This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/1 0 of 1 % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

Dear Ms. Kelly:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
Your property, which is located landward of a functional and substantial man-made structurk (a
concrete seawall) greater than 100' in length and constructed prior to 8/20/77 as shoWh on
Aerographics Photograph #77-2159, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no
permit is required under the Tidal Wetlands Act. Please be advised, however, thal'no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions ara takan to prevent any sedimentation or other alteration or disturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier,
or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies.

Property location: 600 Private Rd. #4, Orient; CTM #24-2-11
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if
the project is implemented as planned.
PROPERTY FACTSIDESCRIPTION: The applicant's 17,350 sq. ft. lot has 12.44 ft.
frontage along Private Road #4 (which also runs through applicant's property on the
southwesterly front side of the dwelling). The property is improved with a 1-1/2 story
frame house and accessory storage building (barn) in the rear yard as shown on the
survey prepared by Fox land Surveying dated March 13, 2002.
BASIS OF APPLICATION: BJilding Department's April 16, 2003 Notice of Disapproval,
citing Sections 100-242A, 100-244, and 100-239.4B, in its denial of a building permit to
construct additions to the ,3xisting dwelling: (a) at less than 35 feet from the front lot line,
and (b) less than 75 feet from the rip-rap structure.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 21,
2003, at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence, the
Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant originally applied for variances as
shown on the March 13, 2002 survey prepared by Fox land Surveying, revised
September 6,2002 (with a ZBA date stamp of May 15, 2003), for: (a) a 44'9" proposed
2nd story addition, and (b) proposed addition at the north side of the house.
ADDITIONAL INFORMATION:AMENDED RELIEF: At the August 21, 2003 public
hearing, the applicant confirmed new construction areas that were different from the
areas shown on the September 6, 2002 and August 14, 2003 survey maps. The Board
asked the applicant to file a modified site plan or survey map labeling the areas for
variance relief with dimensions and setbacks. On September 11, 2003, a survey map
was filed indicating the areas of reconstruction and alterations within the 75 ft. setback
from the rip-rap structure and within 35 feet from the front lot line (right-of-way line). The
amended September 11, 2003 survey confirms the following relief requested by the

applicant: (a) proposed 14.1' x 44.9' second-story addition at the northerly side of the
dwelling, including the second-story 210 sq. ft. roof deck, (b) alteration to allow raising
of the existing dwelling, without expansion of the foundation or footprint, to comply with
applicable flood plain requirements for minimum first floor elevation, and (c)
reconstruction of the front porch with 27.5 sq. ft. increase for a small portion of the
easterly proposed porch.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The applicant proposes a rather
large addition to an elderly, seasonal 1-1/2 story home on Private Road #4 adjacent to
Orient Harbor. At the hearing applicant's agent submitted an alternate plan scaling
down the addition, and confirming that the existing dwelling would be raised
approximately 8 inches above the existing foundation, without a change in the footprint.
The raised dwelling and setbacks will not affect the existing 17.8 ft. setback from the
right-of-way easement, which runs through the applicant's.. p,operty. The survey
confirms conforming side yards are proposed at 37' and 14/, and the requested 47'
setback from the existing covered porch to the rip-rap along Q'rient Harbor. The grant of
the variances will in effect allow the applicant to renovate 'the existing seasonal type
structure with an up-to-date sanitary system, electrical system, and windows that will
meet the present codes.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The lot contains 17,350 sq. ft. of
land area, of which 1693 sq. ft. is a right-of-way easement. The new, updated sanitary
system will cover a large portion of the rear yard, which limits options for any new
building area.
3. The relief requested is substantial in relation to the code requirements, resulting ;n a
reduction from the 35 ft. front setback requirement and 75 ft. setback from the rip-rap
structure. The existing setbacks from the front yard line and rip-rap structure have been
nonconforming for many, many years, and the new addition will be more distant from the
front line and rip-rap than the existing dwelling.
4. The difficulty was self-created when the applicant planned and designed additions
and alterations that did not conform to the current Zoning Code requirements.
5. There is no evidence that the grant of the relief requested will have an adverse effect
or impact on physical or environmental conditions in the neighborhood or district. The
neighborhood is a waterfront community consisting of small lots with shoreline rip-rap

structures. No opposition or concerns were raised at the August 21, 2003 concerning
applicant's request for variances.
6. Grant of the relief requested is the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of additions and alterations, while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member
Goehringer, seconded by Chairwoman Tortora, and duly carried, to
GRANT the variances as requested and shown on Drawings 1 and 2 prepared by
Donald G. Feiler, Architect on 8/5/03, and the survey prepared by Fox Land
Surveying, revised 9/11/03.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action, /

Dear Mr. Verity:
The above mentioned dwelling presently contains four bedrooms which have
been served by a sewage disposal system located on the easterly portion of the
property. Field inspection of this system revealed no overflow or signs of failure.
Redevelopment and reconstruction of the existing dwelling will result in a number
of bedrooms from 4 to 3. Thus, there is no expectation that the sewage disposal
system would fail given the reduction in sewage flow.
Notwithstanding the above, the applicant has made application to upgrade and
relocate the sewage disposal system to the rear of the property. Such a proposal
is prudent. Installation of the new system as approved by Suffolk County
Department of Health Services should be completed prior to the issuance of a
Certificate of Occupancy.

The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on November 20th, 2002 regarding the above matter.
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of Ann Marie Kelly applied
to the Southold Town Trustees for a permit under the provisions ofthe Wetland Ordinance of
the Town of South old, application dated October 10, 2002
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
November 20th 2002 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 ofthe Southold

relocate the existing garage to the eastern corner of subject property and construct a 35 ft. long
retaining wall off the southern corner of same, abandon the existing sanitary structure and
construct upgraded system and relocate private well - roof gutters and drywells for roof run-off
also a line of haybales during construction.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date ofthis
notification.

Dear Ms. Kelly:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
Your property, which is located landward of a functional and substantial man-made structure (a
concrete seawall) greater than 100' in length and constructed prior to 8/20/T: as shown on
Aerographics Photograph #77-2159, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no
permit is required under the Tidal Wetlands Act. Please be advised, however, thatno construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such

The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on November 20th, 2002 regarding the above matter.
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of Ann Marie Kelly applied
to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated October 10, 2002
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
November 20th 2002 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold

Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town.
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of Ann Marie Kelly for a
Wetland Permit to construct a 1,075 sq. ft. second story addition, a 205 sq. ft. front porch
extension a 96 sq. ft. rear patio, deposit 575 +/- cu. yd. of clean fill from an upland source,
relocate the existing garage to the eastern comer of subject property and construct a 35 ft. long
retaining wall off the southern comer of same, abandon the existing sanitary structure and
construct upgraded system and relocate private well - roof gutters and drywells for roof run-off
also a line of hay bales during construction.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of$5.00 per inspection (See attached schedule).
