FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 25,
2006 at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other
evidence, the Zoning Board finds the following facts to be true and relevant:
In considering this application, the Board has reviewed the code requirements set
forth pursuant to Article VII, Section 100-71B(3) [renumbered 280-71B(3)], to
establish an Apartment and finds that the applicant complies with the
requirements for the reasons noted below:
The applicant proposes to renovate the one-story portion of the existing residence
011 the subject property on a new basement/foundation and convert it to business
office use, and requests a Special Exception to establish a market rate rental
apartment on the second floor. Additional new square footage for first floor
office use (3' x 19.7') is proposed to connect the existing residence to an existing
garage in the rear yard, which will be converted to first floor office space. The two
existing accessory garages will remain and be used by the owner/applicant for
storage.
1) The Apartment, as applied for, is reasonable in relation to the District in which
is located, adjacent use districts, and nearby and adjacent residential uses.
AI)artments over business and professional offices are permitted uses by Special
Exception in the RO Residential Zone District under Section 100-71B(3). The
cc'nversion of the existing dwelling into an office use will have no detrimental
effect on the visual character of the residential properties nearby, since the office
will be located in the original renovated residence.
2) The Special Exception use will not prevent the orderly and reasonable use of

adjacent properties. The proposed apartment unit, at 600 sq. ft., is 39.5% of the
proposed 1,518 square feet of office space, which is less than the code's
limitation of 40%, of the principal office building footprint. The applicant complies
with the requirements for total lot coverage of 30 percent. The existing dwelling
and garages total 12.8% of the 26,081 sq. ft. (0.598 acres) subject property. The
proposed conversions/alterations to the existing dwelling to office use, and the
proposed additional first floor office space will increase the lot coverage
minimally to 13.1%.
3) The use will not prevent orderly and reasonable uses proposed or existing in
adjacent use districts. The adjacent property to the east is the parking lot of the
Unitarian Church, to the west is a single family dwelling. The proposed uses
(business office and accessory apartment) are in keeping with the Residential-
Office zoning in the area.
RESOLUTION OF THE BOARD: In considering all of the above factors and
applying the balancing test under New York Town Law 267-B, motion was offered
by Member Weisman, seconded by Member Goehringer, and duly carried to
GRANT the Special Exception application for an accessory apartment as
applied for, SUBJECT TO THE FOLLOWING CONDITIONS:
1. A Certificate of Occupancy shall be obtained from the Building
Department before occupancy.
2. A chain ladder shall be installed for emergency egress from the second-
story apartment.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio,
SHmon and Weisman. This solution was duly adopted (5-0).
