I built the fi'ont building in 1984. I ran my business, Shamrock Tree Expert Co., out of that building for eight or nine years. Shamrock is in the business of tree maintenance. Shamrock is a service business. The Shamrock equipment and office was located at the premises. When Shatmock moved to another location, I leased the building to aa awning company and then a package and mailing company, and finally to a Sllaall equipment sales and repair company, Northeastern Lawn and Garden Equipment, which leased the premises fi.om me until early 2004 when I sold the premises to FI-IV 1J C d/b/a Featherhill Village. Northeastern Lawn and Garden Equipn~ut had an office at the premises and used the premises to store it's rental equipment and also sold on the retail market equipment to the public. The back building was constructed in 1990. It was ori~nally leased to S&L Irrigation for storak~e and wareh0-~in? of irrigation supplies. It was then leased to Hallock Produce as a storage and shipping point for produce. Hallock Produce ~ vegetable product to restaurants and warehoused the product at the premises. Finally, the back building was leased by the equipment comvaay, Northeastern, that was already leasing the fi.out building. The question of whether an action may be significant is not always easy to answer. Frequently, there am aspects of a project that am subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough to allow intrnductlon of information to fit a project or action. Full FAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and infoffnation about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3, Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whebher it is a potentially-large impact. The form also identifies whethe~ an impact can be mitigated or reduced. Part 3: ff any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. Documentation from the DOT stating that the original curb cut was constructed satisfactorily, even though some items were never installed, and/or that they consider this cut to be pre-existing, indicating that it does not require their review. DOT confirmation in wdting should be submitted to the Planning Board by the applicant. It should be up to the DOT to decide if this project requires a new curb cut permit. Drainage Design Calculations should include all impervious surfaces created by development. If loading docks and other developed areas exist they should be included into the drainage calculations. Since his letter was addressed to the Planning Board, it seems appropriate that our response should be to the Board, and I would appreciate it if you would pass along the enclosed revised plan to Mr. Richter as soon as possible:.__There is also a copy for your file. _ Here are our comments, numbered as were his paragraphs: According to Tony Leung of the DEC in Stony Brook and Dave Gaspar of the DEC in Albany, a SPDES permit is not required for this project as long as the area of soil ac- tually disturbed does not exceed one acre. We submit that the soil disturbance will not exceed one acre. The buildings and the vegetated area on the SW of the property would not be regraded and they amount to at least 0.25 acres. The property is 1.16 acres, leaving only 0.91 acres which could be regraded. 2. Details of the proposed curb cut have been added to the plan, attached. 3. Prior to an approval of the site's access and issuance of a New York State Highway Work Permit, the following items must be addressed: In recent years, many states have employed access management as a major technique to address conflicts between through traffic and that generated by developments. The goals of access management are to limit the number of access points, separate conflict points and remove turning traffic from through movements. New York State is utilizing this technique to minimize impacts to State highways. We recommend, therefore, that cross access to this site be obtained from adjacent properties. If this is not presently possible, it should be shown on the plans for implementation as part of future redevelopment. The sidewalk, curb and driveway shall be re-constructed to meet current standards. All sidewalk, curb and driveway details shall be referenced to NYSDOT specification item numbers. Please find the attached plan view of the site and existing sanitary systems. The existing system for building #1 has a 900-gailon septic tank and 2-8' diameter 6' effective depth leaching pools. The septic tank was pumped at inspection and was found to be in excellent condition and in working order. PROTECTIVE LIABILITY INSURANCE COVERAGE ~ermittee must have protective liability insurance coverage in accordance with Department requirements. Work must start within 30 days from date of permit. Notify area gas distributors 72 hours prior to any blasting. Notify Utility Companies with facilities in work area (permission must be obtained befo~'e doing work affecting utilities' facilities) before starting work. Nqtify land owners of abutting lands, before disturbing trees. Notify Department of Transportation at conclusion of work and return original copy of permit to Regional Office. Annual Maintenance Permit Notifications: Notify by telephone the District or Resident Office, one week in advance, each time regular maintenance work ia to be performed. In emergencies, notification by telephone should be mede the next work day. 4. SITE CARE AND RESTORATION An Undertaking, a bend or certified check in an amount designated by the Department of Transportation may berequlred by the Regional Office, before a permit is issued, to guarantee r~steration of the site to its original condition. If the Department is obliged to restore the site of its original condition, the costs to the Department will be deducted from the amount of the permittee's guarantee deposit at the conclusion of the work. 'The permittee ia responsible for traffic protection and maintenance, including adequate use of signs and barriers during work and evening hours. Anyone working within the R.O.W. will wear an orange vest and hard hat. No unnecessary obstruction is to be left on the pavement or the right of way or in such a position as to block warning signs during or between work hours. No work shall be done to obstruct drainage or divert creeks, water courses or sluices onto the right of way. All faleework must be removed and all excavations must be filled in and restored to the satisfaction of the Regional Traffic Engineer. 5. COSTS INCURRED BY ISSUANCE oF'THIS PERMIT All costs beyond the limits of the pro~ective liability insurance, surety deposits, etc., are the responsibility of the permittee. The State shall be held free of any costa incurred by the issuance of this permit, direct or indirect. 6. SUBMITTING WORK PLANS The applicant will submit work plans and/or a map as required by the Department. This shall include such details as measurements of driveways with relation to nearest corner, positions of guys supporting poles and a schedule of the number of poles and feet of excavation necessary for completion of the work on the State right of way. A description of the proposed method of construction will be included. Plan work with future adjustments in mind, as any relocation, replacement or removal of the installation authorized by this permit and made necessary by future highway meintenance, reconstruction or new construction, will be the respon- sibility of the permittee. The permJttee must coordinate his work with any state construction being conducted. 7. TRAFFIC MAINTENANCE Traffic shall be maintained by the permittee on the highway, in a safe manner, during working and non-working hours until con- struction is completed. Suitable safeguards, to reduce conditions dangerous to life, limb and property to a minimum, must be pro- vided by the parmittee (including flagmen when requested by the Department). 8. COST OF INSPECTION AND SUPERVISION If, in the accounts kept by the Department, costs of supervision are found to be exceedlng~y high, the Department re- serves the right to bill the permittee for actual expenses incurred by the supervision and inspection of the permittee's project. 9.
