ZBA 5531 - BREMER'S MARKET AND DELI d/b/a NORTH FORK MARKET & DELI
Properly Location: 11155 Main Road, Mattituck; CTM 142-2-22.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the properly under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 9,600 sq. ft. lot has 75 ft. frontage along the
Main Road and 128 ft. frontage along the east side of Legion Avenue in Mattituck. The property is
zoned B Business, and was recently improved with a fire-damaged building formerly used as a deli
market business.
BASIS OF APPLICATION: Building Department's April 15, 2004 Notice of Disapproval amended
April 20, 2004 and amended April 23, 2004, citing Code Section 100-103A. The reason stated in its
denial of a building permit application is that the proposed building notes a "right-of-way" setback of
23 feet from Route 25 (Main Road) and 1.33 feet from Legion Avenue. The denial indicates that the
code requires that structures be at least one hundred (100 feet) from the right-of-way.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to reconstruct the former deli building
with new construction containing 1,840 sq. ft., set back 23 feet fro the front line along the easement
of NYS Route 25 (Main Road) and set back I ft. 5¼ inches from the west line along the easement of
Legion Avenue.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicant's property is a small corner lot with
frontage along two streets. The building that was used previously as a deli was situated in a location
that did not provide adequate parking or loading areas for vehicles on site. This new building has

been planned with an interior, on-site flow of vehicles around the building, with at least 8 parking
stalls and designed to prevents backing of vehicles onto the street. The buildings which exist on
other parcels to the east of this site, along the Main Road, are visibly closer to the Main Road dght-
of-way than this proposed building. To the west are a cemetery, then the Mattituck Shopping
Center.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The lot is only 128 feet deep and 75 feet wide,
and fronts along two streets. There is no other alternative for applicant to pursue.
3. The relief granted is substantial, with a reduction of 77% reduction of the code required 100 ft.
setback from the Main Road.
4. The difficulty had been self-created, in that the parcel has existed with a nonconforming side and
two front yards, which lends to the difficulties in establishing an "building envelope" under the current
zoning regulations.
5. No evidence has been submitted to suggest that a variance in this business district will have an
adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of a new building, while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community,
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by
Member Dinizio, and duly carried, to
GRANT the variance as applied for, as shown on the 5/25/04 site and building elevation plan,
signed by John J. Condon, P.E. 5/26/04, SUBJECT to receiving the Planning Board's review
determination under the site plan provisions of the zoning code.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly
addressed in this action.

On January 30, 2006 1 conducted a stropping inspection of the North Fork Deli located at 11155
Main Road in Mattituck New York. Inspection found the new roof and wall support framing to be

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, November 7, 2005:
The final public hearing was closed.
WHEREAS, the site plan is for a new 1,840 sq. ft. building with 790.1 sq. ft. of retail floor
display, 864.6 sq. ft. for food preparation, including a utility/bathroom and 185.3 sq. ft. of
storage with no public access on a 0.22 acre parcel in the B Zone located on the n/e
corner of NYS Road 25 and Legion Avenue, known as 11155 Main Road, in Mattituck.

WHEREAS, the applicant and agent, Henry Bremer, proposes the site plan; and
WHEREAS, the Bremer's Market & Deli, Inc. is the owner of the respective property;
and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; and
WHEREAS, on July 12, 2005, the Southold Town Planning Board issued conditional final
approval to the site plan; and

WHEREAS, on November 7, 2005, the applicant submitted to the Southold Town
Planning Department a site plan with the Suffolk County Department of Health Services

RESOLVED that the Southold Town Planning Board grant final approval on the site plan
prepared by Condon Engineering, P.C. and certified by John J. Condon, Professional
Engineer, dated February 17, 2005 and authorize the Chairperson to endorse the final
site plan subject to a one-year review.

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. ]Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning' amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Dear Mr. Rallis:
Attached are 4 copies of S-1 and P-2 for the North fork Deli project. S-1 has been modified as
discussed and P-2 has been added to show the plumbing details.
As also discussed, a separate submittal will be issued for a sign for the site. The range hoods for
the building will also be submitted separately as part of the hood manufacturer's/and installers
installation package. It is my understanding that ABT Design and Fire Protection, Inc. from Center
Moriches will be handling the hood design and installation.
Relative to the bathroom, the transient nature of the deli business makes it very unlikely to have
an occupancy greater than 15 people and thus the need for an additional bathroom is not
necessary.

4 - All straps, connectom, plates, bolts, nails, etc. are to be galvanized steel. Designated connectors,

Steel

4 - Square/rectangular columns are to be ASTM Spesiflcafion A50g.
5 - Columns are to be equipped with 7" square x ~" bearing plates unless indicated otherwise.
6 - All wood nailers are to be bolted to girders with 3/8" bolts, nuts, and washers,
7 - All columns are to be bolted to steel girders with ~" bolts and to wood girders with ~" lag bolts.
8 - All welded connections are to be done by a certified welder and conform to AWS and AISC standards.
