THIS INDENTURE, made the 17th day of March, 1975,
between JANSEN NOYES, JR., residing at 299 Hollow Tree Ridge
Road, Darien, Connecticut, BLANCRE NOYES, residing at 373 Brook-
, side Road, Darien, Connecticut and EDITH JOHNSON SMISSAERT,
residing at 51 West Road, New Canaan, Connecticut, as Ancillary „
Executors of the Last Will and Testament of Jansen Noyes,

WHEREAS, by Deed dated-July 16, 1957, George Leone and
Grace Leone, his wife, conveyed the premises hereinafter more
particularly described to Agnes B. Noyes, which said Deed was-
duly recorded on July 22, 1957 in the Clerk' s Office of Suffolk
County '.in Liber 43,33 at Page 179 (the "Premises")'; and
WHEREAS, Agnes B. Noyes died ,on February ,16, 1972, a
resident of Essex Count 'New jersey and at the time of her
death', she owned the Premises; and
WHEREAS, the Last Will and Testament of Agnes B. Noyes
was duly admitted to probate by the Surrogate's Court of Essex
County, New Jersey on April 7, 1972 (Probate File No. 10,561-E)
and by her said Last Will and Testament, Agnes B. Noyes specif-
ically devised the Premises to her husband, Jansen Noyes; and
WHEREAS, the Last Will and Testament of Agnes B. Noyes
was also duly admitted to ancillary probate by the Surrogate`s
Court of Suffolk County, New York on November 9, 1972 (Probate
File No. 1698P 72) and
WHEREAS, Jansen Noyes died on July 15, 1974, a resident
of Essex County, New Jersey and at the time of his death, he

owned the Premises; and
WHEREAS, the Last Will and Testament of Jansen Noyes
was duly admitted to probate by the Surrogate' s Court of Essex
County, New Jersey on July 31, 1974 (Probate File No. 11,164-F)
and Letters Testamentary were duly issued by said Court to the
Grantors; and
WHEREAS, the Last Will and Testament of Jansen Noyes
was duly admitted to ancillary probate by the Surrogate' s Court
of Suffolk County, New York on March 10, 1975 (Probate File No. ;.
249P 72) and 'Ancillary Letterz Testamentary were, duly issued, by
said Court, to the Grantors.
NOW, THEREFORE, , the Grantors by virtue of the power
and authority given in and by the Last ,Will and Testament of
Jansen Noyes, deceased," and in consideration of the sum of
Sixteen' Thousand Five Hundred Dollars ($16,500.04) paid by the,
Grantee, do hereby grant and release unto the Grantee, his
heirs and assigns forever.
ALL that certain-plot, piece or parcel of land, with the build-
ings and improvements thereon erected, situate, lying and being
on Fishers Island, Town of Southold, County of Suffolk, State of
New York, being bounded and described as follows:
BEGINNING at a point on the northerly line or side of the
road known as The Gloaming, said point being 1229. 05 feet
north of a point which is 118.37 feet east of a monument
marking the U.S. Coast and Geodetic Survey Triangulation
Station "PROS and
I running thence from said point of beginning the following
six (6) courses and distances along lands now or formerly
of Nazzarino Olivieri and Hedge;
(1) North 21 degrees 22 minutes West, 128. 4 .feet
(2) North 62 degrees 06 minutes West, 45. 3 feet
(3) South 22 degrees 45 minutes West, 31. 88 feet
(4) North 71 degrees 14 minutes West, 31.6 feet to a
monument
(5) South 32 degrees 36 "minutes West, 60. 4 feet to anothe
monument

Punning thence the following two (2) courses and distances
along lands now or formerly of West End Land Company, Inc. ,

(1) North 11 degrees 36 minutes East, 60. 87 feet to a
drill hole in a rock
(2) North 24 degrees 11 minutes 15 seconds Bast,
117.58 feet;
running thence the following two (2) courses and distances
along lands now or formerly of William P. and Rose Pauline
Arasimowicz•
(1,) South 65 degrees 48 minutes East, 141.86 feet
(2) North 24 degrees 12 minutes East, 58.17 feet to the
southwesterly line of a proposed road, and;
running thence along said southwesterly line of side of said
proposed road the following two (2) courses and distances:
(1) South 21 degrees 44 minutes East, 52.51 feet
(2) South 7 degrees 44 minutes 40 seconds West, 177.43 '
feet to the point or place of beginning.
TOGETHER WITH a right of way 15 feet in width for use as a road-
way extending southwesterly across land of William P. and Rose
Pauline Arasimowioz, the northwesterly line of said right of way
being described as follows:
BEGINNING at a .point which is 1481.62 feet North of a point
which is 55.98 feet East of said "PROS" monument and running
thence South 24 degrees 12 minutes West, -53.46 feet.
TOGTHER WITH a right of way over said proposed road extending
northerly and westerly from The Gloaming; to the northerly end
of the above described right of way.
ALSO TOGETHER WITH all right, title and interest, if any, of the
Grantors in and to any streets and roads abutting the above '
described Premises to the center lines thereof.
ALSO TOGETHER WITH the appurtenances, and all of the estate
which the said decedent had at the time of the decedent' s death
in the Premises, and also the estate therein, which the Grantors
have or have -power` to convey or dispose of, ;whether individually
or by virtue of said will or otherwise.
TO HAVE AND TO HOLD the Premises herein granted unto
the Grantee, his heirs and assigns forever.
SUBJECT TO four (4) pole line rights of way, each of
which is for telephone and electric lines, each right of way
being 10 feet in width and the center lines being described as
follows:
FIRSTS
BEGINNING at a point 2 feet southeasterly from the northwesterly
end of the first described line in the above described tract and
thence running North 31 degrees 53 minutes East, 105 feet, more
or less.
SECOND;
BEGINNING at a point which is North 80 degrees 26 minutes East
a distance of 2 feet from the point of beginning of the above
described tract. : Running thence North 22 degrees 22 minutes
West, 127 feet, more or less.

BEGINNING at a point which is North 62 degrees 06 minutes West,
21 feet from the said northwesterly end of the first described
line in the above described tract and running thence North
43 degrees 51 minutes East, 71 feet more or less.
FOURTHm
BEGINNING at the northeasterly end of the above third described
right of way and running thence North '65 degrees 49 minutes
West, ,9 feet, more or less.
SUBJECT ALSO to Pole Line Easements recorded in the
Suffolk County Clerk' s Office in Liber 4111 cp 490.
SUBJECT ALSO to covenants and restrictions recorded in
the Suffolk County Clerk's Office in 'Liber 299 cp ,28 and in
Liber= 512 cp177.
SUBJECT ALSO to any state of facts which an accurate
survey and a personal inspection of the premises might show.
SUBJECT ALSO to the rights of tenants and occupants,
in possession. -
AND the Grantors covenant that the Grantors have not
done or suffered anything whereby the Premises have been in
cumbered in any way whatever, except as aforesaid.
AND the Grantors, in compliance with Section 13 of the
Lien Law, covenant that the Grantors will receive the considera-
tion for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the pur-
pose of paying the cost of the improvement and will apply the
same first to the payment of the cost of the improvement before ,
using any part of the total of the same for any other purpose.
IN WITNESS WHEREOF, the Grantors have duly executed
this Deed as of the day and year first above written.
