it
is for people from the highway department being out on the side of the road servicing the
residents of this town and they should also be afforded the same safety with equipment. I can't
reiterate the fact that, you know, I know when you people sit up on that dais and you take your
job seriously just like I take my job seriously and you try to keep the spending costs down for the
town taxpayers, I am not asking for one million dollars, I am not asking for half million dollars; I

am just asking for enough funding to be found, whether we can do it within the budget, whether
we take these two tractors out and add them into a capital bond along with other equipment that
we plan on purchasing but the time is now, it is not tomorrow, it is not next year and you know,
all's I am looking at is to update our equipment, to make is safe for the people that are servicing
this township and other than that, I am here to answer anybody's questions.
SUPERVISOR RUSSELL: Does anybody have any questions for Pete? (No response)
SUPERINTENDENT HARRIS: One last thing that I would like to say and I understand you
know, in last week's paper, the article pertaining about budgets and this and that and it was
brought to my attention yesterday, there was a paragraph about people are willing to accept less
for less taxes. Well, I have got to tell you right now, maybe that is so in some departments in
this town but it is certainly not in highway. Because we are inundated everyday with not just
people requesting, people are demanding services. So, I just, you know, by sometimes they use
the old cliche, pennywise and pound foolish, I think this is one situation where I think we are
being a little foolish and too pennywise.
SUPERVISOR RUSSELL: Thank you, Pete.
MR. SKABRY: I just want to mention something because I saw one head nodding negative
from the floor but I want to address the Town Board where I should be addressing this to, the
idea of possibly putting these mowers on bonding issue...
SUPERVISOR RUSSELL: I will tell you, frankly, Tom, I support the purchase of that mower, I
budgeted for the purchase of both mowers. I wouldn't support bonding them, they are
maintenance. They should be part and parcel to the town's cost of doing business. I bonded two
heavy pieces of equipment because they were part of a capital project which is the stormwater
mitigation; that was the air-vac truck and the backhoe. Because they are a much larger ticket
item, they are part of the ongoing capital project and they have a service life that far exceeds
these mowers and I thought that as a capital outlay that they would make sense. But these
mowers are the cost of doing business for the town, we need them, we ought to just have the
courage to buy them, period.
MR. SKABRY: Alright. Because one idea that I had, that I still need to (inaudible). I mean, the
case is made clear that we are down four mowers, not down four mowers, we are down two right
now, we have four mowers that are antiquated to be polite about it; even if we bond it, even if the
purchase price today is $60,000 a mower. You are talking about $240,000. You bond that over
a period of five to seven years. Every (inaudible) we didn't do that, if you look at the other
scenario, if we bought one mower this year, the next year, the next year, next year, I just heard
one of the council people saying before the Town Board, interest rates are supposed to go up 5%
next year. Okay? Add 5% onto $60,000 for every year; bonding it today, purchasing today's
mowers at today's dollars makes a lot of sense, if you are looking at the pennies. That is one of
my suggestions.
SUPERVISOR RUSSELL: I would just like to say that it figures the interest rates are supposed

to be going up 5%. I am getting ready to sell my house. That would be my luck. Dave?
DAVE BERGEN: Dave Bergen from Cutchogue. I am here in my role in the Town of being on
the Police Advisory Committee tonight to bring up a couple of issues in regard to the police
budget this year. In our meeting with the Chief, he told us about a couple of proposed cuts to the
budget that the Board had made over what he had submitted originally that I wanted to address
and then one issue that is a capital issue. I had the opportunity to go on a ride along last Friday
night, as I do about three or four times a year with our officers, to see exactly what it is that they
go through out in the streets and hear from them exactly what their needs are. And I had the
chance to observe a situation that this Board has already been informed about but I don't know
that the solution has been achieved yet and that is the problem (inaudible). As this Board knows,
we are not in compliance with state regulations regarding our jails and that we cannot have males
and females in our jails at the same time and we are not in compliance. So what happens is, we
heard about and I was able to see in person this weekend, when there was a woman arrested and
we already had a male prisoner on site, they had to go through what do they do in that dilemma?
They withdrew all the matrons on the list in Southold Town, no matrons were willing to come in
to assist. They then contacted Riverhead because that is the backup system that we had
established and Riverhead had no matrons that were available to assist. So we were required to
take a unit off the road to transport the woman because we had a choice-either the woman or the
male-to transport the woman up to Riverhead. We have no choice in this matter, as this Board
knows. We are not allowed, with our current jail situation configuration, to house males and
females. I believe there was budget request put in by the Chief this year in a capital request for, I
could be wrong about this but I think about $75,000 for a trailer that could be obtained to be
placed in back of the police headquarters and could be a detention center that would prevent us
to have to take our, either a car off the road or calling in somebody on overtime to transport
prisoners up to Riverhead and that is if Riverhead will even continue the program. We could
face the situation for future where Riverhead or as a backup we have Southampton, would say
they are not going to take our prisoners any longer, so, my point of this is to really encourage the
Town Board to consider that capital request; to help bring us into compliance where we are no
longer in compliance, bring us in compliance with state standards. The issue that it is a
budgetary issue in the operational budget, that is the issue of car replacement. I had written an e-
mail to each of you that was sent on Friday that hopefully you all had a chance to review.
Excuse me, it was sent on Monday not Friday. And again, this was something I observed the
other day. We all know that the police put in for car replacements each year and my
understanding is that the Board cut the Chief's request back to three cars for this coming year. I
myself saw that there was a car that had an electrical fire, that I will call one of the B units and
the supervisor there said this unit is dead. Now, maybe it could be repaired, it very well could be
repaired but it was dead for that night. I also observed there was another car that had gotten
fueled up that had 122,000 miles on it. Now, we have three types of cars as you guys know. We
have the A cars which are our primary patrol cars. They are the units that respond to
emergencies, whatever it might be in this Town, they have to be in top physical forms, those
cars. Then we have the next, I call them B cars, these are the cars they use in-house. Recruits
that have to go to the academy will take a B car up to the academy and finally have got the C
cars as I call them, they are traffic control officers cars. They get the end of the line. The A cars
really according to the officers I talked to the other night and the supervisors on that shift, they

say once they go over 100,000 miles, these cars are becoming more and more prone to breaking
down and maintenance problems. Now, we have currently we have, just our A cars, two ofthem
have currently over 100,000 miles on them. Four of them have over 90,000 miles of them, two
of them have over 85,000 and the cars average according to Captain Flatley, he provided me with
this today, approximately 42,500 miles per year. That is what is put on a patrol car. So, right
there you have 8 cars that are going to be well over 100,000 miles next year. There is one new
car that is about to be cycled in, that was approved in this years budget and they have taken
delivery of it. So three replacement cars, that is four, eight (inaudible) four of these four cars;
yet the current budget only allots for three car replacements, four cars that are being, of our
primary cars, that are going to be well over 100,000 miles next year. I think that is a very
dangerous situation for this town and creates a liability hazard should they be responding to a
critical incident and they break down. I know our bay constables also are driving vehicles that
are very old. I know I saw where the senior bay constables car where the tie rod broke while he
was driving on the North Road and the car veered off the road. Luckily he wasn't on a call, he
wasn't exceeding any speeds but if he had been responding to a call, that could have been a
disaster. So what I am pleading with you as a member of the police advisory committee is to
rethink that replacement program of only three cars and up that to a minimum of four, if not
beyond that. I will take any questions you might have.
COUNCILMAN KRUPSKI: When the state makes a mandate like that for a jail, do they
provide us with the funding to make that happen?
MR. BERGEN: I don't know if they provide us with the funding to make that happen. One of
the things we asked several years ago, is if there was grant funding available to help offset that
cost.
COUNCILMAN KRUPSKI: Grant funding, this is what your requirement is and here is the
money to accomplish it.
MR. BERGEN: My understanding is that one of the challenges of that is our police department
is not accredited and with accreditation, that possibly that opens the door for grant funding. This
is what came from the Chief. We had apparently had been working over the last two years with
trying to do the necessary paperwork to become accredited. It could very well be that
accreditation would lead, and I don't know if it would or not, but it could lead to more grants
which could help us with the situation. I don't know, that is a question for the Chief.
COUNCILMAN KRUPSKI: That shouldn't even be a grant, it should be just money provided.
MR. BERGEN: Or unfunded mandates, in other words.
COUNCILMAN KRUPSKI: It was their idea, they should pay.
MR. BERGEN: Could be but if not, we are still saddled with the responsibility and the legal
responsibility of taking prisoners either up the road to Riverhead or to Southampton.

MR. BERGEN: Well, talk about taking an officer off the road. Wow. Think of the overtime

SUPERVISOR RUSSELL: Thanks, Dave. Mr. Wills?
FRANK WILLS: Good evening, Frank Wills, Mattituck. I will make this short. On the police
budget, by my math it looks like this is an increase of about 14% on the personnel line. Have we
added a policeman or two or three? Or is it all the police cars?
SUPERVISOR RUSSELL: No. Generally that is a result of several issues. Longevity. There is
a contract that was signed that is 4% per annum for each police officer. There is also officers
who have given us notice with intent to retire which means we have to accumulate money to pay
them for their unused vacation, sick time etc. Those are generally some large sums. Those will
be going away in the future as a result of our recent budget negotiations. Our recent contract
negotiations that limit how much a police officer can travel forward with them over his years of
service. But it is all of those things cumulatively. It is difficult to take one number, compare it
to the second years number and try to draw a corollary to that.
MR. WILLS: Alright, thank you.
SUPERVISOR RUSSELL: Jill?
JILL DOHERTY: Jill Doherty, vice-president, Board of Trustees. I just wanted to go over what
we talked about in the past couple of weeks, about the Trustees in their budget request. On July
20th you got a memo for our budget request for a part-time person in the office. Then we met on
other issues and it was decided by other people that a full-time person would be more sufficient
in our office. Our office has increased in work load due to just the amount of people coming out
here and also code changes. (Inaudible) increased in going from 75 feet to 100 feet jurisdiction.
And our staff has not increased and we feel that at this time with the amount of work coming
through our office, we need another clerk-typist. Right now our environmental technician is
being paid as an environmental technician but basically doing clerk-typist work and in order to
free her from that and do her environmental work, we need more help in the office. And I just
want to let you know that all four of us, well now five with Bob, really want this and need this
and we hope that you will keep it in the budget.
SUPERVISOR RUSSELL: The clerk-typist position that I had originally not included in my
budget, then as a result of the L WRP coordinating meeting with the Trustees etc., I put into my
proposed or tentative budget that the consortium of legislators removed, we did restore that, put
that in so that is part of the preliminary budget now, a full-time clerk-typist. Councilman
Wickham and others had wanted to bring some clarity to what that job would be. The issue of
clerk-typist I think is self-explanatory, however, there is a functioning in that office, we now
have three people and the Town Board decided as a unit that what we would like to see from the
Trustees is a better understanding of what the dynamics of each individual and what their duties
will be with the addition of this new clerk-typist position in the new year. But it is currently in

the budget for the new year.
MS. DOHERTY: Okay. Right now we have the civil service descriptions of each job but we
can break it down further for you.
SUPERVISOR RUSSELL: Right. I got another e-mail from Heather today requesting more help
for the administrative, for the, and I know that every person that I talk to, every single one of you
need the help with the more, the paper pushing, so to speak.
COUNCILMAN WICKHAM: I would like to add to the Supervisor's comments and I agree
with everything he said. I would just like to add that while the item is still in the budget, I, at
least, don't intend to fill that item until we have a clear cut picture of how the Trustees office is
functioning and until we are satisfied with how it is functioning. Until we get the qualifications
of the person who is being recruited and review all of that. Putting it in the budget is one thing,
filling the position will depend on, for me at least, satisfaction of seeing how it is all outlined in
the office.
MS. DOHERTY: Yes, we understand that. As I said, we have the civil service titles but you
wanted more so we are trying to break down those titles and make it clearer to what they do.
And we will get that to you as soon as we can.
SUPERVISOR RUSSELL: And tell Lauren to hang in there, we are getting help on the way.
MS. DOHERTY: Yeah, we have an average of30 field assessments a month...
SUPERVISOR RUSSELL: Your staffhas been working very hard.
MS. DOHERTY: .. and it is not going down.
SUPERVISOR RUSSELL: It is a function of the real estate market and I know the two of them
have been working very hard.
MS. DOHERTY: Yes, they have. Thank you.
SUPERVISOR RUSSELL: Would anybody else like to address the Town Board? Mrs. Egan?

SUPERVISOR RUSSELL: November 20th, we have a special meeting scheduled to adopt it.
MS. EGAN: Good. I did notice family counseling, there was no increase in that and I was
wondering what your input on that was, as far as, I think it is a marvelous idea, the family
counseling and I was wondering how it was working out and your budget remain the same so I
don't know whether you need more or less there.
SUPERVISOR RUSSELL: The, I think you are making reference to the allocation for the block
grant money?
MS. EGAN: No, the family counseling. It is listed in here under family counseling. I think 30
something.
SUPERVISOR RUSSELL: What department budget is that?
MS. EGAN: I don't know. That is your problem.
SUPERVISOR RUSSELL: Good point. I will look into that. I believe that is part of an
allocation that we get from the federal government that we give out to a private not-for-profit
that fills that function.
MS. EGAN: Well, I think it is a great thing. Now, I noticed, now this juvenile aid bureau...
SUPERVISOR RUSSELL: That is essentially the DARE program.
MS. EGAN: That is the same, that is state money?
SUPERVISOR RUSSELL: That is county and state, I believe.
MS. EGAN: Okay. Now, I noticed in the bay constables that when you put 2006 and
supervisor's 2007 and preliminary budgets, what is the difference between the supervisor's and
the preliminary? What is the difference?

SUPERVISOR RUSSELL: The supervisor proposes a budget, the Town Board then re-works or
rethinks that budget and then presents what is called a tentative budget or preliminary budget, I
am sorry.
MS. EGAN: I would imagine that for the police, it should be a hire, certainly we need more.
You keep giving people places to build and that Factory Avenue, you are going to need more
police there. But in addition, for the bay constable, now their boats come under that, don't they?
SUPERVISOR RUSSELL: There is a whole separate section in the police budget that pertains
just to the bay constables and that does include not just their salaries as personnel but also for
their operating expenses such as the boats, etc.
MS. EGAN: Their job now, out on the waters is horrific.
SUPERVISOR RUSSELL: Yes, it is.
MS. EGAN: Absolutely horrible.
SUPERVISOR RUSSELL: And my budget, which this Board supported, includes the hiring of a
third constable.
MS. EGAN: Good. Now if you have a third constable, how many boats do we have?
SUPERVISOR RUSSELL: Right now, we have two that they principally rely on but we have
three or four, three I believe, operating.
MS. EGAN: And some of the fire departments have some...
SUPERVISOR RUSSELL: Fire departments have their own vessels that they launch.
MS. EGAN: Yeah. Good. So take care.
SUPERVISOR RUSSELL: Thank you.
MS. EGAN: You are welcome.
SUPERVISOR RUSSELL: Would anybody else like to address the Town Board? (No response)

I am committed to try to work out the purchase of another mower, you know, after hearing all of
the concerns. So if we could think about that and try to work something out before the final
budget is adopted to restore that mower to the Supervisor's budget.
