PAGNOTTA, S �, residing at Fisher's Island (no street or number) , New York / I2 /S party of the second part, WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part,the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, i, lying and being in the Fishers Island, To of Southold, Suffolk County, State of New York, bounded and described as follows: BEGINNING at a stone monument on the southeasterly line of Ettrick Street, said monument being 1318. 60 feet due north of a point which is 1942. 85 feet due west of another monument marking the United State& Coast and Geodetic Survey Triangulation Station "PROS" ; thence running south 210 23' 15" East 142. 21 feet to another monument; thence south 670 26 ' East 168. 34 feet to ,a stake; thence north 220 00 ' West 274.0 feet to another monument on the southeasterly line of, said Ettrick Street; thence along said street line south 640 47 ' West 91.86 feet to another monument; thence still along said street line south '500 17' West 28. 11 feet to the point of BEGINNING. GRANTOR herein is the same person as the Grantee in deed dated 11/6/53 recorded 11/20/63 in Liber 3615 cp 24. SUBJECT TO restrictive covenants contained in deed recorded in Liber 292 of conveyances at page 320 and repeated in Liber 297 of conveyances page 448, Liber 297 of conveyances at :page 481 and in Liber 864 of conveyances at page 188. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads aborting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered;anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of, the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of.the improvement and will apply r the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
