BE IT RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final surveys dated April 4, 1990. All conditions of the June 4, 1991 conditional final approval have been fulfilled. Enclosed please find a copy of the map which was endorsed by the Chairman. I have deemed that the drainage and/or run/off problems that became evident during construction immediately adjacent to Leslie's Road have been corrected. I have reviewed my finding with James A. Richter, the Southold Town engineer in regards of my acceptance of the work that was performed as being non-detrimental to Leslie's Road and the adjacent town owned road side areas. I SCTM #: 1000-97-04-17 ' Dear Mrs. Woodhouse: I have conducted a final inspected for the above referenced subdivision. The subdivision map on file was prepared by the office of Roderick Van Tuyl, P.C. and was dated Feb. 8, 1990. The required drainage was installed in clean sand and did not encounter any groundwater. This installation has been completed in a satisfactory manner. The drainage and/or run/off problems that became evident during construction immediately adjacent to Leslie's Road have been corrected. The entrance to the new stone blend read was paved with asphalt and contoured to contain runoff from the site and prevent erosion. At this time all of the work specified on the filed map, which had been prepared by the office of Roderick Van Tuyi, has been completed in a satisfactory manner. I have reviewed my findings with Mr. Harris. He has informed my office that he would also be inspecting this road to verify & confirm that the run-off problem has been addressed to his liking. On April 9, 1991, the Town Board approved the amount of $56,285.00 for a bond for roads and improVements. On April 22, 1991, the Planning Board held the final public hearing. The hearing was kept open at the applicant's request, in order for the firewell requirement to be reviewed by the Cutchogue Fire Department. On May 29, 1991, the Planning Board received a letter from the Cutchogue Fire Department rescinding that Department's prior requirement for a firewell. On June 4, 1991, the Planning Board closed the final public hearing, and granted conditional final approval on the subdivision. One condition of approval was that a passbook, Letter of Credit or the equivalent in the amount of $46,285.00, be accepted by the Town Board. The Planning Board's resolution of conditional final approval reduced the required bond estimate by $10,000 to reflect the elimination of the firewell. Although the Planning Board did not do a separate resolution reducing the required bond estimate, it was discussed during the public hearing, and the reduced bond estimate was accepted by the Board in their conditional approval. At this time, everthing is in order for a final hearing. I'll ask if there are any objections to this subdivision? Hearing none, are there any endorsements of this subdivision? Mr. Robert S. Kozakiewicz for Peter Danowski - For the applicant. I would ask the Board to close the hearing, I would obviously like to have this thing moved forward and t© finally get it resolved. However, in so doing, I would like to also, without prejudice, indicate our strong opposition to the inclusion at this very late time of the firewell requirement. The Board is very familiar with this application in as much as the initial application was submitted back in November of 1985, and has had a great deal of time to address this subdivision. We are only asking for three lots as a minor and there is a great deal of time and effort spent on this thing and we are quite concerned and quite adamant about the eleventh hour addition of the firewell in this case. I would point out to the Board that there is a fire hydrant located very close by and I · don't know if the Board is even aware of this fact. What I would like to hand up to the Board is a copy of the fire or homeowners insurance policy that was issued to Ms. Bailey. It shows quite clearly that the property, which is her property, which the Board has as part of the map, shows that it is only located approximately 400 feet from a fire hydrant which in this case would be located on the west side of Skunk Lane and south of Eugene's Road. We feel that the requirement of a firewell at this point and time is erroneous, unreasonable and an arbitrary decision by the Planning Board. I would just like to approach this point and just give you a copy of the homeowners insurance policy. I understand that this may not be a decision that the Board can address at this point and time and would like to keep that avenue open. I do understand that also under the Town Code PLANNING BOARD 4 APRIL 22, 1t there is a certain provision whereby a variance can be granted from strict application of the various roadway specifications and otherwise and again, for the reasons I set forth earlier, the fact that this application is a minor as previously pointed out sometime last year, Ms. Bailey who proposes the subdivision as Kay Dee Estates hopes someday that what she can do with the property is give these lots to family members. The requirements imposed upon her in this case have just made it almost unreasonable for her to be able to go forward with the application, not to mention the late requirement in this instance of a firewell. I would ask the Board, as I indicated, to close the hearing but certainly to grant us relief either by variance or otherwise, wherein we are not required to do firewells. Mr. Orlowski: Have you had discussions with the fire commissioners? Mr. Kozakiewicz: Well, no. I was unaware that we should. Mr. McDonald: Can you indicate where the firewell that you are talking about is? Mr. Kozakiewicz: May I approach? It is a fire hydrant. Mr. McDonald: It is not a hydrant, it is probably a firewell right. There is no public water there so I am assuming it is probably a well. Mr. Kozakiewicz: I haven't been to the site. The applicant advises me that there is a body of water, a small pond there they use to feed the fire hydrant. Mr. McDonald: Do you mean the pond down next to A1 Krupski's? Ms. Bailey: I suppose. Mr. McDonald: That is on private property right, that pond? Ms. Bailey: The pond must be. Mr. McDonald: well? Is that what you are referring to or is it a fire Mr. Kozakiewicz: Is it a firewell or a fire hydrant? Is there a fire hydrant at the site? Ms. Bailey: It is a fire hydrant. Mr. McDonald: O.K., thank you. What is the road spec problem? Mr. Kozakiewicz: The road spec we have addressed and I believe it has been answered. Last year there was a concern for the need for curbing. PLANNING BOARD APRIL 22, 19' Mr. McDonald: There was a problem with the current road spec. Mr. Kozakiewicz: I know and it has been changed and we are happy that you were able to do this for us in this case because it was a major problem as it existed before. The width and the curbing requirements. Mr. McDonald: The only impediment in your clients mind at this time is the firewell? Mr. Kozakiewicz: That is correct. Mr. Orlowski: We can hold this hearing open. The disussion will have to be with the fire districts since they make all the recommendations for fire protections in all the subdivisions. The last review by Sidney B. Bowne's office (dated 3/28/90) indicated that three (3) modifications would be necessary. The first two (2) still apply. The third change was to increase the number of leaching basins. This review was performed when a 20' pavement width was required. Since that time the road surface requirement has been reduced to 16' in width and therefore this modification to increase the number of basins will not be necessary. I have enclosed a copy of SBB's 3/28/90 report along with a copy of the updated Bond Estimate that I have prepared. If you have any questions concerning this matter please call my office.
