STONE, residing at Maple Avenue (no street address), - Katonah, New York, party of the first part, and SUSANNA S. ' -�47 DOYLE, residing at 210 West 78th Street, New York, N.Y., party of the second part: 'WITNESSETH, that the party of the first part, in con- ,�.� � sideration of Ten ($10.) Dollars, lawful money of the United States, and other good and valuable consideration paid by - the party of the second part, does hereby grant and release unto the party of the second part, her distributees and assigns forever, ALL that certain tract or parcel of land with the buildings thereon located at Fishers Island, Town of Southold, Suffolk County, State of New York, bounded and described as follows: BEGINNING at a stone monument on the Northwesterly line of Madeline Avenue, said point being 4363.45 feet North of a point which is 412.04 feet West of another monument marking the U.S. Coast and Geodetic Survey Triangulation Station "PROS"; thence North 800 54, 15" East 60.0 feet along the Northwesterly line of said road; thence North 90 05' 45" West 405.46 feet; thence South 860 44' 40" West 60.31 feet; thence South 90 05' 45" East 261.56 feet to a stone monument; thence continuing South 90 05' 45'' East 150.0 feet to the point of beginning, containing 0.54 acres more or less. SUBJECT HOWEVER to a perpetual right of way or easement heretofore granted to Bert Scagliotti and Leo Valentini, co-partners doing business under the firm name and style of Fashion Cleaners and Launderers, for the maintenance of certain underground pipe leading from the present existing laundry across the rear of the above described premises, for the purpose of carrying Waste water from the above mentioned laundry to West Harbor, and subject to the rights reserved to Fishers Island Farms, Inc., its successors or assigns, contained in its deed to the grantor herein, dated January 29, 1951, to enter upon the above described premises for the purpose of inspecting, maintaining, repairing or re-installing said pipe line. SUBJECT HOWEVER TO THE FOLLOWING COVENANTS AND RESTRICTIONS which shall run with the land and shall be binding upon the grantee, her distributees and assigns. 1. The above described premises shall be used for residential purposes only. 2. The buildings to be erected on the above described premises shall be limited to two (2) one-family dwelling houses and accompanying garages. 3. Neither the above described premises nor any build- ing erected thereon, shall be used for any commercial purpose or use whatsoever, excepting however, rental for residential purposes. SUBJECT FURTHER HOWEVER TO: 1. Any and all zoning restrictions or ordinances imposed by any Town, County, State or Federal Government Agency of competent jurisdiction. -1- F u � 2. To any and all easements, or rights of record, granted for the maintenance of any street, railroad, electric power lines, telephone lines, conduits, water mains, sewage mains or any other public service utility insofar as the same affects the above described premises. 3. Any state of facts an accurate survey or personal inspection may disclose. together with the appurtenances and all the estate and rights of the party of the first part in and to said premises. SAID PREMISES being the same as those conveyed to the party of the first part by Fishers Island Farms, Inc., by deed dated January 29, 1951, recorded in the Suffolk County Clerk I office, Riverhead, New York, on May 29, 1951, in Deed Liber 3220 page 599. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, her distributees and assigns forever. The party of the first part, in compliance with Section 13 of the Lien Law, covenants that she will receive the con- sideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and thatshe will apply the same first to the payment of the cost of the improvement before using any part of the total Of the same for my other purpose.
