THIS INDENTURE, made the day of
vj .p nineteen hundred and seventy-eight between
FISHERS ISLAND DEVELOPMENT CORPORATION, a corporation
organized under the laws of the State of New York, with
its principal place of business c/o Morgan Stanley & Co. ,
1251 Avenue of the Americas, in the City, County and
State of New York, hereinafter called the grantor , party
of the first part, and ROBERT J GENIESSE of 299 Park
Avenue , New York , New York hereinafter called the
grantee, party of the second part:
WITNESSETH, that the party of the first part,
in consideration of Five Hundred Four Dollars ($504.00) ,
lawful money of the United States paid by the party of
the second part, does hereby grant and release unto the
party of the second part, his heirs and assigns forever ,
ALL that lot or parcel of land, with the
buildings and improvements thereon, in the Town of
Southold, Suffolk County, State of New York, being a part
of that portion of Fishers Island belonging to grantor
(which portion is hereinafter called the "Park") lying to

Beginning at a monument at the Northeast corner
of the herein described tract, said monument being
located 4341. 43 feet North of a point which is 1810 . 73
Dist. 1000 feet East of another monument marking the United States
Coast and Geodetic Survey Triangulation Station "NIN" and
Sec. 3 thence running North 72° 08 ' 23" West 140 .00 feet to an
Block 6 iron pipe; thence South 320 30 ' 00" West 250 .00 feet to a
point; thence South 700 46 ' 44" East 238 . 23 feet to a
Lot pt. 3 point; thence North 9° 49 ' 03" East 250. 00 feet to the
monument at the point of beginning.
Containing 1. 06 acres , more or less.
Together with a right of way 15.00 feet in
0000 width extending Southeasterly from the above described
X tract, and running in part along the existing driveway,
CV to the main road to the East End, the center line of said
V-1 right of way being described as follows:
Beginning at a point on the Southeasterly
boundary of the above described tract, said point being
located South 90 49 ' 03" West 15. 00 feet from the
monument at the Northeast corner of the above described
tract and thence running South 570 09 ' 30" East 82. 29
feet to a point; thence South 30" 37 ' 45" East 119.63

Beginning at an iron pipe on the Northeasterly
line of an existing road, said iron pipe being located
3795.06 feet North of a point which is 1631. 02 feet East
of a monument marking the United States Coast and
Geodetic Survey Triangulation Station "NIN" and thence
running North 290 25 ' 50" East 250.00 feet to a point; -
thence North 90 49 ' 03" East 83 . 51 feet to a point; -
thence North 70° 46 ' 44" West 238 . 23 feet to a point;
thence South 32° 30 ' 00" West 60. 00 feet to a point;
thence South 5° 21 ' 05" East 290 . 03 feet to an iron pipe
on the Northeasterly line of the aforementioned road
said iron pipe being at a point of curve to the right
having a radius of 436. 00 feet and the direction of whose
radius at that point is South 160 08 ' 13" West; thence
running Southeastwardly along the arc of said curve a
distance of 101. 16 feet to the point of beginning

rights of the party of the first part in and to said
premises;
SUBJECT to any state of facts an accurate
survey may show; and
SUBJECT to covenants, restrictions, easements,
rights, grants, and declarations of record, if any, and
easements for use of public utilities; and
SUBJECT to all applicable laws and regulations
of Federal, state and local governmental authorities;
RESERVING to the grantor herein from the grant
of the land and premises hereby conveyed easements and
rights of way within a strip of land approximately five
feet wide for the erection thereon of poles to support
wires fog the transmission of electricity for light,
heat, telephone and other purposes, and for the
construction, operation and maintenance of pipe lines or
conduits under the surface of said reservation for any
lawful purpose whatsoever , but the grantor shall have the
right to release the premises above described from these
particular easements and rights of way;
PROVIDED, HOWEVER, that whenever the surface of
the ground shall be disturbed by the granto- , its
successors or assigns, for the purpose of constructing or
repairing any such pole line , pipe line or conduit, it
shall become the duty of the grantor , its successors or
assigns, forthwith, at its or their own expense, to
repair and restore the surface of the ground so disturbed
to substantially the same condition as shall have existed
before the time of such disturbance.
