SCHEDULE A
ALL that lot parcel of land in the Town of Southold, Suffolk
County, State of New York, being a part of that portion of
Fishers Island, formerly belonging to Fishers Island
Corporation (which portion is sometimes called the "Park" )
lying Easterly of a certain line described in deeds made by
Fishers Island Corporation as follows :
BEGINNING at the Southeasterly corner of land owned by the
United States, known as the Fort H. G. Wright Military
Reservation, Mount Prospect Tract, on the shore of Block Island
Sound or the Atlantic Ocean and;
RUNNING THENCE Northerly following the East boundary of the
said land of the United States to the Southerly line of East
End Road (sometimes called Oriental Avenue) and which point is
the Northeasterly corner of land of the United States;
THENCE crossing the East End Road and following the same course
as the last to the shore of West harbor or Fishers Island
Sound; said lot or parcel of land being bounded and described
as follows:
BEGINNING at a stone monument set on the Southerly side of the
road forty feet wide, said monument- being 1428 . 18 feet East of
a point which is 5598. 65 feet North of another monument marking
the U.S. Coast and Geodetic Survey Triangulation Station "NIN"
(which said "NIN" monument is located near the western end of a
ridge overlooking the South Shore of Fishers Island and on the
highest point between Chocomount and Mount Prospect and lies
South 45 degrees 17 minutes 26 seconds East of North Dumpling
Light in Fishers Island Sound) ; and;

RUNNING THENCE EasLwardly aLong the Southerly side of said road
(following the arc of a curve to the right whose radius is
527.40 feet and the direction of whose radius at that point is
South 8 degrees 27 minutes East) a distance of 319 . 64 feet to a
point;
THENCE Southeastwardly still along the Southerly side of said
road (and following the arc of a curve to the right whose
radius is 718 .31 feet and the direction of whose radius at that
point is South 26 degrees 16 minutes 30 seconds West, a
distance of 8 . 01 feet to another monument;
THENCE South 24 degrees 44 minutes 30 seconds West 275. 36'',feet
to another monument;
THENCE North 71 degrees 40 minutes 20 seconds West 171. 71 feet
to another monument; and
THENCE North 9 degrees 07 minutes 20 seconds West 251 . 62 feet
to the place of BEGINNING.
Containing 1. 55 acres, more or less .
SAID premises are the same as those known as Parcel II conveyed
to Harold L. Williamson, Jr . and Jacqueline L. Williamson by
deed of Elizabeth D. Reid dated September 20, 1972 and recorded
in Liber 7248 at Page 257. Said premises were subsequently
conveyed by deed of Jacqueline L. Williamson to Harold L.
Williamson, Jr. dated July 20, 1982 and recorded in Liber 9222

together with an easement for sight or view of Fishers Island
Sound over the following portion of other land of the party of
the first part , which other land is referred to as Parcel I in

Jacqueline L. Williamson to Harold L. Willis son dated July 20,
1982 and recorded in Liber 9222 at Page 339 more particularly

of Fishers Island formerly belonging to Fishers Island

overlooking the South shore of Fishers Island and on the

seconds East of North Dumpling light in Fishers Island Sound) ;
and
RUNNING THENCE Northwestwardly along the Northeasterly side of

radius is seven hundred and fifty-eight and thirty-one
hundredths feet and the direction of whose radius at that point
is South thirty-three degrees fifty-nine minutes and ten
seconds West) one hundred and two and six-hundredths feet to a
stake;
THENCE Northwestwardly still along the Northeasterly side of
said road (and following the arc of a curve to the left whose
radius is five hundred and sixty-seven and forty-hundredths
feet and the direction of whose radius at that point is South
twenty-six degrees six-teen minutes and thirty seconds West)
one hundred and sixty-two and fifty-seven hundredths feet to a
stake;
THENCE-North nine degrees East two hundred and eights and
`eighty-four hundredths feet to the shore of Fishers Island

monument being located 5614 .26 feet North of a point which is
1688.04 feet East of the monument marking the United States
Coast and Geodetic Survey Triangulation Station "NIN" and
running thence Westwardly along said road line following the
arc of a curve to the left having a radius of 567 .40 feet and
the direction of whose radius at that point is South 18
degrees, 44 minutes and 40 seconds West for a distance of 68 .00
feet to an iron pipe; thence North 09 degrees, 00 minutes and
00 seconds East 200. 00 feet to a monument; thence continuing
North 09 degrees, 00 minutes and 00 seconds East 78 . 80 feet to
Fishers Island Sound; thence South 73 degrees, 19 minutes and
50 seconds East 149 . 83 feet to a point; thence South 25
degrees, 54 minutes and 30 seconds West 78 .31 feet to a
monument; thence continuing South 25 degrees, 54 minutes and 30
seconds West 200 . 00 feet to the monument on the said Northerly
line of the road at the point of beginning .
The party of the first part and the party of the second
part agree that for and during the period of such easement, as
follows :
A. The party of the first part shall not erect any
permanent improvements or structures within the easement area,
except for no more than three (3) bird houses or baths at any
one time, provided such bird houses; or baths shall not exceed
three (3) feet in height . The party of the first part shall
not allow to exist any trees, shrubbery or other vegetation
within the easement area which exceeds three (3) feet in
height, provided that, subject to the rights and obligations of
the party of the first part and the party of the second part as
set forth in the last sentence of the first paragraph of
Subsection B hereof, the party of the first part shall not be
required to take any action which would not be in compliance
with a letter of the New York State Department of Environmental
Conservation ("DEC") dated June 24 , 1987 and attached hereto as
Schedule B, or any other order, ruling, regulation or
requirement of the DEC, or which would require the issuance of
a permit under the Tidal Wetlands Act, and provided further
that the party of the first part shall not be required to
remove the existing split-rail fence.
B. The party of the first part shall ensure that the
easement area stall consist largely of grass and shall maintain
the easement area by cutting and trimming at reasonable
intervals (at least twice each year) . The party of the second
part shall pay one-half the actual and reasonable costs thereof
upon demand. It is understood that present and future zoning
and/or environmental laws, rules, regulations or permits, may
restrict or prohibit the party of the first part in cutting and
removing certain trees, bushes, flowers or other fauna which
could affect the present view area . If such clearing or
removal is so prohibited, the party of the first part shall not
be deemed in violation of this easement for failing to perform
, such clearing or removal and this easement shall not be
enforced against the party of the first part . Notwithstanding
the foregoing the party of the second part may, at his sole
cost and expense, pursue such legal means as may be available
to limit or eliminate the impact of any such prohibition as the
same may affect the parcel subject to the easement, and, in
that connection, the party of the first part hereby agrees to
execute such authorizations and consents, to assign such causes
of action to the party of the second part and to take such
other actions as may be reasonably required in order to enable
the party of the second part to do so.
If the party of the first part has failed to maintain the
easement area as required in the easement, the party of the
second part may notify the party of the first part in writing
