y THIS INDENTURE, made the 7 u day of fe„„ _&i
Nineteen hundred and sixty-five, between FISHERLAND
ESTATES, INC., a New York corporation, having its principal
i. °e office at 14 East 52nd Street, in the City, County and State
of New York, hereinafter called the grantor, party of the
first part, and COLBY M. CHESTER, 3rd, residing at Close Road
(no street number) Greenwich, Connecticut, hereinafter called
the grantee, party of the second part:
WITNESSETH, that the party of the first part, in
consideration of One Hundred Dollars (100.00), lawful money
of the United States, and other good and valuable considera-
tion paid by the party of the second part, does hereby grant
and release unto the party of the second part, his heirs and
assigns forever,
ALL that lot or parcel of land in the Town of
Southold, Suffolk County, State of New York, being
a part of that L)ortion of Fishers Island belonging
to the grantor which portion is hereinafter called
the "Park") lying easterly of the following line,
viz.:
BEGINNING at the southeasterly corner of land
now or formerly owned by the United States, known
as the Fort H.G. Wright Military Reservation, Mount
Prospect Tract, on the shore of Block Island Sound or
the Atlantic Ocean (as said Tract was constituted
prior to the extension thereof by the acquisition
of additional lands in condemnation proceedings
instituted in 1942) and running thence northerly
following the East boundary of the said tract of
land now or formerly of the United States (ae same
was constituted prior to such extension thereof)
to the southerly line of East End Road (sometimes
called Oriental Avenue)) and which point is the
northeasterly corner of said tract of land now or
formerly of the United States (as same was con-
stituted prior to such extension thereof), thence
crossing the East End Road and following the same
course as the last to the shore of West Harbor or
Fishers Island Sound;
Said lot or parcel of land being bounded and descr ed
as follows:
BEGINNING at a point on the Southeasterly line
of a private road of the grantor, said point being
Two hundred sixty-five and fifty-three hundredths
feet South of a point which is One thousand fifty-
eight and ninety-eight hundredths feet East of a
monument marking the United States Coast and Geodetic
SurveSurvey Triangulation Station "CHOCOMOUNT 2" (which
said

the highest hill on Fishers Island, N. Y. about two
and one-quarter miles West of the Eastern and of
Fishers Island and lies South 79 degrees 29 minutes
46 seconds East of North Dumpling Light in Fishers
Island Sound); and thence running South 23 degrees
45 minutes 5U seconds East Four hundred seventy-
two and forty-one hundredths feet to a monument on
the northwesterly line of another private road of the

grantor, said monument bein„ on a curve to the right
whose radius is Two hundred sixty-five and nincty-
four hundredths feet and the direction of whose radius
at that point is North 53 degrees 46 minutes 20
seconds West; thence Southwestaardly along said road
line, following the arc of said curve Twenty-five and
no hundredths feet; thence along said road line, South
41 degrees 36 minutes 50 seconds West One hundred
sixty-five and sixty-two hundredths feet; thence along
said road line North 83 degrees 43 minutes 40 seconds
West One hundred fifteen and forty-two hundredths feet
to the end of said road; thence along the end of said
road South 15 degrees 39 minutes 00 seconds West
fifty and no hundredths feet to a drill hole in a
boulder, being in the line of lands now of the grantee
thence along said lands of the grantee the following
two courses: (a) North 18 degrees 32 minutes 50
seconds West Two hundred thirty-six and seventy-six
hundredths feet to an iron pipe, and (b) North 20 deg
rees 32 minutes 30 seconds West Two hundred ninety-sev n
and eighty hundredths feet to a point on the said
Southeasterly line of the first mentioned road, said
point being on a curve to the left whose radius is
Four hundred fifty-six and sixty-one hundredths feet
and the direction of whose radius at that point is Nor h
9 degrees 08 minutes 50 seconds West; thence along
said road line following the arc of said curve Two
hundred seventy-four and fifty-five hundredths feet
to the point of beginning; containing Three and thirty
six hundredths acres, more or less.
EXCEPTING from the grant of the premises above
described and RESERVING to the Grantor, its successors
and assigns a strip of land 5 feet wide bounded on the
Southeasterly side thereof by the lines of the second
and third courses of said premises being along the
Northwesterly side of a private road of the grantor
and bounded on the Northwesterly side thereof by a
line running parallel to said second and third courses
measured at right angles thereto at all points 5
et Northwesterly therefrom) and lines in continuatio
thereof and bounded on the Northeasterly side thereof
by the first course of said premises and on the South-
westerly side thereof by the fourth course of said
premises, said strip of land to become a part of said
private road for all highway purposes and for the
erection thereon of poles to support wires for the
transmission of electricity for light, heat, telephone
and other purposes, and for the construction, operatio
and maintenance of pipe lines or conduits under the
surface of said reservation for any lawful purpose
whatsoever; but granting to the grantee, his heirs
and assigns an easement over said 5 foot strip from
the premises hereby conveyed out to said private road
of the grantor. Whenever the surface of the ground of
said strip of land shall be disturbed by the grantor,
its successors or assigns, for the purpose of construct-
ing or repairing any such Dole line, pipe line or conduit,
it shall bsa me the duty of the grantor or its success-
ors or ass a, forthxith, at its or their own expense,
to repair and restore the surface of the ground so
