THIS INDENTURE, made the 23rd day of
3 , September , nineteen hundred and seventy-seven between
FISHERS ISLAND DEVELOPMENT CORPORATION, a corporation
organized under the laws of the State of New York, with
its principal place of business c/o Morgan Stanley & Co. ,
1251 Avenue of the Americas, in the City, County and
State of New' York, hereinafter called the grantor, party
of the first part, and NAN E. PHILLIPS of 871 Weed Street,
New Canaan, Connecticut 06840 hereinafter called the
grantee, party of the second part:
WITNESSETH, that the party of the first part,
in consideration of Twenty-eight Thousand Dollars
($28,000) , lawful money of the United States paid by the
party of the second part, does hereby grant and release
unto the party of the second part, her heirs and assigns
forever,
ALL that lot or parcel of land, with the
DIST. 1000 buildings and improvements thereon, in the Town of
Southold, Suffolk County, State of New York, being a part

MOUNT 20 , and thence running Northwestwardly along said
road line, following the arc of a curve to the right a
distance of 100.00 feet to an iron pipe, said curve
00 having a radius of 455.73 feet and the direction of whose

East; thence South 450 55' 00" West 120.00 feet to an
iron pipe; thence due West 200.00 feet to an iron pipe;

iron pipe; thence North 55" 00' 00" East 150.00 feet to
an iron pipe; thence North 20" 15' 13" West 270.66 feet
to an iron pipe; thence North 27" 30' 00" East 200.00
feet to the point of beginning.
Containing 3.83 acres, more or less, and being

Beginning at an iron pipe on the Northwesterly
line of a road, said point being located 2245.72 feet
South of a .point which is 6894.18 feet West of a monument
marking the United States Coast and Geodetic Survey
Triangulation Station "CHOCONOUNT 2" and thence running
North 44" 00' 50" West 95.00 feet to an iron pipe; thence
North 180 00' 00" East 200.00 feet to an iron pipe;
thence North 55" 00' 00" East 110.00 feet to an iron
pipe; thence North 37" 09' 09" West 248.80 feet to a
point; thence South 89" 00' 37" West 273.45 feet to an
iron pipe; thence South 29" 30' 00" West 120.00 feet to
an iron pipe; thence South 14" 38' 10" East 162.48 feet
to an iron pipe; thence South 44" 47' 40" East 424.81
feet to a point on the Northwesterly line of said road,
said point being a point of curve to the left having a
radius of 571.16 feet and the direction of whose radius
at that point is North 36" 34' 40" West; thence North-
eastwardly along the arc of said curve 74.13 feet along
said road line to the point of beginning.
Containing 3.56 acres, more or less, and being
designated by this Grantor as Lot 6 in Block 29.
together with the appurtenances, and all the estate and
rights of the party of the first part in and to said
premises;
SUBJECT to any state of facts an accurate
survey may show; and
SUBJECT to covenants, restrictions, easements,
rights, grants, and declarations of record, if any, and
easements for use of public utilities; and
SUBJECT to all applicable laws and regulations
of Federal, state and local governmental authorities;
RESERVING to the grantor herein from the grant
of the land and premises hereby conveyed easements and
rights of way within a strip of land approximately five
feet wide for the erection thereon of poles to support
wires for the transmission of electricity for light,
heat, telephone and other purposes, and for the
construction, operation and maintenance of pipe lines or
conduits under the surface of said reservation for any
lawful purpose whatsoever, but the grantor shall have the
right to release the premises above described from these
particular easements and rights of way;
PROVIDED, HOWEVER, that whenever the surface of
the ground shall be disturbed by the grantor, its
successors or assigns, for the purpose of constructing or
