THIS INDENTURE, made this 14th day of July, 1987, betwegn DWIGHT F.
MILLER, now residing at No. 32 Beth Ridge Road, Bethany Connecticut, party
of the first part, and JENNIFER MILLER, JEFFREY MILLER and JULIA MILLER,
c/o Dwight F. Miller, 32 Beth Ridge Road, Bethany, Connecticut, as joint
tenants with rights of survivorship, parties of the second part,
witnesseth, that the part of the first part for no consideration paid
by the parties of the second part, does hereby remise, release and quitclaim
unto the parties of the second part, their heirs and assigns forever, an
undivided one-quarter (1/4) interest in and to:
All that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being at Fishers
Island, Town of Southold, Cm mty of Suffolk and State of New York, more
particularly bounded and described as follows:
Beginning at a point in the northerly side of a private road which

located at Fishers Island, Town of Southold, County of Suffolk, State of
New York, bounded and described as follows:
Beginning at a stone monument at the intersection of the Northerly
line of Fox Avenue and the Westerly line of Equestrian Avenue, said mon-
ument being 3160.38 feet North of a point which is 2296.94 feet West of
another monument marking the U.S. Coast and Geodetic Survey Triangulation
Station "PROS"; thence running South 87 degrees 07 minutes 30 seconds West
232.01 feet to a merestone; thence North 84 degrees 53 minutes 40 seconds
West 145.36 feet to a merestone; thence North 60 desgrees 10 minutes 10
seconds West 102.58 feet to a merestone; thence North 44 degrees 05 minutes

262.48 feet to a merestone on the Northwesterly line of Sappho Road, this
last line abutting Northeasterly on land now or formerly of Eleanor M.

lines abutting Northeasterly and Easterly on remianing land of Fishers
Island Farms, Inc.; thence running South 04 degrees 24 minutes 30 sec-
onds West 179.30 feet to the point of beginning, this last line abutting
Easterly on Equestrian Avenue.
Together with an easement for sanitary sewer, cesspool and drain-
age field over other properties of Hay Harbor Realty, Inc., lying to
the East of the premises hereii'n described and other property now owned
by Fishers Island Favus, Inp., lying to the WEst, together with a right
to enter upon said premises for the purpose of maintining, repairing
and replacing said sanitary sewer, cesspool and drainage field.
The foregoing premises are subject to the rights of the property to
the West to maintain a sanitary sewer through the premises herein des-
cribed and to enter upon said premises for the purpose of maintaining,
repairing and replacing said sanitary sewer.
Subject to the following restrictions and agreements on the part
of the grantee:
(a) The grantee will not use the premises for any other purpose
than a single family residence n9r erect any outbuildings, without writ-
ten consent of Hay Harbor Realty, Inc., or its successors.
(b) The grantee will not erect any building, outbuilding or struc-
ture within five (5) feet of any boundaries of the premises herein con-
veyed.
(c) The grantee will not sell the premises herein described unless
the grantee shall have (1) received a written offer from a third party
which is acceptable to the grantee and (2) then have offered to sell and
convey the same to Hay Harbor Realty, inc., or its successors, at the same
price and upon the same terms as contained in such offer and (3) 30 days
shall have expired from the date of the making of such offer by the gran-
tee to Hay Harbor Realty, Inc., and Hay Harbor Realty, Inc., shall not
have accepted such offer in writing.
The foregoing restriction shall run with the land and shall enure to
the benefit of Hay Harbor Realty, Inc., and its successors, and say be
modified, amended, or changed by written agreement between the parties
hereof.
The foregoing restriction numbered "c" shall not prevent the grantee
from obtaining a mortgage loan, and if the mortgagee shall acquire title
by foreclosure or otherwise, the mortgagee shall not be required to can-
ply with such restriction, but any purchaser from the mortgagee shall be
bead thereby. The grantee herein will cause any other grantee to assume
and agree to be bound by the foregoing restrictions.
Subject to the following covenants and restrictions:
(1) Grant of easement to Fishers Island Telephone Corp. contained
in Liber 2135 of conveyances, page 424.
