the above described premises over a Right of Way 40 feet wide
(the 1140-Foot Right of Way") leading Northeasterly from the
Northeasterly line of the above described premises to a certain
Right of Way 15.00 feet wide (the 1115-Foot Right of Way")
leading Northwesterly to the Main Private Road, said 40-Foot
Right of Way also running along the Northwesterly line of the
above described premises, also TOGETHER with a Non-Exclusive
Easement over said 15-Foot Right of Way to the Main Private
Road.
Intending hereby to release all right, title and interest of
the party of the first part in and to the 40-Foot Right of Way
and 15-Foot Right of Way, whereupon such 40-Foot Right of Way,
to the extent it traverses the premises granted hereby, shall
be forever extinguished and shall merge with the granted
premises.
The right title and interest of the party of the;_first part in
the granted premises was acquired by deed of Maltha Shanklin
Anderson to Duncan S. Ellsworth, the deceased spouse of the
party of the first part, dated October 22 , 1953, and recorded
in the Suffolk County Clerk's Office on November 9, 1953 in
Liber 3609 page 82. Said Duncan S. Ellsworth died a resident
of Salisbury, Litchfield County, Connecticut on December 3,
1967, leaving a Last Will and Testament which was duly admitted
to ancillary probate in the Surrogate's Court of Suffolk County
on the 19th day of June, 1968, and pursuant to Article Four of
the said Will devised to the party of the first part all of his
right, title and interest in the premises.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any strew and
roads,abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.- 1+'
SUBJECT, HOWEVER, to an easement for ingress and egress for
vehicles which will be appurtenant to, and run with, the land
of the party of the first part adjacent to the southwesterly
boundary of the premises herein granted (said adjacent land
being identified as lot 4 in Block 2 of Section 8 on the land
and tax maps of the Town of Southold) . Said easement shall be
over that portion of the granted premises in which the driveway
to such adjacent property of the party of the first part is
presently located, more particularly bounded and described as
follows:
BEGINNING at the point of beginning of the herein
granted premises and running
THENCE northeasterly along the North 38 degrees 34
minutes 00 seconds East line of the herein granted
premises forty feet to a point;
THENCE southeasterly along a line parallel to the
North 50 degree 34 minute 20 second West line of the
herein granted premises forty feet to a point;
THENCE southwesterly along a line parallel to the
aforementioned North 38 degrees 34 minutes 00 seconds
East line of the herein granted premises forty feet
to a point in the North 50 degrees 34 minute 20
second West line of the herein granted premises;
THENCE northwesterly along said North 50 degrees 34
minute 20 second West line of the herein granted
premises to the place of BEGINNING.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
