HomeMy WebLinkAboutL 4937 P 72 tw4937 em 72 v V THIS IN�NT[ made the 11th day of Ja umm N1ne- �_� teen hundred and six to: FISHERS ISLAND ESTATES, INC„ a New York corporation, having its principal office at 14 Boa o r• 52nd Street, in the City, County and State of New York, herei after called the grantor, party of the first part, and ELLA A W MIL3ANE FOSHAY, residing at 8 East 81st Street, New York 28, New York, hereinafter called the grantee, party of the second part; WITNESSETH: That the party of the first part, in consideration of One Hundred Dollars (;100.00), lawful money of the United States, and other good and valuable considera- tion paid by the party of the second part, does hereby grant and release unto the party of the second part, her heirs and assigns forever, ALL that lot or parcel of land in the Town of South- old, Suffolk County, State of New York, being a part of that portion of Fishers Island belonging to the grantor (which portion 1s hereinafter called the Park") lying easterly of the following line, viz.: BEGINNING at the southeasterly corner of land now or formerly owned by the United States, known as the Fort H. G. Wright Military Reservation, Mount Prospect Tract, o the shore of Block Island Sound or the Atlantic Geean (as said Tract was constituted prior to the extension thereof by the acquisition of additional lands in condemnation pro- ceedings instituted in 1942) and running thence northerly i following the East boundary of the said tract of land now or formerly of the United States (as same was constituted prior to such extension thereof) to the southerly line of East End Road (sometimes called Oriental Avenue) and which point is the northeasterly corner of said tract of land now or formerly of the United States (as same was consti- tuted prior to such extension thereof), thence crossing the East End Road and following the same coot as as the las to the shore of West Harbor or Fishers Island Sound; Said lot or parcel of land being bounded and des- cribed as follows: BEGINNING at a point on the Southerly side of a road, said point being two hundred and forty-one and seven - seven hundredths feet North of a point which is eight hun- dred and thirteen and one hundredth feet East of a monu- ment marking the United States Coast and Geodetic Survey Triangulation Station East End 2" (which said East End monument Is located on the summit of the highest hill East of East Harbor on Fishers Island, N. Y. and lies South fifty-four minutes West of Latimer Reef Light in Fishers Island Sound), said point of beginning also being located South three degrees fifty-four minutes and fifty seconds West five feet from a stone monument set on the formerly Southerly side of said road; and running thence, along the newly established Southerly side of said road, South eighty-four degrees four minutes and ten seconds East one n,ndred and sixty-six and four hundredths feet; thence South twenty-five degrees four minutes and no seconds East fifty-six and seventy-seven hundredths feet to a stone mon sent; thence South forty-two degrees twenty-three minutes and ten seconds East four hundred and seventy-three and P ieEw4937 wA 73 :'lfty-nine hundredths feet to the shore of Block Island Sound; thence, with the meanders of said Sound, South fifty-six degrees twenty-three minutes and no seconds West three hundred and eighty-five and twenty-six hundredths feet and Soatn. sixty-eight degrees forty-eight minutes and twenty seconds West seventy-three and eighteen hundredths feet to a stake; thence North fourteen aegrees twenty-nine minutes and fifty seconds West five hundred and nineteen and slzty-three hundredths feet to a stone monument; and thence North three degrees fifty-four minutes and fifty seconds East one hundred and fifty-five and twenty-nine hundredths feet to the place of beginning; containing four and twenty-one hundredths acres, more or less. TOGETHER with an easement to the grantee, her heirs and assigns, :or ingress to and egress from the premises hereby oonveyed over and along such private roads as now or may hereafter exist connecting the premises hereby conveyed with the public highway; provided, however, that the gran- tor hereby reserves the right to change the location, route or grade of said roads from time to time, provided that such change shall not prevent adequate access to the premi- ses hereby conveyed. .RE.SERVINd to the grantor, its successors and as- signs, from the grant of the premises hereby conveyed, or. easement and right of way within a strip of land five feet wide along the first course of the boundaries of said premises for the erection thereon of poles to support wires for the t.ansmission of electricity for light, heat, telephone and other purposes, and for the construction, operation and maintenance of pipe lines or conduits under the surface of said reservation for any lawful purpose whatsoever, but the grantor shall have the right to release the premises here- by conveyed from these particular easements and rights of way; provided, however, that whenever the surface of the ground shall be disturbed by the grantor, its successors or assigns, for the eurpose of constructing or repairing any such pole line, pipe line or conduit, it shall become the duty of the grantor or its successors or assigns, fort with, at its or their own expense, to repair and restore the surface of the ground so disturbed to substantially the same condition as shall have existed before the time of such disturbance.
