�5 THIS INDENTURE, made the 12th day of October, nineteen
hundred seventy nine between LOUISE H. TIBBETTS residing
at 14 Mount Tom Avenue, Holyoke, Hampden County, Massachusetts,
and ELIZABETH H. COOK, residing at 10 Tory Hole Road,
Darien, Connecticut, party of the .first'part.p,.and ROBERT
B. CALHOUN, JR. AND JEAN N. CALHOUN, his wife, residing
at 81 Tanglewylde Avenue, Bronxville, .New York, 10708,

UC WITNESSETH, that the party of the first part in consideration
of TEN ($10.00)
Dollars, lawful money of the United States, in hand
paid by the party of the second part, does hereby grant
and release unto the party of the second part, the heirs
or successors and assigns of the party of the second

the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk,

Beginning at the Southeasterly corner of land owned

Military Reservation, Mount Prospect Tract, on the shore
oof Block Island Sound or the Atlantic Ocean and running

said land of the United States to the Southerly line
of East End Road (sometimes called Oriental Avenue)
and which point is the Northeasterly corner of land
40 of the United States, thence crossing the East End Road

o of West Harbor or Fishers Island Sound;

as follows:
Beginning at a stone monument set on the Northwesterly
F side of a road forty feet wide, said monument being
twenty-two hundred and ninety-seven and twenty-one hundredths
N ; feet South of a point which is sixty-nine hundred and
forty-seven and twelve hundredths feet West of another
monument marking the U. S. Coast and Geodetic Survey
' Triangulation Station "Chocomont 2" (which said "Chocomont

2" monument is located on the summit of the highest
hill on Fishers Island, N.Y, about two and one-quarter
miles West of the Eastern end of Fishers Island and
lies South seventy-nine degrees twenty-nine minutes
�y and forty-six seconds East of North Dumpling Light in
Fishers Island Sound) ; and running thence Southwestwardly
along the Northwesterly side of said road (and following
C the arc of a curve to the right whose radius is five
hundred and seventy-six and sixteen-hundredths feet

THENCE
North four degrees and forty-one minutes West one hundred
and sixty-one and seventy-seven hundredths feet to a
stake; thence North thirty-seven degrees twenty minutes
and forty seconds West along the Northeasterly side of
a thirty foot wide path eighty-four and seventy-eight
hundredths feet to a stake; thence.,-North forty-five degrees
forty minutes and fifty-six seconds ,East*two'=hundred
seventy and sixty-three hundredths -
feet to a stake; thence
4 South forty-four degrees forty-seven minutes and forty
seconds East one hundred sixteen and four hundredths feet
to a stake; and thence South forty-four degrees forty-
seven minutes and forty seconds East three hundred and
thirteen and eighty-two hundredths feet to the place of
beginning.
Being the same premises conveyed to Louise H. Tibbetts
and Elizabeth H. Cook by deed of Edward P . White,
Conservator of Dorothy White Hubbard, dated December 28,
1976 and recorded in the Office of the Clerk of Suffolk
County in Liber 8167, Page 394 .
Together with all the right, title and interest of the
grantors in and to any easements, rights of way and any
other rights and privileges in respect to these premises
of record and subject however to such covenants, agreements,
restrictions , reservations and easements, if any, now
of record and applicable to the subject premises .
TOGETHER with all right, title and interest, if
any, of the party of the first part in and to any
streets and abutting the above described premises to
the center lines thereof,
TOGETHER with the appurtenances and all estate and rights
of the party of the first part in and to said premises,
SUBJECT HOWEVER, to easements and rights of way granted
by Fishers Island Corp. to The Fishers Island Electric
Corp. and The Fishers Island Telephone Corp. and by
Fishers Island Estates, Inc . ,to Fishers Island Water
Works Corp. by deeds recorded in the Clerk 's office,
Suffolk County and easements for the maintenance, repair
and reconstruction and replacement of any pipes , wires
and other equipment now installed upon the land hereby
conveyed and used for the furnishing of water, sewer,
drainage, electricity or telephone service.
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been incumbered in any
way whatever, except as aforesaid.
AND the party of the first part, in compliance with
Section 13 of the Lien Law covenants that the party of
the first party will receive the consideration for
this Conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for
YON. CURLEY. SCULLY the purpose of paying the cost of the improvement and
& FITZPATRICK will apply the same first to the payment of the cost
