SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in
this application and determines that this review falls under the Unlisted Action category of the State's List of
Actions, and issues a Negative Declaration without advertise effects to the environment as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's property contains 145+ acres, zoned HD and R-80,
and the Brecknock Hall building is located in the R-80 Residential portions of the land, as shown on the site
diagram prepared by Donald W. Smith, P.E. (based on information prepared by Young & Young, LS.).
BASIS OF APPLICATION: Zoning Code Section 280-22B(4) for Special Exception authorization of uses,
proposed within the existing Brecknock Hall building, in part for an apartment, offices and for public space
related to conferences, art shows, weddings, and other types of indoor events. Also noted in the Building
Inspector's March 9, 2006 Notice of Disapproval confirming that approvals are required for a Special
Exception from the Southold Town Zoning Board of Appeals and from the Southold Town Planning Board
concerning site plan approval.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on September 28, 2006, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and
relevant:
APPLICANT'S REQUEST: The applicant is proposing to convert 8,000 square feet of the interior of the
existing building for office use, for an apartment, and the west section of the building for publiC space (inside
events, parties, receptions, meetings, art shows, concerts).

REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal
inspections, the Board makes the following findings:
1) The applicant seeks authorization, by Special Exception, to convert the interior floor areas of the
existing historic mansion to a single apartment, office areas, and indoor events. After a site visit on
September 16, 2006, and discussions at the September 28, 2006 public hearing, the Board finds that the
apartment use and offices are appropriate for this grand building. These uses will not in any way alter the

character of the neighborhood or district and the activities will fall within the purpose and intent of the
provisions listed in Chapter 280-14B(16).
2) Zoning Code Sections 280-14B(16) and 280-22 provides a limitation of three uses per building, and
requires that the building be owned and maintained by a not-for-profit historic organization. The uses
proposed by applicant will not exceed the limitation of three uses (office use), and in no event will there be
more than one apartment under this Special Exception authorization.
3) In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in
Article XXV and finds:
A. That the use will not prevent the orderly and reasonable use of adjacent properties or of
properties in adjacent use districts.
B. That the use will not prevent the orderly and reasonable use of permitted or legally established
uses in the district wherein the requested use is located or of permitted or legally established uses in
adjacent use districts.
C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will
not be adversely affected by the proposed fitness facility use and its location.
D. That the use will be in harmony with and promote the general purposes and intent of this
chapter.
E. That the use will be compatible with its surroundings and with the character of the neighborhood
and of the community in general, particularly with regard to visibility, scale and overall appearance.
F. That all proposed structures, equipment and material shall be readily accessible for fire and police
protection.
BOARD RESOLUTION: In considering all of the above factors and applying the standards under New York
Town Law 267, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly
carried to
GRANT a Special Exception, as applied for, to convert the interior floor area of existing building for
offices, an apartment, and space for indoor public events (art shows, weddings, meetings, and
similar indoor activities), as shown on the first floor plan dated 6-27-2005, and second-floor plan
dated 5-15-2005, prepared by Martha V. Smith, Architect, SUBJECT TO THE FOLLOWING
CONDITIONS:
1. Public entertainment and special events shall be requested in a separate permit application and
obtained in accordance with the provisions under Chapter 205 (formerly Ch. 71) of the Town Code.
2. The activities allowed by this Special Exception are:

(a) a single apartment of approximately 900 square feet on the east side of the
building on the second floor;
(b) two public or private offices (instead of the existing two bedrooms) on the west
side of the second floor;
(c) Use of the entire ground floor or first floor for special functions as rental
income, but without habitable space; and
(d) Kitchen facilities are permitted for the purpose of limited preparation of food, a
warming kitchen, on the first floor.
3. Additional permits (other than this authorization) must be obtained by applicant from the Town of
Southold, including but not limited to inspections that may be required by the Town Building
Inspector prior to occupancy on the site (any rental, interior or outdoor).
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such
uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that
does not increase the degree of nonconformity.
Vote of the Board: Ayes: Members Oli (Chairwoman), Goehringer, Dinizio, Simon, and Weisman. This
Resolution was duly adopted (5-0).

PUBLIC HEARING
NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100
(Zoning), Code of the Town of Southold, the following public hearing will be held by the SOUTH OLD
TOWN ZONING BOARD OF APPEALS at the Town Hall, 53095 Main Road, P.O. Box 1179, South old,
New York 11971-0959, on THURSDAY. SEPTEMBER 28.2006:
10:55 A.M. PECONIC LANDING, INC. #5949. Request for a Special Exception under ZONING
Code Section 280-22B(4) for approval of conversion of the existing building, in part for
apartment, offices and space for public events, at Brecknock Hall, 1500 Brecknock Road,
Greenport; CTM 35-1-25. A Notice of Disapproval was issued March 9, 2006 by the Building
Inspector indicating a Special Exception approval is required from the Zoning Board of
Appeals, and site plan approval required from the Planning Board under Section 100-31B(16).
The Board of Appeals will hear all persons, or their representatives, desiring to be heard at each
hearing, and/or desiring to submit written statements before the conclusion of each hearing. Each

Brecknock Hell in Greenport, stands on property owned by Peconic Landing, Inc. The Brecknock Hall
Foundetion has a stewerdship egreement with Peconic landing to conserve and maintain the Hall.
Towar-d this end. the Foundation plans to bring the Hall to the point where it can be self-susteining.
The 8000 square feet (4000' on eech floor] will be rentad es office space, end public rooms for
public events [ art shows. concerts, parties, receptions, meetings, etc.] in the west section of the
building.
In the east section, the former servants quarters,we propose a two bedroom apartment of @ 900sq.'
on the second floor and public restrooms on the first floor.
Although there is no construction involved other then converting the interior servants querters, we
are obliged to seek special exemption approvel from the ZBA according to Article III, Section 100-31.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location oflot and of buildings on premises, relationship to adjoining premises or public streets or

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

(d) Kitchen facilities are permitted for the purpose of limited preparation of food, a
warming kitchen, on the first floor.
3. Additional permits (other than this authorization) must be obtained by applicant from the Town of
Southold, including but not limited to inspections that may be required by the Town Building
Inspector prior to occupancy on the site (any rental, interior or outdoor).
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such
uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that
does not increase the degree of nonconformity.

(c) The identification sign shall be no larger than two square feet in areas zoned
Residential-Office or higher, but there shall be no exterior signage identifying
the use as a bed-and-breakfast in residential areas.
(d) No accessory apartment, as authorized by § 280-13B(13) hereof, shall be
permitted in or on premises for which a bed-and-breakfast facility is
authorized or exists.
(15) Historical society. [Added 11-12-1996 by L.L. No. 20-1996]
Obuilding
Preservation and use of a federal or state designated historic building for the
purpose of hosting community events, together with the use of part of such for professional offices and/or one apartment, not to exceed a total of
three uses per building, provided that such building is owned and maintained by a
not-for-profit historic organization. In no event shall there be more than one
apartment per building. [Added 10-25-2005 by L.L. No. 18-20051
C. Accessory uses, limited to the following uses and subject to the conditions listed in
§ 280-15 herein:
(1) Any customary structures or uses which are customarily incidental to the principal
use, except those prohibited by this chapter.
(2) Home occupation, including home professional office and home business office. In
permitting these uses, the Town Board recognizes that the residents historically
have operated small businesses which provide services to the community from
their homes. The Board finds that these businesses have not impacted negatively
on the appearance of these residential zones. In the Board's judgment, it finds that
in order to maintain the economic viability of the Town, to maintain the rural
quality of life and in the interests of the welfare of the residents, these businesses
(or home occupations) should be permitted to continue. In setting forth the
following subsections, the Board intends to permit as of right certain business uses
in residential zones with the understanding that these uses are to be conducted in a
manner that will not alter the character of the residential neighborhoods. The
Board believes that the following subsections provide sufficient safeguards to
accomplish that aim. These uses shall be permitted, provided that: [Amended

(a) No display of products shall be visible from the street, and no stock-in-trade
shall be kept on the premises.
(b) Such occupation is incidental to the residential use of the premises and is
carried on in the main building by the residents therein with not more than
one nonresident assistant for whom off-street parking must be provided on
site.
(c) Such occupation is carried on in an area not to exceed 25% of the area of all
floors of the main building, and in no event shall such use occupy more than
500 square feet of floor area.
