HomeMy WebLinkAboutL 5733 P 9 „,5733PACE 09 THIS INDENTURE, made the 31 qday of Nineteen hundred and sixty-five between FISTS ISLAND ESTATES, INC., a New York corporation, having its principal office at 14 Eget 52nd Street, in the City, County and State Of New York, hereinafter called the grantor, party of the first part, and CCHFORT P. O'CONNOR, residing at 3 6 :75 Ctln fi fc C h 0 ei- , Bedford Hills, Westchester County, s New York, hereinafter called the grantee, party of the second part: WITNESSETH, that the party of the first part, in consid- eration of One Hundred Dollars ($100.00), lawful money of the -- United States, and other good and valuable consideration paid by the party of the second part, does hereby grant and releas unto the party of the second part, her heirs and assigns forever, ALL that lot or parcel of land in the Town of Southold, Suffolk County, State of New York, being a part of that portion of Fishers Island belonging \ to the grantor (which portion is hereinafter called the "Park") lying easterly of the following line, viz.: o BEGINNING at the southeasterly corner of land w. ee owned by the United States, known as the Fort H. G. Wright Military Reservation, Mount Prospect Tract, on the shore of Block Island Sound or the Atlantic Ocean (as said Tract was constituted prior to the extension thereof by the acquisition of additional lands in condemnation proceedings instituted in 1942) and running thence northerly following the East boundary of the said tract of land of the United States (as same was constituted prior to such extension thereof) to the southerly line of East End Road (sometimes called Oriental Avenue) and which point is the northeasterly corner of said tract of land of the United States (as same was constituted prior to such extension thereof), thence crossing the East End Road and following the same course as the last to the shore of West Harbor or Fishers Island Sound: Said lot or parcel of land being bounded and described as follows: BEGINNING at a monument on the Easterly line of a private road of the grantor leading to the East End, said monument being one thousand four hundred sixty- nine and sixty hundredths feet North of a point which is one hundred sixty-four and ten hundredths feet East of another monument marking the U. S. Coast and Geo- detic Survey Triangulation Station "NIN" (which said NIN” monument is located near the Western end of a ridge overlooking the South shore of Fishers Island and on the highest point between Chocomount and Mount Prospect and lies South 45 degrees 17 minutes 26 seconds East of North Dumpling Light in Fishers Island Sound); and thence running North 70 degrees 07 minutes 30 seconds East two hundred twenty-three and eighty- five hundredths feet to a point at the shore of Island Pond; thence North 71 degrees 45 minutes 20 seconds West two hundred fifty-five and sixty-five hundredths feet to a point on the Easterly line of UBERMLPVT 2 said road, said point being one thousand six hundred twenty-five and seventy-three hundredths feet North of a point which is one hundred thirt�­one and eighty- two hundredths feet East of said NIN' monument; thence along the Easterly line of said road South 14 degrees 24 minutes 40 seconds East one hundred seven and thirty-two hundredths feet to a point of curve to the right whose radius is one hundred eighty-one and thirty-eight hundredths feet and the direction of whose radius at that point is South 75 degrees 35 minutes 20 seconds West; and thence Southwardly along the Easterly line of said road, following the arc of said curve, fifty-two and sixty-eight hundredths feet to the point of beginning; containing 0.40 of an acre, more or less. EXCEPTING from the grant of the premises hereby conveye and RESERVING to the grantor, its successors and assigns a trip of land five feet wide bounded on the Westerly side there of by the third and fourth courses of the property above described, being along the Easterly line of said road, bounded on the Easterly side by a line running parallel to said Easter ly line of said road, measured at right angles thereto at all points five feet Easterly therefrom and bounded on the North- erly and Southerly sides by the second and first courses, respectively, of the property above described, said strip of land to become a part of said road for all highway purposes and for the erection thereon of poles to support wires for the transmission of electricity for light, heat, telephone and other purposes, and for the construction, operation and main- tenance of pipe lines or conduits under the surface of said reservation for any lawful purpose whatsoever. EXCEPTING from the grant of the premises hereby con- veyed and RESERVING to the grantor, its successors and assigns all right, title and interests of any and every nature in and to all land under the waters of Island Pond and in and to the waters of Island Pond and all the water rights upon or which would otherwise be appurtenant to the demised premises; it being intended and covenanted and agreed that no right of any nature to any land covered by the waters of Island Pond or to the use or control thereof or to the waters of said Island Pond or to the use or control of any of said waters, shall pass by this conveyance, that the party of the first part and its successors and assigns shall have the right to use in any manner and to raise or lower or otherwise control in any manner the waters of said Island Pond as may at any time or times or from time to time be found expedient, that the rights of the party of the second part and her heirs and assigns in and to the premises hereby conveyed shall be limited and bounded by the shore of said Island Pond, as the same may var from time to time or be regulated by the party of the first part, its successors or assigns, and that any use of said waters, if permitted at any time or times or from time to time by the party of the first part, its successors or assigns, and of the land under the same shall be subject to the regula- tions made by the party of the first part, its successors or assigns, at any time or times or from time to time. TOGETHER with an easement to the grantee, her heirs and assigns, for ingress to and egress from the premises here by conveyed over and along such private roads as now or may hereafter exist connecting the premises hereby conveyed with the public highway; provided, however, that the grantor hereb
