THIS INDENTURE, made the �8" day of .d,
Nineteen hundred and sixty-four, between FISHERS ISLAND
ESTATES, INC., a New York corporation, having its principal
•'1 office at 14 East 52nd Street, in the City. County and State
I of New York, hereinafter called the grantor, party of the
first part, and Lily Cushing Boyd residing at Fishers Island,
New York (no street or street number), hereinafter called
the grantee, party of the second part;
WITNESSETH: That the party of the first part, in
consideration of One Hundred ($100) Dollars, lawful money
of the United States, and other good and valuable considera-
tion paid by the party of the second part, does hereby grant
and release unto the party of the second part, her heirs
and assigns forever,
ALL those certain lots or parcels of land in the
Town of Southold, Suffolk County, State of New York,
being a part of that portion of Fishers Island belong-
ing to the grantor (which portion is hereinafter called
the "Park") lying easterly of the following line, viz.:
BEGINNING at the southeasterly corner of land
now or formerly owned by the United States, known as
the Fort H. G. Wright Military Reservation, Mount
Prospect Tract, on the shore of Block Island Sound
or the Atlantic Ocean (as said Tract was constituted
prior to the extension thereof by the acquisition of
additional lands in condemnation proceedings instituted
in 1942) and running thence northerly following the
East boundary of the said tract of land now or for-
merly of the United States (as same was constituted
prior to such extension thereof to the southerly line
of East End Road (sometimes called Oriental Avenue)
and which point is the northeasterly corner of said
tract of land now or formerly of the United States
(as same was constituted prior to such extension
thereof), thence crossing the East End Road and follow-
ing the same course as the last to the shore of West
Harbor or Fishers Island Sound;
Said lots or parcels of land being bounded and
described as follows:
HCMESITE #1
BEGINNING at a concrete monument at the Southwest-
erly end of a private road of the Grantor, said monument
being sixteen hundred thirty-nine and ten hundredths
feet North of a point which is thirteen hundred forty-
four and fourteen hundredths feet West of another monu-
ment marking the United States Coast and Geodetic Sur-
vey Triangulation Station "NIN" (which said NIN" monu-
ment is located near the Western end of a ridge over-
looking the South shore of Fishers Island and on the
highest point between Chocomount and Mount Prospect
and lies South 45 degrees 17 minutes 26 seconds East
of North Dumpling Light in Fishers Island Sound); and
thence running North 44 degrees 46 minutes 30 seconds
West two hundred thirty-five and twenty-one hundredths
feet to the shore of Fisherslsiand Sound; thence follow
ing the meanders of said shore line the following tie lin e
two courses: (1) South 37 degrees 42 minutes 20 seconds

West two hundred four and fifty-nine hundredths feet
and (2) South 51 degrees 51 minutes 20 seconds West
one hundred forty-six and eleven hundredths feet;
thence South 47 degrees 18 minutes 00 seconds East
two hundred fifty-nine and seventeen hundredths feet;
thence North 46 degrees 49 minutes 30 seconds East
three hundred thirty-three and eighty-two hundredths
feet to a point of the end of said road; said point
being sixteen hundred six and sixty-two hundredths
feet North of a point which is thirteen hundred fifteen
and ninety-three hundredths feet West of said "NIN"
monument; thence along said road line North 40 degrees
58 minutes 40 seconds West forty-three and one hun-
dredth feet to the point of beginning, containing 1.97
acres, moreor less.
HQMESITE #2
BEGINNING at a point at the Southwesterly end of
a private road of the Grantor, said point being six-
teen hundred six and sixty-two hundredths feet North
of a point which is thirteen hundred fifteen and
ninety-three hundredths feet West of a monument mark-
ing the United States Coast and Geodetic Survey Tri-
angulation Station "NIN" (which said "NIN" monument
is located near the Western end of a ridge overlooking
the South shore of Fishers Island and on the highest
point between Chocomount and Mount Prospect and
lies South 45 degrees 17 minutes 26 seconds East of
North Dumpling Light in Fishers Island Sound); and
thence running along said road line South 40 degrees
58 minutes 40 seconds East forty-three and one hun-
dredth feet; thence South 18 degrees 00 minutes 00
seconds East two hundred forty-two and fifty-four
hundredths feet; theSouth 62 degrees 40 minutes
20 seconds West three hundred eight and six hundredths
feet; thence North 22 degrees 08 minutes 00 seconds
West one hundred ninety and sixty-four hundredths
feet; thence North 46 degrees 49 minutes 30 seconds
East three hundred thirty-three andeighty-two hun-
dredths feet to the point of beginning, containing
I 1.70 acres, more or less.
HCMESITE #3
BEGINNING at a point on the Northwesterly side
of a private road of the Grantor, fifty feet in width,
said point being eleven hundred sixty-three and thir-
teen hundredths feet North of a point which is eleven
hundred fifty-five and thirty-four hundredths feet
West of a monument marking the United States Coast
and Geodetic Survey Triangulation Station "NIN" (which
said "NIN" monument Is located near the Western end
of a ridge overlooking the South shore of Fishers
Island and on the highest point between Chocomount
and Mount Prospect and lies South 45 degrees 17
minutes 26 seconds East of North Dumpling Light in
Fishers Island Sound); and thence running North 23
degrees 44 minutes 20 seconds West one hundred
eighty-six and ninety-seven hundredths feet; thence
South 62 degrees 40 minutes 20 seconds West two hun-
dred eighty-eight and no hundredths feet; thence South
22 degrees 53 minutes 50 seconds East one hundred
sixty-nine and ninety hundredths feet to said road

line; thence Northeastwardly along said road line and
following the are of a curve to the left, whose radius
is ninety seven hundred eighty-six and four hundredths
feet, a distance of two hundred ninety and no hun-
dredths feet to the point of beginning, containing
1.16 acres, more or less.
TOGETHER with an easement to the grantee, her heirs
and assigns, for ingress to and egress from said lots above
described, over and along such private roads as now or may
hereafter exist connecting the premises hereby conveyed with
the public highway; provided, however, that the grantor here-
by reserves the right to change the location, route or grade
of said roads from time to time, provided that such change
shall not prevent adequate access to the premises hereby
conveyed.
EXCEPTING AND RESERVING to the grantor from the
grant of Homesite #2 and Homesite #3, for the benefit of
the grantor, its successors and assigns, a perpetual easement
for the repair, maintenance and operation of the existing
underground water infiltration line leading to Barlow Pond
and the construction, repair, maintenance and operation at
any time or from time to time, of any underground water in-
filtration line in replacement of any such line, now or here-
after existing, in, to, under and over a certain right of way
ten feet wide, which crosses portions of said Homesite #2 and
Homesite #3a measured five feet on both sides of the center
line of said right of way, said center line being described
as follows:
BEGINNING at a point in the second course of
Homesite #2, as above described, which point is
North 18 degrees 00 minutes 00 seconds West one
hundred feet from the Southeasterly end (being the
terminus) of said second course of Homesite #2, as
above described, and thence running across portions
of Homesite #2 and Homesite #3 South 27 degrees 33
minutes 50 seconds West a distance of four hundred
eleven and no hundredths feet to a point on the
Southwesterly line of Homesite #3•
AND THE GRANTEE HEREBY COVENANTS for itself, its successors
and assigns, (1) that said easement and these covenants
shall attach to and run with and burden Homesite #2 and Home-
site #3; and (2) that the grantor, its successors and assigns
shall have the right to enter upon said Homesite #2 and
Homesite #3 for ingress to and egress from said right of way
for the purposes of such easement, provided, however, that
whenever the surface of the ground shall be disturbed by the
grantor, its successors or assigns for the purpose of such
easement, it shall become the duty of the grantor, or its
successors or assigns, forthwith, at its or their own ex-
pense, to repair and restore the surface of the ground so
disturbed to substantially the same condition as shall have
existed before the time of such disturbance.
RESERVING to the grantor, its successors and as-
signs, from the grant of the premises hereby conveyed, an
